The Fight for Nick Hogan's Car

Nick Hogan wants the wreckage of his car back -- but the father of critically injured John Graziano says not so fast, boy.

TMZ has obtained exclusive documents through PIO Wayne Shelor at the Clearwater Police Department, showing that Nick, through his attorneys, asked for his wreck back on August 28 -- and without searches, please -- adding that the vehicle might be "the subject of potential future litigation." Then it looks like Nick got yet another lawyer to represent him in the accident, and they sent a letter as well.

On September 5, Edward Graziano, the reportedly temperamental father of the still-hospitalized John, had his attorneys notify cops that they "preserve the vehicle so that we can have the opportunity to have our accident reconstructionist coordinate a date and time" to examine the wreck.

61. THIS IS SAD BUT I'M SURE THIS WASN'T THE FIRST TIME THIS GUY HAD RODE WITH NICK. AND I HAVE YET TO SEE A 17 YEAR OLD WITH A FAST CAR THAT DIDN'T "GET ON IT" AT TIMES". NICK SHOULD BE PUNSHIED AND LOOSE HIS RIGHT TO DRIVE AS WELL AS GET A HEAVY FINE, BUT PUT THIS KID IN JAIL FOR 20 YEARS ! COME ON NOW THAT MAKES NO SENSE. he was trying to get a jump on the father, but hopefully failed.
this was not an accident as some post suggest or hiring two lawyers to get the car back would not be so important right now.
It's not as if he can drag race it again, I'm sure he has a new one by now for that.

I love reading these posts because it shows me that there are perfect teenagers out there who would never dream of speeding or doing something their parents told them not to do......and parents of perfect teenagers who never do what you tell them not to do. That is awesome. I wish I lived in that community.....because not a day goes by where I live that I don't see some young kid driving like an idiot....but I'm sure their parents know they're driving like that. Because if you tell them not to do that, well....then of course, they're not going to. Kudos to the perfect teenagers posting on here.....and a special "atta boy" to the parents of perfect teenagers posting on here.

I think that nick should be charged just like any normal person would be charged not celebrity status like most of the stars get, if it was anyone else they would have a list of charges that they have to deal with not just some small no jail time charge, give him some jail time and let him get a reality check as well as long term damage, an i hope that the family an atty sue him for as much as they can, make him responsable for the law suit not his dad its not terrys fault that it happened. it sounds like nick has had been givin breaks from the law in the past, so now its time for that to stop..

65. The problem is Nick never had a father.

A father may love his kid more then anything but still has a DUTY to say "That's wrong don't do that, or that's dangerious, or you are hurting others".

Nick was not raised. He lacks morals and commonsense.

Sure he's a young kid and wants to party and race but Hogan has the ability to completely control him since Hogan controls the money, so soon to be 18 or not Hogan could straighten the kid up if he wanted to.

I'd start by making Nick get a real job with real people and not just for a week.

Otherwise one day Nick will lose all of the Hogan money since he's never worked for any and has no idea how to handle it.

And yes Nick DOES need some jail time. For his own good to give him some morals.

When the hell does Nick go to School instead of trying to get this car back he should think of other thing first like he firend John and maybe going to School as long as I have watches that show I have never seen either one go to School what kind of parents give their tennager a fast car and not send him to School I blame Nick for the accident but the blame should really be on the parents for giving him the car he didnt get it on his own they should worry and he should worry about School not cars

69. WOW, after reading every one of the comments, I never realized how many Idiots are in this country.

First, it was an accident, Nick did not intentionally go out and wreck the car. There was no malicious intent. Second, spoiled rich kid, well possible, but what do you really know? Because you have seen the show. I am sure VH1 has scripted most of it, and you watch an edit hour, not the 24/7 life.

Then you comment on all the press. Press will change the words of anyone that will make the story better. So, don't believe every thing you read.

As for the car, the Hogan's should gain access to the car, through a hired investigator. You know that there is going to be litigation in this matter and it is only right that the defendant get access to present their case.

People, you need to set your jealous feelings (from others success) aside, and look at the whole picture. Yes, I agree there should be a complete investigation, If Nick is at Fault, he should be punished to what the law allows. However, what you forget is, that everyone is assuming many things here, there have been no facts released in the investigation. That is why we in this country have investigations, witness accounts are only part of the investigations because people cannot get facts straight.

And finally, everyone asks why there are no charges filed yet? Well, because of the press and people like you that are making such horrible accusations without the facts. The police need to make sure that they have 100% of their case secured. When this goes to court, they must PROVE BEYOND A RESONABLE DOUBT. With the press writing stories that are not the whole truth, and people writing stupid comments, believe it or not, if one person looking at this becomes a juror in the case, and is presented a FACT that is completely different than what they read, what truly stuck in their minds, then to them, they only believe what they are presented. And guess what, Nick gets off. So, if the police take a year, and hope that John recovers enough to get a statement, then good. Because the only 2 that know what really happened, are Nick and John. And right now, John cannot speak for himself.

