25. Perfect Example of Special Treatment for Lindsay Lohan. Why Wasnt Linsay charged with Felony DUI? It will be intersted if they lower the charges on this one too. I bet they wont. Because she is not a celebrity. Remember- The DA looks "individually" when deciding how to charge. IS this mom a felon? We'll see.....

Felony DUI can be charged when there is injury to another person that is caused by a second violation in addition to driving drunk, such as running a stop sign, speeding or any other traffic violation that is cause of an accident resulting in injury. Unless the driver has had multiple previous DUI convictions, most prosecutors don't very often charge Felony DUI when the injury is a minor fracture. So I would guess that this lady has numerous previous DUI convictions that causes the prosecutor to want to send her to prison this time.
