Security Guard Claims Axl Gave Him the Boot

A security guard at a Guns 'N Roses concert is suing the band and lead singer Axl Rose claiming that Rose kicked him in the head while on stage -- back in 1996!

In a lawsuit filed in Los Angeles Superior Court on August 29, Gary Armijo claims that while he was working as a security guard stationed in front of the stage, Rose "intentionally kicked [Armijo] in the head proximately causing severe physical injuries." His injuries were apparently so bad, he forgot to sue for 11 years!

The lawsuit goes on to allege that unless Rose is stopped, he "will continues to commit willful assaults of the nature described herein on innocent members of the public and security personnel, both during and outside of Guns 'N Roses concerts." Wait, people still go to Guns 'N Roses concerts?

UPDATE: Howard Weitzman, Rose's attorney, tells TMZ, "The allegations in this lawsuit are frivolous. There is video of this incident which contradicts the allegations against Axl. Axl vehemently denies he did anything wrong which will be proven via witnesses and the video. Unfortunately anyone can file a lawsuit whether it has merit or not. In my opinion this is a pathetic attempt to get money from Axl."

UPDATE #2: A few astute TMZ readers pointed out the incident couldn't have taken place in 1996 -- GNR wasn't performing then. We're trying to confirm, but the incident probably happened in 2006 -- let's chalk the error up to a typo by the lawyer.

17. There were no GNR shows in 1996. The show they are talking about at the Gibson Amphitheatre was held on December 20th 2006. Not 1996.

22. jimmy sez-- Mr. Rose has quite a history for beating and assulting people. I guess his money has kept him out of the pokey . But he should see the "Foxy Brown" development. That tired bitch is going away for 1 year. Maybe there is "Celebrity Justice" after all. I remember in the 80's he was married to Erin Everly. Don Everly is her Dad.Anyway he was arrested for wife beating . Never heard anymore about that case. Erin got a divorce!!! So maybe he'll go away for a year, then we as a society would be a lot safer.

24. I love Axl Rose, always have. So many actors, singers have been sued by people out for a buck. It is a waste of the courts time and it a great way to get your unknown name into the press. Become a celebrity by suing one. Whether it was 1996 or 2006, it is still quite a long time to wait. If someone kicked me in the head causing "severe" injuries, you can bet I would A.) Have them arrested and B.) Sue A.S.A.P if I was that badly hurt. Please, this will be thrown out of court so fast the "victim's" head will spin.

25. Poor guy it took him 11 years to realize that he should sue and than he will wait another
11 years before he realizes that he did not fet anything out of this, SO he wil file it again, He is having some late effects maybe Axl can kick a few more people on their heads like Virgie Arthur, Rita Cosby, Debra Opri and Elisabeth Hasselcrack. If they can forget things
for 15 years it will be nice.

26. TMZ bring on the video if you get it. We would love to see justice for Axl in that this guy is just trying to get money. I have seen gnr 3 times in concert in 06 and if anything Axl tries to control the crowd by pointing out the idiots that make the show really uncomfortable for others and in most times if that person doesn't stop he gets that person kicked out by security. He isn't going to kick a guy in the head.

Second- who cares if he has dentures or not, dont doubt we'll be having them some day
