Lindsay Cops Plea! -- She'll Do Time

Lindsay Lohan will not stand trial for DUI -- but she'll do a teeny tiny amount of jail time.

She just struck a deal by pleading no contest to two counts of DUI (driving with a .08 blood alcohol level or higher). By law, Lohan becomes a second offender (with two DUIs) and must serve a minimum of four days in jail. But the judge cut that in half by ordering her to perform 10 days of community service in lieu of two of the days. He also gave Lindsay one day credit for time served when she was busted. That means she gets a grand total of one day in jail.

Lohan also pleaded guilty to two counts of being under the influence of a controlled substance (two separate incidents) -- both misdemeanors. She also pleaded no contest to reckless driving.

The judge said Lohan will serve 36 months probation and attend an alcohol education program for 18 months.

As to the controlled substance plea, Lohan was ordered not to use controlled substances. She's also required to enroll in a drug program. She's also required to stay for an unspecified amount of time at the Utah facility where she's currently in rehab.

Lohan was also ordered "not to associate with people with controlled substances."

On January 18, Lohan must show she's successfully completed rehab.

When Hilton plead no contest to a plea-bargained DUI that was lowered to Reckless Driving Due to Alcholol, she got probation -- no jail time. She wasn't sentenced until she violated probation, got caught speeding on a suspending license, etc. If Lohan violates her probation she'll get more jail time -- and I have no doubt that she will.

Can't you just see every stinking celeb laughing their butts off now? LA and celebs are a total joke.

Next, she will sell her photos of her doing community service (propably another PSA where stands in front of a camera, gets served Latte's all day, and warns us all about the sins of drinking and driving) to some mag for 1 Million.

I pray that the next time she drives drunk (you know it's going to happen) that someone isn't seriously injured. But, if they are, they should throw the judge, the DA, and her lawyer in jail with her. They all deserve each other.

51. Lindsay is not off the hook on the felony drug possession charges and I am sure that her attorney has informed her of the dangerous situation she is in. I hope she listened carefully.

The fact that the prosecutor did not file felony possession charges against Lindsay only means that he is not filing those charges 'at this time.' There is a 3 year statute of limitation running on the cocaine possession offenses and the prosecutor can still file the felony charges at any time within that 3 year statute of limitation.

The prosecutor knows that Lindsay would not likely be sentenced to a prison term if convicted on those charges at this time because Prop. 36 (the California Substance Abuse and Crime Prevention Act) allows 1st and 2nd time drug possession offenders the option to receive substance abuse treatment instead of incarceration. But Prop. 36 has no provision for treatment instead of incarceration for a 3rd time offender. So if Lindsay is caught again, a 3rd time with felony drug possession within the 3 year statute of limitation for filing charges on the 1st and 2nd offenses, the prosecutor will file charges on all 3 offenses and there will be no escaping a prison sentence if Lindsay is convicted on all 3 felony possession offenses.

54. I think you should all try dealing with personal addiction or the addiction of a family member for a single month and see how well you fare.

I would not wish this degree of addiction on my worst enemy. None of you understand so shut the heck up and go back to spending your entire day reading your celebrity blogs and living vicariously through others.

It is pretty lame to pass judgement on someone suffering with something you know NOTHING about.

56. The judge just sentenced her to unenployment, because she can not associate with people controlled substances. That means the entire movie and entertainment industry.

She has to change her career into a McJob. Flip burgers for the next 36 months.

So much for the hardcore rehabs, she had been through for the last half year. Instead of a life of an adult, she has no life for 3 years.

60. #55 Do 30 days straight in LA county Jail .... I guarantee you that you will break the addiction and never do it again, same with most any crime.

Believe me when I say I have done it, and I never wanna go back I will do anything I can not to go back.
