Gary Collins Won't Be Charged With Manslaughter

Gary Collins will not be prosecuted for manslaughter, even though the man he hit the night he was busted for DUI died.

Collins copped a plea last Thursday to DUI. The next day, 89-year-old Warren Gates died from his injuries in the crash. Gates has been hospitalized since the accident last October.

Prosecution sources tell TMZ Collins will not be prosecuted for manslaughter for two reasons. First, officers say Gates caused the crash by making an illegal left. In order to prosecute for manslaughter, the D.A. must prove that Collins caused the accident. Also, because Collins pleaded no contest to DUI, double jeopardy attaches. So Gary will serve his 96 hours in jail and then it's case closed.

You'd be all over this story if it was BRITNEY. but because you guys arent intrested in Gary Collins..it's just a side note for you all..

19. Why in the hell was an 89 year old man driving in the first place? People in that age group don't see as well (especially at night), have slower reaction time, and don't always use good judgment. (Sounds like the same problems as drunk drivers - doesn't it?)

Besides, the old guy is the one who made the illegal left turn in the first place!

21. Maybe the 89-year-old shouldn't have been driving in the first place? He is the one who was at fault for the accident, not Collins. Maybe if Gary hadn't been out driving, the other guy would have plowed into a family with young children in a minivan and killed them instead.

Does anyone remember the old guy who ran down all of those people at the Santa Monica open air market a few years ago?

Yes, Collins was out driving drunk, but he didn't cause the accident - the 89-year-old man did so Collins can't be charged with manslaughter. Some of you people are absolute morons saying that he should go to jail for murder (not even manslaughter, you have to say murder which is ridiculous). Leave your computers and go outside or maybe focus on your jobs and actually work instead of sitting in here all day.

23. I don't think double jeopardy would attach because to be accused of manslaughter you do not have to show the elements required to be guilty of DUI. Double jeopardy requires that both crimes have the same elements. That isn't the case here. You can show that someone is guilty of manslaughter without needing to show they are guilty of DUI.

25. How is it even possible for an 89 yr old man to be driving? Where is his family? Why was he allowed to drive at this age? Gary did not cause this wreck.

What makes me sick is had the shoe been on the other foot, and Gary Collins was responsible for the death of pets, and Vick was responsible for a manslaughter, there would be uproar that Vick got away with murdering a human being. Point blank, all life is precious, but because we've ALL grown accustomed to de-valuing human life, other life forms tend to be thought of as more precious.

Kiefer got 48 days for several reasons: because it was his *fourth* DUI (the first two were plea bargained down to reckless driving), because he was still on probation for his third DUI when he got his fourth DUI, and because he agreed to a longer sentence in return for some flexibility in serving his time. Since the writers' strike put his show on hiatus, he didn't need the flexibility after all. Oh well, sucks to be him. I don't have much sympathy for Kiefer and his massive self-inflicted alcohol problems. Quite the contrary, I wish every celebrity popped for DUI had to serve at least 48 days, the girls too (they always seem to let female celebrities off especially lightly, don't they?)

But this explanation about Collins is crap, he ought to be charged with manslaughter. I don't see how double jeopardy would apply - vehicular manslaughter is a seperate charge from driving under the influence.

Human life is cheap in California, it seems. I wonder how much time Kiefer will serve when he kills someone - you know he will, eventually.

28. This is nasty, disgusting, and repulsive! But, the law is the law, and double jeop is in effect. I am surprised the DAs office moved so quickly on this when there has always been a looming chance that the elderly victim could die! The Plea isnt final until it is accepted and ruled upon by a judge and court, so the double jeop. rule really isnt in effect yet...unless he has already been before a judge......Calif is a odd state to practice law in because of the different speeds at which they operate. I havent enjoyed practicing law there, but its better then living in any other state!

29. Being 89 does not automatically mean you can't drive. Just as being 21 doesn't automatically mean you can.

30. OK - IF YOU ARE GOING TO TALK ABOUT MICHAEL VICK HERE GOES. IF I WAS THEJUDGE I WOULD HAVE SENTENCED HIM, TO BE TIED TO A POST AND THEN LET 100 PIT BULLS IN AND LET THEM, HAVE AT THAT SOB. HE IS NOTHING BUT A PIECE OF CRAP IN MY EYES AND I HOPE HE NEVER PLAYS THE SPORT AGAIN. THE CREEP.
