Underage Clubber Claims Les Deux Owner Raped Her

A 19-year-old girl has filed a lawsuit against Les Deux nightclub, claiming she was plied with alcohol and then anally and vaginally raped by the owner.

In court papers filed yesterday in L.A. County Superior Court, Skye-Anne Smith alleges on August 9, 2007, she went to Les Deux and was admitted without showing ID. She says she was immediately taken to the "owner's table," where she met defendants Lonnie Moore and Sylvain Bitton, both co-owners of the club. In the lawsuit, she says Moore "started off the debauchery" by plying her with six to eight alcoholic drinks. The suit alleges one of the owners suggest to Moore that Smith shouldn't be in the club because of her age. The alleged response from Moore: "I don't care. She's hot."

Smith says Moore led her to the "manager's lounge" -- which was outfitted with a large bed. She alleges that Moore pinned her against the wall and began to kiss her (she did not kiss him back, she says). She then claims he "pushed [her] onto the bed," "moved [her] clothing" and then "forcibly penetrated [her] both anally and vaginally and forced Plaintiff to conduct oral copulation on him."The suit claims Smith "verbally expressed her pain and said 'no.'"

Smith is suing for negligence, assault, battery, and sexual battery and is asking for damages in excess of $5 million. Mike "Boogie" Malin, a co-owner who won the all-star season of "Big Brother," was also named as a defendant, though Smith did not allege he engaged in misconduct.

The attorney for Les Deux, Ronald Richards, tells TMZ the club and other agencies investigated the incident and concluded Smith was not credible and a "whack job." Richards adds Smith made moves on Moore and that "she was all over him in front of numerous witnesses." He says this is a "typical Hollywood shakedown." The bed, he says, is for managers to sleep in -- alone, because of long hours. Richards tells us Moore has never been accused of harassment or assault of any kind, noting Les Deux has a strict sexual harassment policy in the club. We're told Smith has been on the "party circuit" for years.

17. I have no doubt she was raped. I bet they gave her some fruity drink that you cant tast the alcohol, but was probably stronger than a martini! and 6-8 of them at the age of 19! Im surprised she even remembers what happened.

18. How sad, but honestly i dont feel sorry for these girls one bit, i bet she was having the time of her life, acting all grown, probably flirting and all, then they want to scream RAPE!!! She was asking for it, just like that one girl with david copperfield, OK some famous star is gonna send me to his island, just cuz im hot!!! COME ON u know what your getting yourlselfs into!!

20. Ask any of the bartenders there and they'll tell you some stories! This is the only way this owner, sadly, can get laid....hey, start a bar in L.A. with some hype, and put in a 'lounge'! Why not?!? I wouldn't leave that place...look at these guys, seriously, (can you say: douche bag?) would either of them have a chance if it weren't their place? I doubt these guys actually run this business at all let alone into the wee hours so much so that they need to sleep there alone! Ask about all the 'stars' that have gotten their freak on in that lounge! Wanna F a movie 'star'? -go to Les Deux (don't forget the snow!)...with a black light i bet you can see that place from space!

21. I will agree is bit questionable to file suit months after something like this. I think I'd be focusing on trying to get criminal charges filed if this happened to me, not on suing for $5Mil.

25. something doesn't seem right. She claims four months ago she was raped. Where are the police charges? What are the other 'agencies' who investigated? She can't remember if she had 6 or 8 drinks but can remember specific details of the night. After 6-8 drinks, I don't remember squat.
If she was raped they should pay .....alot!!!! but something is amiss.

there is NO EXCUSE, NO EXCUSE ever to rape someone, drunk, skanky, young, pretty, doesn't matter, NO EXCUSE, all those that say she deserved it, are probably ugly people that doens't even hit on, so you wouldn't even know a little bit of sexual harassment experience.

28. This seems kind of fishy. Where was the criminal investigation for this? You would think that if this man traumatized this girl so much, she would want to see him behind bars more than she would want money from him. The incidient took place 6 months ago, but yet nobody has heard of it until now because of a civil investigation? Where is the physical evidence? Pictures of bruising, results of an exam, DNA? Aside from that, I always thought that rape victims never had to have their names released to the public?

29. I met Lonnie about 2 years ago when a friend of mine and I went to Dolce for dinner. He ended up taking us all around LA to the "hotspots he owned". He tried getting with myself and myfriend many times that night and even stayed over at our hotel, even then he never got anywhere with either one of us. He tried, but was completly respectful when we declined. I don't believe this girl who just wants her name in the rags and money from Lonnie.
