Celebrity Justice
Prosecutor in Kiefer Case -- A Slammer Jammer

TMZ has obtained the sentencing recommendations in the Kiefer Sutherland DUI case.

The sentence is complicated, but Kiefer will do 48 days in custody.

Kiefer will do 18 days for the probation violation, surrendering December 21. He will serve an additional 30 days for the current DUI and must complete that sentence by July 1.

Based on what TMZ knows about production schedules, that would mean Kiefer is serving the bulk of his sentence when "24" is on Christmas holiday and not in production -- he may have agreed to the speedy disposition of the case in order to protect the show from having to shut down production.

Kiefer's lawyer, Blair Berk, would not comment on the case.

UPDATE: A rep for Twentieth Century Fox and the FOX Broadcasting Group issued this statement: "Today our friend Kiefer Sutherland resolved his criminal case at the earliest opportunity. Kiefer made clear to us at the time of his arrest that his first concern was the welfare of those he worked with and that he intended to do whatever was necessary to prevent shutting down the show because of his situation. He told us that even if he had to sacrifice more time in custody in order to protect the show and the jobs of those who work with him, he would do so. From what occurred today, it is evident he is a man of his word. We wish him well and look forward to a long relationship with him."

91. He's a grown man & he definitely knows better but I still love Kiefer & 24. He has to clean up his act because he could have killed someone & I hope he finally gets the help he needs. I am sad he's going to jail but it might be good for him. I do wish him luck & happy he took his punishment like a man & didn't whine about it.

93. personally, I have no problem with this. He did the crime, he accepts the time. No fanfare, minimum hoopla. I like him as an actor, now I respect him as a man. I guess us simple people have simple ways, but it works.

98. Hi aJuliet

I think the two sentences are separate and don't have to be served together. I'm just guessing from the way it was worded.

99. Julia dumped Keifer. He cheated on her with a stripper. Amanda Rice. Who cares old news. Just get a driver. Drink yourself stupid. Just get a driver. He should do the full time. He won't and he knows it. Let's hope this doesn't happen again. DRIVER.

100. How many times have a lot of us out there went to a party and had too much to drink and didn't think we were drunk, and drove home? Perhaps we made it home without being caught by law enforcement. Perhaps we were pulled over. Maybe someone even ended up hurt.
Anyone that drinks and has had excessive DUI's has some problems that I believe need to be looked out. I hope someone is able to help him get to the source of why he drinks in the first place.
I don't know about anyone else, but I'd really hate to have my mistakes magnified by everyone.

101. Once again, part of the plea deal is that he MUST serve the jail time. He will serve the time!

-----------------------

Of course he accepts the time, why wouldn't he? It's a PLEA BARGAIN!!!

He got the BEST DEAL EVER!!! Judge Sauer is on vacation!

Personally, I have a problem. He should serve 6 MONTHS in jail, not 48 days.

Kiefer didn't "make a mistake," like we all do. This is NOT his first DUI, or his second, it's his FOURTH DUI.

He could have killed someone, and probably will someday.

103. An ordinary person wouldn't get a chance to choose when they serve their time, the court wouldn't care how it would affect their co-workers, the judge would say too bad, you should have thought about that before you drove drunk. He's not doing anyone a favor except himself because he knows if he went in front of Judge Sauer he would get more than 48 days! And since his alcohol treatment is outpatient he'll probably be stopping by a bar on the way home from the sessions. I don't think he's going to stop his drinking, I see a fifth DUI coming because he got special treatment and he's still not taking it seriously enough. In many states he would be doing more time plus have his license permanently revoked after 4 DUI's and violating probabtion. And an ordinary working guy would have lost his job so I don't feel sorry for him. He's getting off easy.

104. "Normal" people can serve their sentences on the weekends in some cases.

105. Also, in terems of sentencing, it was his second DUI. The first two were "reckless driving," not DUIs.
