Nick Hogan Crash: A Tale of the Tape

Nick Hogan's camp is trying to turn the tide of public opinion by offering up exclusive new video shot just a few hundred feet from the sensational August 26 crash that left his former Marine buddy in a vegetative state.


The images, captured by a nearby security camera, appear to show Hogan's yellow Toyota Supra and another silver Dodge Viper, driven by pal Daniel Jacobs, stopped at a red light mere seconds before the smash-up. Then, they contend, Jacobs' ride momentarily got stuck behind a stalled car. That could contradict eyewitness reports that the Hogster and his buddy were drag racing.

Nick's attorney, Kevin Hayslett, spoke exclusively to TMZ and told us exactly what he thinks the video proves.

"This video is so important," Hayslett says, "because there are people that law enforcement relied upon who said that Nick was driving a particular way on this particular stretch of road. They are claiming that he was speeding during that time period, driving recklessly, losing control of his car. One witness even claims he got to the intersection on Missouri Avenue and Court Street and had to slam on his brakes and nearly went into oncoming traffic.

The allegation of street racing is totally inconsistent with the video. If there is any race going on, even if the Viper was in a race, Nick wouldn't know he was in it because he was so far ahead. That videotape is a complete 180 from what people claim happened and if they are wrong on that, how can we be sure they are right on other things?

I think eyewitness testimony is the least reliable. That's why we have instant replay in football."

91. There should be an investigation of the Florida Highway Patrol to identify the officers who let Nick Hogan off for speeding on multiple occasions during the months preceding this accident. The dates and locations can be determined. The officers can be subpoenaed.

By letting Nick Hogan free, despite radar evidence of speeding WAY over the limit, those officers contributed to the ruining of John Graziano's life.

Come on FHP, where is your internal investigation? Come on, State's Attorney, where is your independent investigation of the FHP?. Come on, Florida newspapers, where is your investigative instinct? Please work on this debacle.

People on Florida roads are still being put at risk because of this let-em-slide attitude of FHP officers towards celebrities, friends, and those witht the right connections. People of Florida, please demand that the FHP be investigated.

I think once John's injury's are seen in black & white anyone will see a seat beat would not have saved him from where he is right now.
I'm sure if the driver had told him the car was going to suddenly accelerate in a race on a public street he would have put his belt on.
The passenger has little control on how the driver will behave.
It's been the Hogan's game from the start to blame John for not wearing his seat belt and some dumb asses are eating it up like candy.

93. Seat-belt (YES/NO) who’s to blame? Who Cares! I once had a co-worker who once ran a curb and went face first into the steering wheel. Had she been wearing a seat-belt, she probably would have walked away with nothing more than a scratch (it’s believed?) But she ended up with multiple facial surgeries and a very long and painful recovery period. Her face was a mess! From that day forward (even before it became mandatory by law) I have made it a point to wear my seat-belt. If I’m going to be involved in a wreck, I don’t want to have to wonder for the rest of my life whether I would have faired better, if only to have worn a seat-belt? If you’ve never tried it; the first couple weeks will feel confining and uncomfortable. Come the day you get behind the wheel, pull out into traffic and feel strange (weird) and not being able to figure out why until you realize you forgot to ‘buckle up! If the least you can do is buckle up, it may just be the one thing that will save your life and spare you unmentionable pain? Wouldn’t you rather walk away but for a scratch, or are you a glutton for punishment?

95. So all that proves is he mashed the gas pedal when the light changed and for all intents and purposes, ended the life of his friend, because he’ll never be right again. I don’t see how a seat belt is the issue. He was forced back into the seat and his skull was fractured by the head rest. Now if Graziano had flown out the front windshield, then I could see all this talk about seatbelts.

Hogan’s kid had alcohol in his system. How do they explain away that?

96. II have to wonder if anymore information will come out regarding that 'day on the boat' with Dad - Didn't the supposed driver of the Viper; Danny, tell officer's that he had drank a couple of beers on that boat before they 'all 'set out for dinner?

Could that have been where both John and the underage Nick had drank before the incident ?

Hey - Wasn't 'Father of the Year; Terry (Hulk) Boella the owner; as well as a passenger on that same boat?

I can only guess that if the son pleads no contest; that several of the facts will never come out - . John certainly won't be able to reveal anything.

Nick Boella will likely spend the rest of his life being compared to an O.J. Simpson type of personality.

In the court of public opinion; any of the "Hogan's" ' future, public service attempts regarding the use of seatbelts; will be viewed as no more than a joke.

A self-serving, sick joke.

97. Nick is still responsible because as the driver of the vehicle, one must not allow his passengers to NOT wear one. If I am driving, I tell my passengers that my car doesn't take off or go anywhere unless they are wearing seat belts. Nick, stop blaming everyone else, but yourself. You were speeding and had a lapse in judgement. Now, you have to pick up the pieces.

