Joe Says Prosecutor's Gone Wild

Famed attorney Roy Black filed a prosecutorial misconduct motion today against Bay County, Fla. State Attorney Steve Meadows, claiming Meadows exhibited a "pattern of blatant abuse" in his prosecution of "Girls Gone Wild" creator Joe Francis. Black is asking that the case against Francis be dismissed.

The 62-page Motion To Dismiss claims Meadows violated Florida's professional code of conduct and infringed on Mr. Francis' Sixth Amendment U.S. Constitutional right to a fair trial. The motion says Meadows has a "conscious and brazen disregard for its professional and ethical obligations and the Constitutional rights of the [Francis]."

Steve Meadows: Click to watchAccording to the motion, Meadows made disparaging statements about Francis on an interview televised on Vh-1. Meadows, the motion says, violated the rules of the Florida Bar and Francis' Constitutional right to due process, by alleging on camera that Francis was guilty of smuggling drugs into the jail, among other things. The motion states, "The smuggling of drugs actually refers to the defendant's lawful possession of medications prescribed by his treating physician." Francis had two Vicodin pills in his shaving kit when he was arrested -- pills for which he says he has a doctor's prescription.

According to Black, Meadows has repeatedly painted Francis as an "enemy combatant," so deriding his character that Francis will be unable to find objective people to serve on a jury.

Another of Francis' attorneys, David Houston, says, "From the moment Joe Francis and the Girls Gone Wild bus rolled into Panama City during that infamous Spring Break more than four years ago, local politicians and police have waged war against Joe."

"Apparently," Houston says, "Joe's desire to enforce his Constitutional rights has rendered him to the officials of Panama City Florida the equivalent of a terrorist cell."

Francis has been in jail for over six months, without ever having been convicted of a crime.

Meadows' office had no comment.

Funny i love how many of the people who judge and critizize joe for what he does are probably a bunch of closet porn freaks who wish they were the one's who would've came up with the simple idea of filming dumb drunk sluts ( there's PLENTY of them everywhere you go chasing and flashing their fake racks to the cameras) and made zillions like he has before the age of 30.. No # 2 " we " do not know Joe got screwed at all
His sniveling is not proof he got screwed.
His so called mistreatment in the Florida jail was hysterical and dramatic. he likend his walk to the showers there to Jesus's walk to the cross!
Many jails have people even on DUI belly chained for their trip to the court house or anywhere outside of the cell. His other cries of abuse and corruption are things that will be settled through the legal system, so we will see how bad he got screwed when it's all over.

50. It's amazing how fast American's will sell out the constitution because they don't like someone. The difference between Joe Francis having his constitutional rights vioaled and sitting in a jail cell indefinitely and the jabronie reading this post suffering the same fate is-- nothing.

51. I've never personally met the man (as I doubt many posters have) so I can only comment on legal "justice". Anyone who is locked up indefinately at the whim of an aggressive DA looking for convictions under his/her belt is a VICTIM of the system. Ever hear of Duke? What has happened to the woman who falsely accused an entire lacrosse team? How much money is being spent on housing / prosecuting this individual? Who wouldn't agree that the money would be better spent on murderers? Probably the same people who believe Michael Vick deserves life behind bars for dog fighting. HHmmm parents...is killing the family dog equivalent to running over your children? Get Real!!!

52. Like or hate Joe Francis, he was illegally treated by the State of Florida. Personally, I am not a fan, but what has been done to him, should require an immediate release and admission fo wrongdoing by PBC. Black's pleading was magnificent. Way to go, Roy!!!!

56. I watched Greta Van Susteren interview Joe last week. Assuming that his treatment in jail was as he described, all of those involved are going to be facing large civil penalties. The perps (guards) in the jail that committed these acts are looking at hard time. Even the judge should be removed from the bench for forcing him to stay in jail without bond because he would not settle a civil case. Joe had the right to go to trial. No judge can force a settlement in any jurisdiction in USA. The Constitution guarantees an individual's right to bail unless he is a danger to himself or to others.
