Howard K. Stern's attorney and Anna Nicole's former bodyguard Big Moe respond to the photos of the late model burning up the Internet.

The above picture -- a so-called "death photo" -- is just one of the ANNA NICOLE SMITH and DANNIELYNN images that have surfaced on the Internet. Watch tonight's ET for more on the photos! Just moments ago HOWARD K. STERN's attorney L. LIN WOOD made a statement on behalf of Stern regarding the estate of ANNA NICOLE SMITH and the photos.

"Shortly after I was retained by Howard Stern, I received firsthand information that MOE BRIGHTHAUPT ("Big Moe") had contacted tabloids offering for sale one or more photographs of Anna Nicole Smith. Yesterday, photographs of Anna Nicole and Dannielynn were posted on various Internet websites. These photographs are the property of the Estate of Anna Nicole Smith and were stolen from her camera shortly after her death. Big Moe denies selling the photographs but admits that he is distributing them. His misappropriation of Estate property is unlawful and his stated motives for doing so are not credible.

"This is another egregious example of deceit and manipulation by individuals and certain members of the media to profit from Anna Nicole's death. Even more disturbing is the fact that selective photographs have been distributed -- intentionally selected to make Anna Nicole and others appear in a false light. Fortunately, the memory card stolen from the camera had been downloaded before it was stolen and the Estate is in possession of every photograph in the series. The other photographs clearly show that Anna Nicole, as she often did, was merely playing for the camera.

"The Estate shall pursue all available remedies against any individual or entity involved in the unauthorized distribution or publication of these, or any other, stolen photographs."

Now, Moe responds to the controversial pictures via his spokesperson PAUL PORTER:

"After reading the statement of attorney L. Lin Wood we find it necessary to respond to a series of erroneous comments. Big Moe has never stolen anything including a memory card shortly after the untimely death of Anna Nicole Smith. Claims of profiting from Anna Nicole's death are equally disturbing. Big Moe would never seek to profit from the disturbing photographs on various Internet Web sites.

"In regard to L. Lin Wood's comment regarding deceit and manipulation the pictures in question through focused eyes speak for themselves. If playing for the camera included Anna Nicole Smith vomiting L. Lin Wood has taken spin to a new level.

"Big Moe continues to mourn the death of his close friend and wonders why those pictures of Anna Nicole Smith were ever taken."

On Wednesday, ET showed you the picture on the right of ANNA NICOLE SMITH that was being called a so-called "death photo" but we can report that it is in fact an image of the late model goofing around and fully aware that she is being photographed.

The digital time stamp from the camera shows that the above picture on the left, with Anna Nicole looking playfully into the lens, was taken eight seconds before the shot on the right.

Although some Web sites were saying these photos were taken moments after Anna Nicole died, they were actually taken January 12 in the Bahamas in Anna's bedroom.

Anna Nicole's longtime friend HOWARD K. STERN told us that these were just a couple of shots in a series where Anna Nicole was joking around and, while eating her favorite fish sandwich, got tartar sauce on her face.

On Thursday we showed you the picture of ANNA NICOLE SMITH on the left -- her hair disheveld and her mouth open wide. Taken just three weeks before her death, it's the image of nearly 5-month-old DANNIELYNN in her arms that makes the photo especially unsettling.

Was Anna Nicole under the influence? The digital time stamp on the picture is January 20, 2007 at 6:15:23. But the photo on the right emerged from the same camera showing Anna Nicole wide awake and alert. The time stamp on that photo? 6:15:24 -- just one second after the image on the left, demonstrating how easily a single photo can cause so much speculation.

These two new photos come on the heels of the now debunked Anna Nicole "death photos" passed around the world on the Internet -- of what was reported to be the late model in her deathbed.

KING: Looking back at the photos we saw, we asked Big Moe, Anna Nicole's former bodyguard, Moe Brightthaupt, for a comment about the photos and the accusations made against him, as a key part of the statement his spokesman gave us. "All accusations concerning distribution and theft of the photos in questions are false. Mr. Stern's 360 spin regarding Big Moe seems to be a calculated diversion. Lin Wood's statement regarding Big Moe 'admitting distribution of the photos' was another example of fiction, not fact."

