Joe Says Prosecutor's Gone Wild

Famed attorney Roy Black filed a prosecutorial misconduct motion today against Bay County, Fla. State Attorney Steve Meadows, claiming Meadows exhibited a "pattern of blatant abuse" in his prosecution of "Girls Gone Wild" creator Joe Francis. Black is asking that the case against Francis be dismissed.

The 62-page Motion To Dismiss claims Meadows violated Florida's professional code of conduct and infringed on Mr. Francis' Sixth Amendment U.S. Constitutional right to a fair trial. The motion says Meadows has a "conscious and brazen disregard for its professional and ethical obligations and the Constitutional rights of the [Francis]."

Steve Meadows: Click to watchAccording to the motion, Meadows made disparaging statements about Francis on an interview televised on Vh-1. Meadows, the motion says, violated the rules of the Florida Bar and Francis' Constitutional right to due process, by alleging on camera that Francis was guilty of smuggling drugs into the jail, among other things. The motion states, "The smuggling of drugs actually refers to the defendant's lawful possession of medications prescribed by his treating physician." Francis had two Vicodin pills in his shaving kit when he was arrested -- pills for which he says he has a doctor's prescription.

According to Black, Meadows has repeatedly painted Francis as an "enemy combatant," so deriding his character that Francis will be unable to find objective people to serve on a jury.

Another of Francis' attorneys, David Houston, says, "From the moment Joe Francis and the Girls Gone Wild bus rolled into Panama City during that infamous Spring Break more than four years ago, local politicians and police have waged war against Joe."

"Apparently," Houston says, "Joe's desire to enforce his Constitutional rights has rendered him to the officials of Panama City Florida the equivalent of a terrorist cell."

Francis has been in jail for over six months, without ever having been convicted of a crime.

Meadows' office had no comment.

17. Not that I am a fan of this Joe's work, but I have to ask: Why is he still in prison? Has he even been convicted of anything or even charged for that matter? American justice is so flawed it’s scary. Overzealous, arrogant & vindictive prosecutors seem to plague the system at every turn… Steve Meadows & Mike Nifong should start a club.

18.

Joe Francis is in jail because someone in power doesn't like him. I doubt that I would like him, either. BUT you can't put someone in jail because they piss you off.

This is just one more indication of how flawed the people who run our legal system are. The system is not flawed, it is the people with the power in the judicial system who are abusing it. Just because they can.

20. Aw, poor widdle pornographer.

Lucky for him, his paid shills are defending him on TMZ!

Too bad they can't share his cell and the affections of 300-pound cellmate Bubba.

22. Mel Reynolds got clemency from President Clinton for his federal crimes. And Joe Francis is still in jail and has not been convicted of anything?

Jesse Jackson's New Staff Member:

Mel Reynolds

Jesse Jackson has added former Chicago Democrat Congressman Mel Reynolds
to Rainbow/PUSH Coalition's payroll. Reynolds was among the 176 criminals
excused in President Cl inton's last-minute forgiveness spree.
Reynolds received a commutation of his six-and-a-half-year federal sentence for 15
convictions of wire fraud, bank fraud, and lies to the Federal Election
Commission He is more notorious, however, for concurrently serving five
years for sleeping with an underage campaign volunteer.
This is a first in American politics: An ex-congressman who had sex with a
subordinate...won clemency from a president who had sex with a
subordinate...then was hired by a clergyman who had sex with a subordinate.
His new job? Ready for this??

23. I feel sorry for Joe, but if any of you kept up with this story you would know that Joe put himself in there. First of all if he should have never talked smack to the judge. Second, when the judge told him to settle his case or turn himself in, he took 5 days after the deadline to turn himself in. He could have just settled, but no he wants to be a smart ass and go turn himself in 5 days late. Thats what he gets. However, the fact that he is staying in there to avoid being arrested on the Florida charges sucks and thats not really his fault. But if you watched the VH1 special you can see that the police in Panama city are out to get him, they have a vendetta or something.
Furthermore, I don't think that OJ, or rappers, or people not paying their taxes have anything to do with this case. You people are idiots, Joe Francis is not in jail for a case persay, he's in jail for contempt of court. Snoop Dogg has enough sense to do what the judge says and be respectable to the court, obviously Joe didn't thats what put him there in the first place.

24. Isn't he still in jail there because he doesn't want to come back here to be prosecuted? Did he have permission at that moment to have the Vicoden in his possession in the jail cell? If not, that's smuggling. Besides, the guy has more to look forward to than just Bay Co., FL when he gets out of that jail.

Yeah, sure, other people get away with stuff all the time. More average people than celebrities get out of stuff. It happens. Who cares? Nobody said life was fair. If it were, we would have to build 3 to 5 times as many jails out there, increase the police force by 4 times, etc. just to catch all the 'average' people, I would say at least 60% of which are like the people screaming on this and other sites like this, about the celebrities and their mistakes, errors, bad judgements, ect.
Let's think about it for a moment... how many have had a couple drinks and driven home, hmmmm? How many have had a sick, screaming child and been so helpless, knowing the only way to get the child to remain even remotely calm is to hold it or put the child seat in the front seat, even if you are driving? How many of you speed?
Now, how many of you film underaged girls, knowing they have been drinking illegally, therefore they are impaired in 2 ways (at least-I'm familiar with the clubs around here) with or without their consent in such a sexual manner? And dodged taxes? And smuggled drugs into jail? And 'insulted' a judge? And been in contempt of court? And stayed in jail in another State so your lawyers could keep wrangling the judicial system? Joe Francis is keeping this alive, not Panama City, FL.
If you want to blame someone for this, don't blame the DA, don't blame republicans or democrats, and don't blame me. The blame is firmly in Joe Francis' and his lawyer's court.
Joe, play the cards you've been dealt (after all you dealt them, you idiot) and move on. You are wasting our time and our tax dollars. Oh, and once we're done with you, please don't ever return to our city again. You're not welcome here.

25. I have no sympathy for Joe and his brand of explotation setting woman back several hundred years....however, it seems like the Sheriff in this case had a personal vendetta against him, and the stories about his time in that prison are straightout tales of the deep south. It is like he went to the Deliverance of prisons.

26.

Don't know why the Media is giving him so much Publicity, in HIS Favor.

They must like all the FILTH that he produces.

Why feel sorry for someone that USES YOUNG GIRLS & Destroys their lives !!!

When channel surfing, it is Disgusting to have to see all that TRASH.

Joe should come up with better things to do to make $$$.

With all the $$$ MILLIONS that he has already made,

he should devote his life to Doing something Positive

to help make this world a safer and better place to live.

DON'T Pity him One BIT !!!

27.

I don't like the Girls Gone Wild series, either. I think it's creepy.

But since it is LEGAL, there's not much I can do about it other than not watch it or not buy it.

The young women who are the subjects of the videos are looking for attention by acting badly. Those young women look really happy to be getting on camera. You might consider him an ass for filming it, but those girls are skanks and literally chase around the GGW cameras in order to be on the video. Yeesh.

28. Joe's critics and haters are just jealous of what Joe has accomplished and are kicking themselves in the rear saying "why didn't I think of something like that?"

29. TO # 23 Michelle

His medication was prescriptions. No, it is not allowed until it is approved. If you want to bang on someone taking "illegals" into the jail, how about Lindsay Lohan. She had cocaine on her.

Oh, I forgot. It wasn't her coke and they weren't her pants, right? Maybe that's why she didn't get charged with a felony.
