Nicole Richie Smoking ... Mad!

A report surfaced yesterday saying a pregnant Nicole Richie was recently seen smoking outside of two NYC restaurants, but that seems highly unlikely... as she's been out of the country and hasn't been in the Big Apple in months!

As seen in these pics, exclusively obtained by TMZ, Nicole spent the last couple of weeks in Australia and Thailand with her baby daddy, Joel Madden. The couple returned to L.A. directly from Asia on Oct. 26.

TMZ tried to smoke-out NY Post columnist Cindy Adams, who published the inflammatory item, but we were not able to nail down the exact date when Nicole was allegedly spotted lighting up. Cindy's spies are clearly a little slow with the tips, as Nicole hasn't been in NYC since September 5 for Fashion Week -- and that was nearly two months ago!

While Nicole, who is due in January, denies the accusation, her rep told TMZ, "It's frustrating when journalists don't check the facts."

50. I'm really surprised that so many websites ran the smoking story. The very same blogs had pictures of Nicole in Australia for a couple of weeks while Joel was on tour and over the weekend Nicole coming out of a restaurant in LA.

58. Isn't it child abuse to smoke when you are pregnant? I think smoking should be banned in all public places because it stinks so bad and we are tired of breathing other people's smoke. They are in front of every restaurant and store, on bus and park benches, they hang their cigarettes out their car windows and it blows into our car, it just never ends, we are forced to breathe their smoke all the time and it also causes cancer to the non-smoker. They shouldn't be allowed to do this to us.

59. Nicole looks beautiful & I think tabloids should leave her alone. All of you who are condemning her: Did you see her smoking with your own eyes? Didn't think so. Since this story was proven false I think she should sue! That's what I would do. How did race get brought into this? How ignorant & stupid some people are. Their baby is going to be soooo cute. What if she has twin boys like she always wanted? cute! Just wish them the best and all the happiness in the world.

60. What is wrong with you TMZ? Are you actually looking for material that exonerates a famous person? It's nice to see your site treat a celeb like a real person with real feelings.

Good job and maybe you can extend a little of that feel good vibe toward other troubled vulnerable celebs, namely Britney, your ever-producing "Golden Goose."