WOOD: Wrong. I know that Big Moe tried to sell photos. I know it from firsthand information.

KING: Those photos?

WOOD: The photo of Anna Nicole and Daniel after his death. I also know, as a matter of fact, that Moe had the camera card from Anna Nicole's camera, and her videotape recorder, which he took from the hotel room and to this day has refused to return.

So Big Moe and whoever this guy Paul Porter is, is trying to go out and sell those pictures.

STERN: Anna took a lot of pictures around the house. And when you take a series of maybe 15 or 20 pictures, I don't think there's a person in the world who is not going to have one bad picture out of those series. And in this case, that's what was released. And that's what I don't understand. And in terms of videos, Anna was releasing videos on her Web site. So a lot of things were videoed and these things were all stolen from the house and they were aired out of context.

KING: Howard wanted to comment on Big Moe because Big Moe praised you when he was on this show.

STERN: Right, Big Moe obviously said a lot of -- he did a lot of interviews and he always said very positive things about me. And my question now is, what changed? Honestly for him to do what he did, that's the one person that it really hurts. Because I thought that Moe was a trustworthy person.

70. KING: And recently two very disturbing photos of Anna Nicole started circulating. Some even called one of them a death photo. We've obtained two more photos from Howard that he says put the disturbing images in context. You want to describe this for us, Howard?

STERN: Again, it's the same thing with the clown video. These are stolen pictures and somebody released two selective pictures in order to make Anna appear bad and to make me appear bad.

And they are pictures that are taken literally seconds apart that show what they are. One of them is Anna eating a Kentucky Fried Chicken sandwich. And with -- I hate to say it, Anna was not the neatest of all eaters. And she's playing around for the camera she's making a pace, a little pouty face she makes. And she knows the pictures are being taken and they are fun. They are not supposed to be released to the media. We never would have. But somebody stole it and released it to the media in order to make her look bad.

The other pictures with her and Dannielynn when she's sitting in the nursery, and it was a series of about 15 or 16 pictures and they selected the one picture where Anna had a strange facial expression to make it appear that Anna was on drugs. When there's another picture taken literally a second earlier that shows that it's night and day.

And the question is, why are these people trying to manipulate reality to make Anna look bad and make me look bad? And then also make Dannielynn think that Anna was around her on drugs all the time, which is false.

KING: How did they become public?

STERN: Stolen. Stolen, stolen pictures.

KING: For money?

STERN: Well, I can't say but I do believe I know who stole them. I do believe I know who released them.

KING: You do?

STERN: I think I do.

Your time stamp is ETs time stamp this it not the original time stamp and the photo you say say taken one sec later has a cropped head of Anna. So take you spin to Art Harris . We know it doesn't ring truth here. They did not respond to the Photos until three days later. Had to set L. Wood straight. Don't believe that this was shared with him at all. Think it was new news for him. The original time stamp was on the site the pictures where displayed for two day and then the article was removed, but copies where made.

75. What Howie accomplished on the Larry King live Show. He made a fool out of Larry King. He admitted to having sex with his client Anna, not a good thing for a Lawyer to do, he Admitted he lied about his being the Father, He admitted to taking compromising pictures and videos of Anna. He told us Anna was a messy eater. His excuse for taking pictures was Anna did this too. He admitted to taking pictures of Daniels dead. He called Moe a thief and so did L. Wood. He discredited Hatten AGAIN, He discredited Virge AGAIN. He is so tiresome. He told us everything bad about him is out there. So MY guess is that Rita book is correct and he is a Homosexual. Nothing wrong with that unless you are ashamed of your life style. He said he can't work, but really never has had a job, He said his parents are supporting him. He only made 1200 thousand a year. He represented himself on that show as a poor excuse for a human being.
