Hallmark to Paris: It's Your Fault People Make Fun of You

Hallmark is responding to Paris Hilton's lawsuit, in which she claims they used her image to sell cards -- and their explanation to her could be an open greeting card to young Hollywood:

The company's motion to dismiss said, "Hilton has become a household name, based in large part on her efforts to draw attention to herself. Having done so, she has subjected herself to public scrutiny and the parodist's pen. The First Amendment does not allow her to respond by welcoming the fawning and flattering, but silencing the critical and comical."

Hallmark, when you care enough to send in the very best attorneys!

46. Brilliant response from Hallmark! That company has never really registered on my radar before but I now have a new found respect for them. Good for you Hallmark for not kowtowing to another vapid, spoiled celeb. I expected the usual blather about how sorry they are and how they never meant to offend, but i am pleasantly surprised!

51. It's a motion, thats all. There is a counter to each and every thing they say the law is, this is their opinion.
Yes it is well written but it is only one side of an argument.

When it is countered then the court will decide to go forward or to dismiss.

All you people who are dancing in the street over the fact that their lawyers can, after months, write well might be shown to be fools if the court decides that they are wrong.

They deliberately printed her picture and her copyrighted words on their card that they were selling for profit.

In law there is more to this than their well crafted excuse.

53. Hallmark is absolutely correct. She's a shameless media whore who would publicize herself taking a dump if she thought it would get her more attention & make her more money. She's put herself into the public domain with her own actions; she's made sure everyone knows who she is, due to her media whoring. Now that she's in the public domain due to her seeking publicity, she can't have it both ways. She's going to lose this one, and Hallmark knows it.

I hope she spends MILLIONS of dollars on attornies, only to lose it in court. "That would be hot..."

As far the as the copyright of "That's Hot," that's ridiculous. Hilton isn't suing for this reason -- that's just a smoke screen. She's looking for $$, and is annoyed at anyone who says or does anything she feels makes her look foolish -- regardless of the fact that she has left herself wide open to this type of ridicule by her very own actions. Parody fits this situation perfectly.

When TMZ last ask people to vote on this issue, over 80% of the voters agreed with Landmark.