71. Every time I think I have seen and read it all there is one more thing to shock me. Now Nick wants his car back....disgusting. I just read his message on the Supra website..."John's body is perfect..he just hit his head". I have seen too many head injuries and know how very slim a person's chances are of coming out of it are and coming back 100% like Nick may think will happen. Now he has lawyers, of course he is a minor so the Bollea seniors are paying for that so he can get his car back. I am just sick to death of people like the Bolleas who just cannot stand up to the plate and take whats coming to them. How many more people like John will it take before you all get it? Nick has caused the wreck...I don't care if his friend yelled for him to go faster....Nick was behind the wheel...it was his foot an the accelerator...he made the choice to drive like a maniac on a public street. I am also sick to death of the excuses that we all drove fast at that age..like it is a valid excuse...that we all make mistakes so don't point a finger. God yes we all make mistakes but when you continue to drive in such a dangerous way, and you lose control, hit the median and slam into a tree and your friend regardless of his telling you to go faster is in critical care, you are responsible. Just saying that he is paying for it now because of his friends suffering doesn't cut it. Frankly I don't care what his name is...Nick Hogan Bollea or Joe Blow...or Joe Schmoe and Mary Contrary...when you break the law and cause injury or death to another human being you are responsible. Nick is 17, he is no baby, he is not a child. At 18 you are legally an adult. I sincerely hope that the legal system takes him and others like him to pay the full price for their actions. If he was your son, would you be stupid enough to keep letting him drive? As a minor he is on their insurance, they are also responsible, and it would be like that if he was your kid too. The way to becoming a muture and sensible adult starts at home with the parents. I did some darn dumb things as a kid and my folks were definately not my friends or my bros. I made some dumb decisions as an adult too but never intentionally broke the law or put anyone in the hospital. I paid for every time I screwed up and my folks didn't bail my butt out. I am almost 60 now and see how much the world has changed....it saddens me. I am sad at the idea that so many people feel that even a 17 year old shouldn't have to pay for his mistakes. Yeah, I find it all unbelievable.

Wow after reading so many comments the only one that I see that is truthful and not full of Jealousness etc. is from Sean post # 66 There were a couple of more in here somewhere but most are all people who have never made any mistakes in their own lives. John was in that car because he wanted to be there it was not the first time and I don't think it will the last (well maybe in that car , but they will be out together again) I am sure also that it was not the first time they were racing if that is what was going on. John was there because he wanted to be there. If he was afraid of Nic's driving he would not of been there. He was there because they are friends and I am sure he loved hanging out with Nic and the Hogans, Because he did choose to do so. Instead of throwing stones at someone we do not know say a prayer for his friend . Why is there so much hate, envy and etc. on these posts? God Bless and heal Them ALL. May you have not made a mistake or sinned cast that first stone. At 17 I don't think any of us did not do something that we wished we had not done. Not many Einsteins at 17.

73. The police want to car to get the black box analyzed. This has been used in other cases and the data recovered used for convictions - it will tell speed, throttle position, braking or not, etc. for the moments prior to the crash impact. They are probably also looking at illegal modifications done to the car's safety equipment as well - disabling anti-lock brakes, removing traction control... --- I also think they are waiting for a stable report on John's likely health status or if he is going to even live. They will then wrap it all up into a package of charges against this repeat offender.

74. The Hogans' have made 2 serious mistakes with the children they love dearly:
1-Letting 17 year old Nick own a car that has 1000 horsepower under the hood. If Nick wants to race, then race on a track...in a go cart and work your way up.

2- Leading Brooke on that she can sing. Her new tour...shopping malls??? Put her in front of Simon Cowell and let the truth be known.

How many other kids have been in accidents because of these unrealistic Hollywood car race movies?

75. Wow. Every time I see some fool say that Nick only had an accident, I seriously want to vomit. He "accidentally" hit the gas pedal and was forced to speed? Not likely.

People do make mistakes, and some change lives forever - or end them. It doesn't mean someone who has no problems disregarding the law should be let off the hook.

Blaming the victim is even sicker. No matter what, the onus is on the driver, that would be Nick. He wreked the car in all likelihood while illegally street racing - again for the dense, how is that accidental? He knew what he was doing was illegal.

So to those who seems to think that all is ok because Nick didn't mean to wreck the car (while breaking laws set in place to prevent such things from happening), remember that drunks who get behind the wheel and people who run red lights don't "mean" to hurt others either. That doesn't mean dip to the persons injured or killed due to someone else's wrecklessness.

And if all you can fall back on to determine why people are upset that a repeated law breaker has seriously injured someone due to brekaing the same law again is that people are just jealous, then you have a weak argument or you spend all your time watching tween dramas where personal responsibility means less than blaming everyone else. You know, the rule of being a Hogan.
