The Audacity -- Hogan Blames Victim for Injuries

Nick's rep, Adam Handelsman, EVP of 5WPR, issued the following statement to TMZ:

"Nick and the entire Hogan Bollea family are saddened that criminal charges have been filed in regards to the tragic single car accident on August 26, 2007.

Nick will meet and answer these charges in the appropriate arena ­ a court of law. The family's primary focus and concern still remains for the continued recovery of Nick's longtime friend John Graziano. The Bolleas will also continue to stand by the Graziano family and help them in any way they can.

The tragedy to both families is compounded by the fact that unfortunately John was not wearing his seatbelt. Thankfully, Nick was wearing his.

Because of what happened to John, the entire Bollea family will make it a priority to increase public awareness about the importance of always wearing your seatbelt. There has been much speculation as to the speed and wet road conditions surrounding this accident. Although all the evidence has not been evaluated, preliminary reports from the experts indicate that this was not, in fact, a high-speed accident. Because Nick is still a juvenile and has no prior criminal record, we are disappointed that he is being charged as an adult offender. However, we are confident that the evidence will demonstrate that this was an accident.

We ask all who follow these events to keep an open mind as to the facts until they have been ultimately determined. Finally, we thank all who have prayed for John's recovery and ask for your continued support and prayers."

I am sometimes astounded by the fact that what has happened here with Nick Hogan is not an isolated instance.

Look how many times Lindsay Lohan has mashed her car while she was drunk/drugged. Look at Paris Hilton, Nicole Ritchie....the list goes on and on.

And it is not simply celebrities who are making such horrendous decisions; there are A LOT of young adults AND adults who are doing the same thing.

WHY?????

Does your right to "have fun" overrule the public's right to drive down the road safely and not take their lives in their hands while they and their families are in their cars going from place to place?

NO! My life, my friend's life, my child's life is worth more than that extra beer, that extra toot of blow, or the thrill someone else gets by pressing the accelerator to the floor for some sort of adrenaline rush.

What I want to know is why these "impaired" people feel that they have the right to decide whether I or my children, friends, etc. live or die so they can scratch their particular itch.

93. In Oregon the driver of the car is responsible for all occupants to be wearing seat belts. If they refuse, the car doesn't move.

95. why did this take months to finally iron out? money talks. and spoiled brats walk. lets blame the victim while were at it. glad the family was out partying over Halloween. Hulk and Nick at seperate parties living it up, the pictures told it all. the victim is in a permanent coma in the hospital with brain damage that can't be reversed. a vegetable the rest of his life. yeah lets party it up you trashy, self centered, CREEPS.

97. This is what they charged him with. Reckless Driving Involving Serious Bodily Injury, Use of a motor vehicle in commission of a felony, A person under the age of 21 operating a vehicle with a breath-alcohol level of .02 or higher and illegal window tint
The driver of the Dodge Viper, 22-year-old Daniel Jacobs, has been issued a court summons for Reckless Driving. And 22-year-old John Graziano III still remains in the hospital on life support.

99. i can't believe they want no jail time because "jerko" has no record. I think he needs to pay for all the times he got pulled over for SPEEDING. It's sure doesn't look like his parents are teaching him how to be resposible - just look at how he talks about driving. I can't belive what they allow that kid to get away with. Not to mention the fact that THEY are the one who encourage him to speed by giving him (a 16-17 year old) those cars.

105. As the driver, Nick is responsible for his passengers. Whenever I get in a car to drive I always make sure my passengers have their seatbelts on. I used to tell my niece the car wouldn't start unless her seatbelt was on.
