Britney Spears Has Lost Her Kids

TMZ has learned Britney Spears has lost physical custody of her kids.

L.A. County Superior Court Judge Scott Gordon issued an order today, stating that Kevin Federline, the boys' father, "is to retain physical custody of the minor children on Wednesday, October 3, 2007 at 12:00 PM until further order of the court."

Mark Vincent KaplanJudge Gordon had ordered Spears to undergo random drug testing and take parenting classes. Sources say Federline's powerhouse lawyer, Mark Vincent Kaplan (left), raised the issue that Spears was driving without a valid California driver's license, something first reported by TMZ.

is reporting that Spears took the kids to the drive-thru at Carl's Jr. at 12:02 this afternoon and surrendered the kids to K-Fed's bodyguard three minutes later.

A source connected with the case says Spears was not focusing on the judge's order last month, and she may not have attended the parenting classes or performed the required drug and alcohol testing.

32. Is anyone really surprised by this? I hate to say it but her kids are better off. She needs to get her life back in order. Maybe it means another stint in rehab or therapy. She definitly seems bi-polar to me and she needs help. Hopefully she'll be able to focus on getting herself better.

40. that's so wrong... they can take her kids when she is at least paying for someone to take care of them... how about these losers that leave their kids at home ALONE... and they still have their kids. She is always out with them.

42. Apparently she was driving around all weekend without a driver's license. And before that, when the judge ordered random drug and alcohol testing, her response was to go out and party at two clubs. Did she think this was all a big joke? I feel sad for her, but everyone could see this coming a mile away. The judge in this case is probably just trying to protect the kids from her irrational behavior.

44. I really think that this is what is best for the kids, i don't think kevin wants her money. Those kids need some stability and we all know britney is clueless. I hope for all their sake this is a reason for her to fight for herself, her dignity, etc.
