Gary Collins Won't Be Charged With Manslaughter

Gary Collins will not be prosecuted for manslaughter, even though the man he hit the night he was busted for DUI died.

Collins copped a plea last Thursday to DUI. The next day, 89-year-old Warren Gates died from his injuries in the crash. Gates has been hospitalized since the accident last October.

Prosecution sources tell TMZ Collins will not be prosecuted for manslaughter for two reasons. First, officers say Gates caused the crash by making an illegal left. In order to prosecute for manslaughter, the D.A. must prove that Collins caused the accident. Also, because Collins pleaded no contest to DUI, double jeopardy attaches. So Gary will serve his 96 hours in jail and then it's case closed.

To both Al and Mr. Beerhouse posting: Keep in mind you likely, after the fine and alcohol classes and minimal jail time, still have a portion of time that was suspended pending your completion of a 1-5 year (depending on where you live) probationary period during which you cannot have any new criminal law offenes. If you are arrested again in that period, for anything at all, you can go back and serve the time that was suspended. Where I live the usual for 1st time dui is: 365 days in jail with 364 suspended for TWO years. So, during the next 2 years, if you have any criminal law violations, any of those remaining 364 days can be revoked and you can do the time. Stay out of trouble, and UNDERSTAND what you signed on for. Most folks dont bother to read the part about the unsupervised probationary period of 1-5 years.

And Al, if a judge denied you a sobrietor/ignition interlock blow device, it's either because you couldn't pay for it, or you weren't complying with conditions of probation thus far, or, and most likely, you have unfinished business in the form of pending, unpaid or defaulted traffic matters. In otherwords, you suck as a driver and shouldn't be on the road.

66. Beerhouse: The man can be prosecuted for vehicular homicide and DUI. The DUI plea does not negate conviction on other seperate or additional charges. And no on here believes you are counsel, online ranting about your own drinking problems, your slew of rabid dogs, etc. Boring.

69. DOUBLE JEOPARDY - Being tried twice for the same offense; prohibited by the 5th Amendmentto the U.S. Constitution. U.S. v. Halper, 490 U.S. 435, 440 (1989).

DUI and Vehicular Homicide are seperate offenses. One can be committed without the other, or both can be committed. Lame of TMZ to claim any prosecutor told them Double jep. was at issue.

73. In WA state it's 1-5 probationary period, and it varies by municipality not state. Never heard of a 10 yr probationary period and I doubt your PO's have the funding to handle that sort of target end date. Unlikely, but then I'm not in California so dunno.
