Anna Nicole's Doc Challenges Search Warrants

Lawyers for Dr. Khristine Eroshevich, Anna Nicole Smith's former psychiatrist, were in a Los Angeles County courtroom challenging the validity of a search warrant used in last Friday's raid on her Studio City home.

The home of Dr. Erosovich was one of several locations raided by state officials as part of an investigation into doctors who prescribed medications to the former Playmate who died in Florida on February 8th.

Erosovich's lawyers challenged the search warrant as "overly broad" and requested the return of some of the good doctor's personal items, including CDs and DVDs that had been seized in the raid.

Erosovich's attorneys also made arrangements to view all of the seized materials. We've learned the judge may appoint a Special Master to the case. This person ensures there was no "inappropriate seizure," and analyzes the material seized to determine what is protected by doctor/patient privilege and what is not.

In addition, the judge signed several additional search warrants -- what those are for, we don't know. They'll be back in court December 5.

Several agencies conducted searches last week in connection with the Medical Board of California's investigation into whether Anna Nicole was overprescribed medication.

62. It doesn't take a CSI team to know that Anna Nicole Smith and her son were both murdered within days of each other. These were not casual overdoses.

67. After Reading this quote from the Mercury News link on this thread...

"After a medical professional's office is searched, a special master appointed by the court reviews the items and helps ensure authorities didn't seize materials, privileged or otherwise, not covered by the warrant. The doctors' attorneys will have the opportunity to challenge the seizure of these items. "

...I did some reading on Doctor/Patient Privilege...to little ole me, this SEEMS to be in place to protect the Patient NOT the Doctor...
"
"Once a bona-fide doctor-patient relationship is established, the duty of confidentiality"attaches," and in many states, the doctor can invoke a legal privilege, on the patient's behalf, when asked to disclose or divulge information the doctor may have or know about the patient."

http://www.enotes.com/everyday-law-e...onfidentiality

CALIFORNIA: California's legal privilege expressly includes psychotherapists and psychiatrists (Section 1010 of Evidence Rules). Patients must expressly waive doctor-patient confidentiality when they become plaintiffs in civil lawsuits (Section 1016 of Evidence Rules). Doctors may withhold certain mental health records from patients if disclosure would have an adverse effect on patient. (H&S Section 1795.12 and.14).

Another something interesting...imo...

"The attorney-client privilege, perhaps the most important of traditional privileges, can be negated if a court determines that an attorney-client communication has been used to further a crime."

http://judiciary.senate.gov/testimon...70&wit_id=5754

SO, I would surmise, they will try the "OVERLY BROAD" argument...ANYONE have further info or thoughts on this?

69. 1st. It's impossible for doctors who see hundreds, perhaps thousands of people on a regular basis to be certain wether or not an individual is "drug-seeking" or actually has a valid need for scheduled & government controlled meds.
2nd. Going after reputable doctors who regularly have these tough decisions to make, and threatening to demonize & strip them of their ability to practice valid medicine is a tragedy all it's own!
3rd. Being an American Military Veteran suffering from a chronic condition which requires such medicines in order to get through some of the ugliest-brainseering-blood boiling-disabling & wickedly painful days and managing to maintain a positive outlook on life, I've come to understand the uses of the same drugs I, myself, once demonized as a soldier and a younger man.
4th. Since it's unclear what A.N.S. was suffering from to be certain, we may never know the truth.

AND

5th. If the courts of law & our government make it any harder for common joes such as myself who have no history nor want and need for drug missuse or abuse... what's next??

FINALLY, I'm not saying that Anna beneffited from constantly being medicated. I AM SAYING, going after doctors who are genuinely attempting to help sends only one somber message. And it's not a good one.

71. She killed Anna. She knew Anna was abusing those drugs and she continued to prescribe them. Most doctors monitor the drugs they give their patients, I know mine do. Hell, he only give me so much of a particular drug....and gives me a hard time about renewing it....This doctor was unethical and kept prescribing knowing the state she was in and she was abusing the very drugs she was prescribing. You don't need to be a rocket scientist to figure it out. I still think she and Howard are in on it.

Revoke it friggin license....

72.

Howard & Co. is FINALLY going to Pay for what he put Virgie thru.

Larry's also going to know what it's like to have his child taken away from him.

And hopefully they will BOTH, along with a few others, live happily ever after

in a COLD, DAMP Jail Cell for the Deaths of Daniel and his mother.

We will all be Singing Hallaluyah !!!

Rejoicing, we will do.

Amen!

73. You people who speak about the departed so coldly and with such vulgarity will earn your penance in hell.

Anna was an addict and I do think the doctor should be held responsible but to blame Howard is ridiculous. He is not a doctor and did what many attorneys do for their clients daily in Hollywood. You people still want to crucify this man and it makes me sick.
