Vegas Cops Don't Have O.J. Tape -- Yet

Las Vegas authorities do not have the audio tape of the confrontation that led to Simpson's arrest, but it's coming soon.

Thomas Riccio, an auctioneer who recorded the tape, tells TMZ that last night, his lawyer negotiated immunity with the Las Vegas District Attorney. Riccio's lawyer wanted to make sure his client would not be prosecuted as part of the team that allegedly robbed two men.

Riccio recorded 20 hours of tape, including conversations with Simpson, as well as interviews with cops after the incident. Riccio's lawyer wanted to make sure the D.A. would not go after Riccio for possible illegal recording, though Riccio says nothing was illegally recorded.



As to whether O.J. knew he was being recorded, we now have an answer. He didn't. Riccio did it of his own accord, placing the recorder on a piece of furniture when it all went down.

Riccio says the initial plan of confronting Alfred Beardsley, a sports memorabilia dealer, was hatched by O.J. and he simply went along with it. Riccio says the plan was to create a phantom buyer of Simpson memorabilia, enter the room and give Beardsley two options -- either return the goods to Simpson or O.J. would call the cops. Riccio says he was stunned that it went down differently.

Riccio says when his lawyer gets written confirmation of the immunity deal, he'll pop the entire 20 hours of conversation in a FedEx box, probably sometime today.

46. Come on Harvey Levin. You yourself has said many times "You don't go into court with dirty hands" especially when you proclaim to be the victim. Cops should drop the whole matter. Harvey I've seen you say it on Peoples Court You can't reward a criminal for the act he's done to cause another criminal act.

48. Riccio recorded 20 hours of tape! If he wasn't trying to set OJ up, what were his motives for doing that? Perhaps he had monetary motives, selling the tapes or writing a book. Doesn't sound to me like the guy just happened to have his blue chip cell phone recorder with him and decide to start recording as things were going down. He had made other recordings with OJ prior to that, so he obviously went there with intensions to record the showdown.
It is also very clear when listening to the recording, that OJ went there to take back what belonged to him, not commit robbery. He never says anything like "give me all your money". Everything he says in the clip leads me to believe he felt he owned these items. You can clearly hear one guy saying to OJ that "Mike took it" and OJ responds, "I know Mike took it", so even the guy with the goods is admitting to OJ that he knows the stuff belongs to him and was taken from him, not sold previously or given away by OJ.
Since OJ did not have a gun, he can't face any weapons charges. I'm not sure who, if anyone, actually had a gun, but it wasn't OJ.
He was told by Riccio that these guys had his stuff. A meeting was set up and the real thieves were expecting a collector to show up. They didn't know who it was going to be, but they were obviously there waiting for someone to come and buy the stuff. It seems to me that OJ was invited to come in the room as an anonymous collector, so I don't see how he could be charged with any kind of breaking and entering or burglery.

50. Nevada Law says both parties must consent to a WIRETAPPED conversation... this was not recorded over a phone or radio... IT WAS RECORDED IN PERSON therefore Roccio (since he was a party to the "conversation" can simply say he "authorized" it and bingo LEGAL RECORDING....

I can record anyone I like in a conversation in NV as long as I am present as a party during the taping.. I just authorize myself to tape the session...

52. All this brewhahha about the tape? The audio recordings taken in the hotel room and of the witness interviews? It's all going to be deemed inadmissible in court and Riccio will probably be charged as a third-party having taped other people's conversations without their knowledge? Against the law in most states? To be continued...On another note; I've known nothing about these so-called "Memorabilia vendors" until now, but they sure seem to REEK? What a bunch of snakes. With friends like those who needs enemies goes the saying...Thank you...

55. My guess is that a judge would rule the tape admissible in court. The statutes cited generally pertain to wire tapping, taping of phone conversations etc. Surveillance of a personal domicile by the resident is generally permissible, and that would apply to rooms rented at a hotel. Whether OJ was set up is a separate issue that the court may wish to consider but bear in mind that the manner in which OJ and his entourage handled the confrontation was entirely of their own choosing.

59. It is NOT illegal to tape a conversation without the consent of the person(s) being taped. If it was illegal 60 Minutes would never have been a TV show. TMZ would not be a TV show.

And it is not necessary for a juror to never have heard of a person or never to have heard about the crime. What is necessary is a juror who can set aside what he has heard prior to being a juror, set aside what he thinks the law is and hear & weigh the evidence in accordance wth what the judge explains the law is, then make a decision using that criteria. Some people can do that and some people cannot.
