Nicole Richie Smoking ... Mad!

A report surfaced yesterday saying a pregnant Nicole Richie was recently seen smoking outside of two NYC restaurants, but that seems highly unlikely... as she's been out of the country and hasn't been in the Big Apple in months!

As seen in these pics, exclusively obtained by TMZ, Nicole spent the last couple of weeks in Australia and Thailand with her baby daddy, Joel Madden. The couple returned to L.A. directly from Asia on Oct. 26.

TMZ tried to smoke-out NY Post columnist Cindy Adams, who published the inflammatory item, but we were not able to nail down the exact date when Nicole was allegedly spotted lighting up. Cindy's spies are clearly a little slow with the tips, as Nicole hasn't been in NYC since September 5 for Fashion Week -- and that was nearly two months ago!

While Nicole, who is due in January, denies the accusation, her rep told TMZ, "It's frustrating when journalists don't check the facts."

19. Some of you can look at pictures pretty well but can't read? The Pic at x17 was from THE SIMPLE LIFE, she was not preggers in it, it was a stunt for the show.

20. The picture that is posted on other sites is a picture with a fake belly when she shot a funny episode of "A Simple Life". It is clearly a fake!!

23. Smoking? So what. Many women smoke while they are pregnant, and this does not make her a bad person. Some of you act like Nicole is doing something really bad. Wake up alot of people smoke who are pregnant and their babies are born just fine.

24. Wow - so judgmental. Pregnancy is stressful!! Those who tell you it's not, are living in dreamland. If she took a hit off of a smoke, so what?!! She's not smoking a pack a day I can guarantee. Just leave Nicole alone man.... first, she's too skinny, second, she's 'not fit'.... the press will always find something wrong so they can get a headline. Her baby will be fine... like previous comments stated, we all turned out fine, didn't we? We drank out of water hoses, ate twinkies, and had no car seats. AMAZING, we're all still here to talk about it... holy pete.... you people amaze me. When you see her hitting a crack pipe, then call me. Until then, let Nicole do what she does....

27. Please... I was lucky to be able to quit smoking when I got pregnant but my Dr. told me to smoke (a small amount) if I felt the need. The stress of quitting cold turkey is worse for the baby than a few drags here and there!