99. hogan is guilty. and hulk has no one but himself (and his wife) to blame. maybe, just maybe, if they gave their son some attention this wouldn't have happened. instead they are obsessed with their daughter, who is going to end up like brittney once she finally has some freedom. nick has obviously been crying out for help for years with all the speeding.

100. My prayers are for John and all his family and friends who would rather be lying on that bed instead of him. Keep your faith strong and never give up hope. As for Little Nicky, well it's time to pay the fiddler. Bad bad choice you made that day. Maybe instead of drawing naked ladies and naming your dumb cars stupid names you should spend more time in chruch asking for forgiveness in all the dumb things you .do. Do you realize how bad you hurt your family as well. Grow up it's all matriealistic crap, but life when only have one so take care of it. The intersection on video here is one of the first busy intersections coming off of the bridge and through Sci Fi Land from Clearwater Beach the accident occured at least a block and a half east of the intersection your seeing.This is BS.Have any of these "journalists" reporting on this story even thought of booking a trip here(Clearwater)?To actually see what they are reporting and get the facts ,like this kid was on Daddys boat @ Shepards and tried to get into the tiki bar the same day as the accident. No one seems to be reporting the facts.What is going on?Lies? cover ups?This 16 year olds licence and insurance should have been cancelled by his PARENTS after his 2nd speeding ticket.

103. I saw the video, it appears that Nick peels out at a high rate of speed from the stoplight. If he's peeling out, then he has no idea that his racing buddy is stalled and as far as he's concerned the race is still on.

More importantly, where's the time stamp? This may sound hokey, but maybe there are two parts of this tape and we're only seeing one. Maybe the buddy says to Nick 'hey that didn't count, I stalled, let's take it around the block and try again?" Maybe it was the second time around that Nick crashed and this is really the first time around. That would also account for him being able to hit a higher rate of speed, because he may have seen from a distance that he had a green free and clear.

As for people saying that he was only going 20 miles faster than the speed limit, please note the police report where it states 'at least 60 miles an hour', that means 60 was the miniumum he was going. Even if he was only going 20 miles over, there is a reason for posted speed limits, and that is because the area can not tolerate faster levels and still remain safe for other drivers and pedestrians.

Whether Nick was speeding or not, here was a 17 year old kid with alcohol in his system, driving at an unsafe speed for the conditions, with a passenger without a seat belt. That says guilt to me.

This is what a Hogan Press Release should read, being mindful that any admissions on paper are admissible in court:

Nick Hogan was arrested today for reckless driving and other offenses. The Hogan family is devastated by the injuries suffered by their good friend John Graziano, and are doing all they can to insure a speedy recovery. As the driver of the vehicle, Nick Hogan, feels horrible about the crash and his concern for his friend is at the forefront of his mind. The Hogans ask that you join them in praying for a quick recovery for John and his family.

See. It's easy. I'm not even a PR person, nor do I know of any of the parties, and I was able to take 5 minutes to type up a much more sincere press release.

26. this was an accident! plain and simple. the marine wasnt wearing his seatbelt and nick was. thats why the marine is in a vegitative state and nick is perfectly fine. If this was such a "high speed" crash, nick would have been injured regardless of wearing a seatbelt or not. His friend had nothing holding him back from hitting the dashboard, or flying out a window, and it was his fault for not being responsible enough to put it on. this tape shows nick stopping next to his freind to wait for him. look closely and you'll see the stalled car infront of his friends car. as soon as the stalled car moved so did nick and his freind. stepping on the gas at the same time right next to each other doesnt automatically mean your drag racing. it means you pulled next to your friend, stopped, and waited for him. everyone needs to lay off nick and focus on the facts. WEAR YOUR SEATBELT. thats the only lesson learned here.

An Accident caused by:
#1. Excessive speeding
#2. Excessive speeding on wet roads ( Even the posted speed limit is too high in the rain)
#3. Underage drinking
#4. Illegal street racing / drag racing. Sorry to burst your bubble babe but 0 - 60 in 2 /3 seconds along side another car is racing.

You can try an spin it as many ways as you want, but criminal behavior led to the Accident.
If you truly believe the Former marine is reponsible for this situation perhaps you should come to california and Discuss Lane Garrisons case with the parents of the Teen He killed in his crash.

BTW - Rate of impact, tire tracks and level of impact are facts. You can try to spin it all night long. But those logistics are written in Johns blood.

105. Everyone is judging nick just becasue he's "from a rich family", etc. That only shows your own problems with being self-righteous and judgemental.

okay, maybe he has prior speeding tickets, but that doesn't mean he was speeding this time, as the video clearly shows that he was not. Don't assume people, don't assume.

Oh and yea, "personal responsibility" applies to John as well. If he had worn his seatbelt as he is required to do both by the military and FL law, then he would be okay. yes, it's a shame he was injured and okay, he's a marine, but that doesn't automatically absolve him of being responsible for himself to simply buckle-up.

this is nothing more than a tragic accident. those calling for a pound of flesh from nick are just being vindictive.
