Phil Spector -- Hung?

The jury in the Phil Spector trial has indicated to a judge that they have been unable to come to reach a verdict.

Superior Court Judge Larry Fidler says he is considering giving the jury the option of weighing a possible manslaughter charge. The jury is currently considering only a second degree murder charge against the music producer.

The judge has just asked the jurors how they are split. The foreperson has told the judge they are divided 7 to 5. No word on how many are voting for a guilty verdict or how many are leaning towards acquittal.

66. #48 Joe Hammons their was residue on Phill Spector, there was much more on her but she was dead almost instantly . He walked around the crime scene for 40 minutes before the police got there. There was evidence he wiped some things down and moved around the house and that is how the residue on him was diminished. The defense talked about forensic evidence being the key but then said he didn't do it because there was not enough blood on him. A lack of evidence is not evidence. A LACK OF EVIDENCE IS NOT EVIDENCE! They tried to say he didn't have enough blood oh him but the fact is the blood was only in a small area you can see the crime scene photos on line and the spray din't go beyond her lap area which means he had to be very close to her to get even the small amount of spatter that he did have.

67. I live in San Diego, Ca, and I definitely would have found Mr. Spector guilty. I think DDA Alan Jackson did an incredible job, and I feel bad for him, as well as Ms. Clarkson's family, that this may end up a mistrial. I don't know what else Mr. Jackson could have done to help convict Spector. It is obvious, to me, that Spector originally was in possession of the gun, no matter what caused it to go off. If nothing else, his behavior after the shooting proved consciousness of guilt!!

68. Good God....why would Peepaw Spector pick up a gun that someone just supposedly committed suicide with and walk outside holding it and say "I think I just killed someone"....helllllooooooooo.....
I hope the Judge gives the Jury an opportunity to use the Manslaughter charge. I agree he didn't mean to have the gun go off....but, he has done this over and over with other women and in the Studio...yuck.....
Let Justice prevail for the poor woman who can't speak for herself and had her name drug through the mud by so-called 'friends'!!!

69. Doesn’t anyone think that it is weird that Phil Spector was charged with 2nd degree murder? Shooting someone in the face is clearly 1st degree murder, with intent. The prosecution chose to charge Spector with 2nd degree murder, because they did not have enough evidence to charge him with 1st degree murder.

It seems highly prejudicial to choose the charge not based upon the crime, but based upon the likelihood that the state will be able to get a conviction.

If the crime fits the description of a murder with intent, it should NOT be charged and tried and as a “reckless heart” murder, or a murder in which the defendant’s grossly negligent actions caused the death. Shooting someone in the face is not the result of a grossly negligent act; it is the result of intent to cause death. If the prosecution did not have enough evidence to try Spector under a 1st degree murder charge, then perhaps they should not have tried him at all. From the outcome of the trial, it does not appear that the prosecution had enough evidence to even convince the jury of 2nd degree murder.

The idea that “money talks” in California, or that somehow Spector was able to buy his way out of a conviction, is ludicrous. Who are you suggesting that Spector paid off, the jury? The judge in this case is obviously very biased against Spector. To even consider dropping the charge to manslaughter, just so that Spector will be convicted, is outrageous. From what I saw of the evidence, there is good reason to believe Spector did not pull the trigger. The coat that he was wearing only has a small blood splatter, as if he was standing far from Clarkson, when the trigger was pulled.

It is sad that so many people, who were not on the jury, and who did not hear all of the evidence, still insist that Spector is guilty. It shows the ignorant, mob-based mentality of society.

70. There was blood splatter on Phil's white jacket under his lower right sleave which meant his arm had to be raised above his head at the time the gun went off. He's a righty. Even the fastest gunslinger in the west couldn't pull off that stunt. It was her fingerprints only on the unused shells. That would have been impossible to produce that after the fact because her hands were covered in blood. He would have had to be really close to have the gun inside her mouth behind her teeth and there was no sign of resistance. He would have had more blood spatter on his white jacket which he could not clean after the fact. The prosecution offered no explanation for this.

72. This news saddens me. This is obviously a person (so to speak) that has no reguard or respect for women. He did, he knows he did it. What an injustice. What a slap in the face to innocent women everwhere. I hope someone smothers him with his own hair.

74. ratta, you are not correct his arm was higher because she was seated and he was standing above her when the gun fired and at that instant the recoil caused his arm to go up thus the spatter on his sleeve. His hand did not have to be above his head just higher than her mouth which it would be because he was standing above her. She had blood on her hands because she was tring to push the gun away. There were bruises on her wrist that proved she was struggling. In the defenses open they said spatter goes 6 feet so he was 6 feet away when the gun went off but this is not true there was not spatter 6 feet away or 5 or 4 or 3 the spatter was on her chest and lap and on phill spector in was not anywhere else so he has to be standing directly in front of her. The prosecutor didn't charge him with 1st degree because he didn't beleive he meant to kill her. If he put a gun in her face and it accidentally went off that is second degree murder. The prosecutor did the right thing and didn't over charge
