Hogan Blames Victim

For Injuries

Nick's rep, Adam Handelsman, EVP of 5WPR, issued the following statement to TMZ:

"Nick and the entire Hogan Bollea family are saddened that criminal charges have been filed in regards to the tragic single car accident on August 26, 2007.

Nick will meet and answer these charges in the appropriate arena ­ a court of law. The family's primary focus and concern still remains for the continued recovery of Nick's longtime friend John Graziano. The Bolleas will also continue to stand by the Graziano family and help them in any way they can.

The tragedy to both families is compounded by the fact that unfortunately John was not wearing his seatbelt. Thankfully, Nick was wearing his.

Because of what happened to John, the entire Bollea family will make it a priority to increase public awareness about the importance of always wearing your seatbelt. There has been much speculation as to the speed and wet road conditions surrounding this accident. Although all the evidence has not been evaluated, preliminary reports from the experts indicate that this was not, in fact, a high-speed accident. Because Nick is still a juvenile and has no prior criminal record, we are disappointed that he is being charged as an adult offender. However, we are confident that the evidence will demonstrate that this was an accident.

We ask all who follow these events to keep an open mind as to the facts until they have been ultimately determined. Finally, we thank all who have prayed for John's recovery and ask for your continued support and prayers."

It is the drivers responsibility to make sure that all of their passengers are seatbelted. You are the driver, you are in charge. If he refused to put his seatbelt on, Nick had the responsibility to not let him ride in the car. Plain and simple people.

1. open mind means open mind. i, for one, will wait until something has been decided on this case. personally i believe this was accident but both parties contributed. 2. john is a big boy and should have been wearing his seatbelt WITHOUT having to be told. we are all responsible for our own actions. yes it was an accident but john could have walked from this if he had been responsible for his own well-being

Granted, John Graziano should have been wearing a seat belt. That goes without saying.

What Nick DID have complete control of was his actions. His rate of speed. His immaturity.

As in the case of Lane Garrison, there were poor choices made by all. Those young adults should not have asked him to buy more liquor. They should not have asked him for a ride nor invited him to party with them. They bear the responsibility of being where they were at that time. Had they not chosen to get in the vehicle, Lane Garrison would have mashed the car and been the only occupant.

Lane Garrison was responsible for being drunk and high and driving a car. He should not have purchased liquor for underage young adults. He should not have decided to give them a ride or party with them. If Lane Garrison hadn't made his decision, he would have been alone in the car if an accident happened.

In this instance, however, unless it is shown that John Graziano was egging Nick Hogan on (whether it was a contest of speed with another vehicle or simply shouting yee-haa while Nick Hogan was ripping up the road), then there is only one person who bears the responsibility for the rate of speed. That is Nick Hogan.

I don't care if the pavement was wet or not. That is part of the responsibility you have as an operator of a vehicle. If the conditions warrant reducing your speed, then that is what you do. If you are a responsible person.

I can't see where Nick Hogan had acted responsibly as the operator of a vehicle. Not in this instance and not in the many instances where he was stopped for speeding. You don't get stopped that many times without being a habitual speeder. Those were the times he was actually caught, not how many times he actually exceeded the speed limit by an obscene rate of speed.

Man-up, Nick.

There is plenty of blame to go around here and as the driver the majority of it falls at Nick's feet. That said John knows what kind of rep Nick has for street racing/driving fast, most likely knew that Nick had had something to drink, and should have known to always put on your seat belt. He was certainly aware of the fact that he was taking risks beyond those a normal passenger would experience.
