Gary Collins Won't Be Charged With Manslaughter

Gary Collins will not be prosecuted for manslaughter, even though the man he hit the night he was busted for DUI died.

Collins copped a plea last Thursday to DUI. The next day, 89-year-old Warren Gates died from his injuries in the crash. Gates has been hospitalized since the accident last October.

Prosecution sources tell TMZ Collins will not be prosecuted for manslaughter for two reasons. First, officers say Gates caused the crash by making an illegal left. In order to prosecute for manslaughter, the D.A. must prove that Collins caused the accident. Also, because Collins pleaded no contest to DUI, double jeopardy attaches. So Gary will serve his 96 hours in jail and then it's case closed.

46. Michael Vick sould not get any time for his offense. Those dogs should be blamed for wanting a career in dogfighting. Why did their families allow them fight in the first place.

And as for Gary Collins, how can you charge a man who was once married to Mary Ann Mobley with anything.

47. That sucks man! And you were in California too!!! Usually they are pretty easy on remorseful first timers, but the driving on the suspended license must have been why they added on the extra times! 3K isn’t too bad in 07 or 08, cause they have dubbed it the "10 thousand dollar ride" now. I have heard about police doing the same tactic they used on you to re-bust peopl. Was the arresting officer the same one that pulled you over, or just a fishing cop with a short quota? Can you tell I work defense, haha!

48. I know ppl that have gotten several DUI's and have'nt spent a day in jail. One guy had five and had most of those dropped down to reckless by his lawyer.

50. Cause I was .145 and only got one day of community service, and a 3-month class. But, then again, I did agree to pay a hefty fine, 4500 when all said and done....plus a bunch more in court fees. I think I was out 7K when all was said and done...

51. Sorry Rik, He was wasted and someone ended up dead. Sorry if I dont feel sorry for him, nor do I want to leave him alone. What if it was your father that ended up dead....come on, why do you care about this guy Collins, liked his TV Shows or something? Cause I bet his family liked him more than any B-rate flick Collins was in. He commited the crime, he should do the time!

52. Ya man it sucked... I have never been to a real Jail before that.. not like Kiefer. And I had to change to survival attitude kill or be killed and inmates were killing themselves around me.

All in all I survived but I never want to go back F That place it's like a Gulog in Germany during the holocaust.

What's F'd up is although you commited the crime the state doesn't give you a way to atone for it they expect you to go to work, and alcohol classes and back and forth to court for progress reports but they won't give you a restricted license to do it. They won't even allow you a blower in your car to get you through.. they just say OOOHH you did it now . now go lie down in the gutter in a blanket and live the rest of your life like a bum cause we won't give you a license.

F them, F the system, F the cops as they are the biggest offenders of drinken driving, F the judges. I abide by the law, but I don't respect it as it doesn't respect me.

54. Hey man, I hear you! I am just glad I didn’t end up going to jail, but I learned my lesson really quickly! I saw this un-even justice occur even when I was in court. The day I was there, I think I was the only person wearing a suit, let alone with only person with a graduate degree appearing before the judge that day. Each and every other person was sentenced to more time then me and harsher punishments, and the only reason I got off easy was because I could pay the fine. Even though I was happy I wasn’t going to the slammer (hehe), i was pretty disgusted by the treatment that was dolled out based purely on looks and money.

I never understood why the restrictions were so hard for people that were just trying to drive to and from work and essential functions. If you atone, then the law should reflect that, but unfortunately, justice truly isn’t blind, and it is horrific that this kind of stuff still happens today! Working man trying to get his life back in order v. some jerk who really never tried to change his actions and killed someone.....I feel for you man!! I would have hated to be in that situation in jail...Rock on man! Glad to hear you have learned for your mistakes like so many of us....unfortunately there are too many people out there that screw it up for the truly reformed!

57. HAHA!! "If you dont kill them, they will kill you." I have a full blood American pit that play with my children all the time, and I have never once been fearful for their lives. Nature vs. Nurture. Vick made those dogs into killing machines, and he deserves what he gets, regardless of Collins situation! Pit Bulls can be wonderful dogs, but they can also be horrible killing machines like any other animal trained to do that. I have seen a pony turn violent because of its owners, so I dont accept that horrid statement that you need to kill them before they kill you....You realize how dumb that sounds??? ITS A 30-70 pound dog!! Who cares about lock jaw, my other dog, a basset hound, can cause as much damage as my pit if I trained her to do so....arggg…you wanna talk about Vick, then talk about it on that page, not here….Collins and Vicks situations are totally different, went to trial in different states, and had different social pressures!!

59. I guess I can understand that. Whether Gary was "under the influence" or not, he did not cause the crash. Now, had he not have been "under the influence", maybe his reflexes would have been a little quicker.
