Vanessa to Lawyer: You Can't Sue Me, I Was Just a Kid!

"High School Musical" cutie Vanessa Hudgens is seeking dismissal of a lawsuit filed in September, alleging she owes her attorney $150,000. Hudgens says she was only 16 when she signed the deal, so it doesn't hold up!

In his suit, attorney Brian Schall claims he helped Hudgens earn more than $5 million by advancing her funds for her songwriting and recording career. The suit says that Vanessa "has paid some, but not all, of the money owed ..."

Court papers filed Monday by Hudgens' lawyer, Evan N. Spiegel, say California's Family Code "provides that the contract of a minor is voidable and may be disaffirmed before (age 18) or within a reasonable time afterward" -- essentially, Vanessa was too young to sign the deal. The contract in question was initially signed in October of 2005, and Hudgens officially disaffirmed the contract on October 9, according to court documents. A copy of a two-paragraph letter from Hudgens to Schall nullifying their agreement is attached to her court papers, as is a copy of her birth certificate, which states that she was born December 14, 1988.

The court papers also say the agreement was with the law offices of Schall, not with Schall himself.

46. What kind of lawyer worth his salt has a 16-year-old sign a contract? Surely he could have had her manager or parents sign in her stead and then he'd have some legal recourse. It's wrong not to pay him, but he really should have known better. That's what law school is for.

51. The fact that he's pursuing a contract he knows can be voided, as soon as she becomes famous, casts doubt on whether he's after fairness or publicity. If what was said about the terms of the contract is true, he is to blame for trying to take advantage of a minor. Did he not get the contract countersigned by an adult because he knew they wouldn't be niaive enough to accept it?

52. Ok, there's a thing or two you guys need to learn about law before you can go around blaming Vanessa for not paying him:

One. When she entered into that contract, she was 16 years old. Therefore, she was a minor. Legally, minors are not allowed to enter contracts by themselves unless they have a gaurdian sign with them. This boneheaded lawyer obviously did not know this and did not bother to have her parents, or even her manager, sign along with her. Therefore, it's his own fault that he hasn't recieved most of the money, and Vanessa shouldn't have to pay up for his stupid mistake.

Two. Even if this guy did take her to court, there's no way he'd win anyways. He signed a deal with a minor, and therefore the contract does not hold up in any sensible court of law. The chances of Vanessa losing this case are slim to none. Also, the article clearly says Vanessa was contracted to his FIRM not him specifically. Therefore, if she DID lose, she'd pay the firm, not him.

Three. If this lawyer really did care about the money, not only would he have brought the issue straight to Vanessa, instead of giving it to the media first, but he also would have sued her for the money a LONG time ago. Two years is a long time for someone to realize that someone has NOT paid you the money that you believe you are legally obligated to. Obviously the lawyer who's suing her is less interested in the money, and more interested in the attention it will give him.

Four. It has nothing to do with the money. Someone like Vanessa, who's made over 5 million in two years, doesn't need to worry about something simple like 150K. It's the principle that's the issue here. The fact that someone's using her fame in order to sue her out of money that is not rightfully theirs. I think if people stepped back from the hate, prejudices and jealousy they've built up for this girl, they'd realize how stupid the whole lawsuit is, and how right Vanessa is for not standing for it.

Unfortunately, some people are too stupid to do something as simple as that. I however, condem Vanessa for taking this head on instead of hiding back and paying money like I know a lot of people would. Many of you have no idea what kind of situation she is in anyways, so before you jump on her, take a chance to look at this through her glasses instead of your own.

I'm going to finish with this: let he who is without sin cast the first stone. One mistake does not a bad person make. She screwed up, yes, but she also owned up to the fact that she screwed up, something not many people are able to do, especially in such a high position as Vanessa's. None of you are perfect, so why do you expect Vanessa to be?

56. Vanessa is now a loser in my book. I have no problem about her taking naked PRIVATE pictures of herself and sending them to her boyfriend. That's her perrogative. But the way she was talking about Lindsay, Britney, and Paris' problems on Tyra and calling there choices stupid and making a WORSE decision for her career (for a disney star) and now she isn't paying the lawyer when it's the morally right thing to do. She's crazy if she thinks she is better than any other star making mistakes.

60. Schall's own damn fault. In CA, you CAN affirm a contract with a minor by getting said contract approved by a Superior Court judge, believe it is Cal Fam Code Section 6750 or 6751. Schall should know this, he isn't a newbie... probably some associate lawyer messed up, and did not know about this unique provision of Cal Fam Code. Otherwise, why would Hollywood use child talent without this? Vanessa got a free pass. Good for her... if you don't know some of these basic tenements of Entertainment law, you should NOT be trying to practice it.
