Prosecutors Split in Brandy Case

Brandy Law enforcement sources tell TMZ that officials in the Los Angeles City Attorney's office are split over whether to prosecute Brandy for a fatal car accident last December.

Brandy's Range Rover rear-ended a car, triggering a multi-car accident, which resulted in the death of a 38-year-old woman. One source says there was a "conflict" in the City Attorney's office over whether Brandy should be prosecuted at all. The charge on the table, we're told, is misdemeanor vehicular manslaughter.

We're told prosecutors are waiting on technical data that will measure the speed of Brandy's vehicle on impact. The data will help prosecutors determine if the singer tried to brake before impact. The tests are being conducted by a London based firm.

When the results are returned, the City Attorney will make a decision. One source says, "At this point it could go either way."

16. Darla, "what about driving at a "safe speed?" She killed someone. Don't you get it? Someone is dead cause she was either driving too fast, on a cell phone or just not paying attention to traffic. People driving those big SUV's have an obligation to be cautious.

18. My sister accidentally hit an elderly lady about 10 years ago when she ran out in front of her vehicle. My sister killed her, and it was deemed an accident. Brandy didn't intentionally hit the back of the car to hurt that poor woman. Anyway, the victim's family is already taking a pretty penny from Brandy in court. Nothing will bring that woman back, but Brandy has suffered enough.

20. She was on her freakin cell phone and not paying attention when she killed the person in the car. I guess according to Hollywood standards it was a minor accident...screw the person who died from her negligence. Brandi is so sweet....let's forget about it. If her victim was related to me, I would press for manslaugher and own her house, bank account and anything else I could get my hands on.

Shamefully, if you look at Hollywood standards, probably no one will account for the death and Brandi will continue to live the good life while her victim is 6ft. under.

22. Who doesn't speed? Take her license away, but she doesn't deserve any jail time. Lane Garrison is the one who should be in jail for driving under the influence.

27. Do any of you know if Brandy was really on her cellphone? Any proof. You should try to drive on 95 through New Jersey. All those a-holes drive too close and tailgate. Maybe she was following too closely? The girl isn't a criminal by far. Take her license away for a year or two.

28. Further more, I remember when this was first reported. She cut some people off and pulled right in front of them with her big SUV, and SHE DID LEAVE THE SCENE OF THE CRIME. EXACTLY AS THEY REPORTED.

And for you idiots claiming it was just an accident. That exactly right, and accidents happen all the time where damage is done and lives are lost, and in those cases of "accidents" where damage and loss of life occur, people are held responsible for man-slaughter and other crimes due to their "accident".

She is a criminal and needs to be put behind bars where she belongs!!!!!!!!!!

29. Just another black person's behavior being "excused" because they deserve special treatment. If you attempt to hold her accountable, she will place the race card and Al, Jesse or one of the other usual cast of characters will come out of the woodwork hollering racism. 30. Lane Garrison was under the influence of alcohol and cocaine along with having liquored up minors in his vehicle. Brandy wasn't drunk or taking drugs, and it was an accident. She should get her driving privileges suspended and pay compensation to the victim's family.
