Brandy Almost Off the Hook

The clock is ticking for the L.A. City Attorney's Office to file criminal charges against R&B singer Brandy, who was involved in a multiple car crash that killed Awatef Aboudihaj, the mother of two boys. The first anniversary of the accident, December 30, is fast approaching, but Brandy has not been charged.

Sources tell TMZ that the City Attorney's Office plans to make a decision at the very last moment. If charges aren't filed, chances are the public wouldn't notice over the holidays -- and the case would quietly go away.

TMZ spoke exclusively with Bill Sayed, lawyer for the victim's husband, Marouane Hdidou. Sayed questioned the delay, saying, "There is a death and obviously reckless driving involved, which is enough evidence for an involuntary manslaughter charge. As to why the City Attorney has taken this long? I think we would all like to know."

Over the past year, Brandy has pursued her usual activities; shopping, partying and living a normal life. Sayed says, "Brandy continues to live life with really no negative results ... doing what Brandy is doing ... as if though nothing has occurred here." He also describes how life has become a roller coaster for his client. "Thanksgiving just passed and he was all alone -- he has no family here."

On December 30, 2006, around 10:30AM, Brandy was driving her brand new Range Rover northbound on the 405 Freeway at about 65 mph -- and didn't notice when traffic in front of her slowed down. She then hit Awatef Aboudijah's car, which veered to the left and was hit by another vehicle before crashing into the center divider. Awatef died at the hospital eight hours later, from massive internal bleeding.

16. I don't think Brandy should be charged, look at Rebecca Gayeheart, she killed a child because she was driving recklessly and irrepsonsibly, now she is all over the place doing one movie after another, everyone forgot she killed a child. SHE'S the one I would have liked to see in jail for a few years. So if everyone can forget what Rebecca did, she buzzed by stopped traffic and killed a little boy because she was talking on her phone and didn't think she should have to stop for A CHILD, I think all these "forgiving" people should do the same for Brandy.

17. If she was following at a safe distance she wouldn't have rear ended the car in front of her.

19. To addicted to trash magazines- that's what I'm saying. Brandy is at fault!
Not to mention shortly after the horrific crash, Brandy was out partying it up!

21. If she's going to be charged with anything, it should be Involuntary Manslaughter (If ya'll don't know what that means, look it up!!) She was being a stupid freakin' idiot behind the wheel and didn't slow down when the traffic infront of her began to slow..I guess she missed those big red things on the back of those things with wheels light up or perhaps she didn't notice those big things with wheel where becoming surprisingly close to her ... She's a douchebag.

22. I think she should be charged. I read she was on the phone at the time. How can someone be so reckless. Her actions have cost two boys to grow up without their mother. And look at the picture of the rear of that car,if that is a "tap" I would hate to see what it would have been if it was not a "tap".

23. To all of you who say "it was just an accident"....I hope someone on the highway who is NOT paying attention doesn't run into a love one like a husband, wife or your kid and put them 6 feet under.......Then, we can all say it was an accident and I'm sure you'll forgive the one who "accidentally" killed someone close to you.

27. TMZ really knows how to spin things. Brandy wasn't partying shortly after the crash. In fact, she was out of the lime light for a long while. Not to mention, when she was out, you could tell she wasn't taking the situation lightly because she looked a total mess. I'm glad to see that she's picked herself up and is trying to live a normal life. People that say she should rot in jail etc. over an unfortunate accident are simply stupid.

28. 65mph is speeding

*no drunk driving
*not on cell phone
*has drivers license
*had insurance
please tel me which law has been broken

I do feel sorry for the loss of a life but like others say this can happen to anyone. If it happened to me I would be devastated (I'm sure she is) but I wouldn't want anyone to consider me a criminal, a bad driver yes, but not a criminal

29. I agree with you Mike #. Guess in California the laws are different for celebraties who START the accident, regardless if they were speeding or chatting on cells, But then, in Hollyweird, they also get away with knife slashing murder, shootouts at dinner restaurants with ex's. Come on over to my state.....in my jurisdiction....you gonna do big TIME.....
