Underage Clubber Claims Les Deux Owner Raped Her

A 19-year-old girl has filed a lawsuit against Les Deux nightclub, claiming she was plied with alcohol and then anally and vaginally raped by the owner.

In court papers filed yesterday in L.A. County Superior Court, Skye-Anne Smith alleges on August 9, 2007, she went to Les Deux and was admitted without showing ID. She says she was immediately taken to the "owner's table," where she met defendants Lonnie Moore and Sylvain Bitton, both co-owners of the club. In the lawsuit, she says Moore "started off the debauchery" by plying her with six to eight alcoholic drinks. The suit alleges one of the owners suggest to Moore that Smith shouldn't be in the club because of her age. The alleged response from Moore: "I don't care. She's hot."

Smith says Moore led her to the "manager's lounge" -- which was outfitted with a large bed. She alleges that Moore pinned her against the wall and began to kiss her (she did not kiss him back, she says). She then claims he "pushed [her] onto the bed," "moved [her] clothing" and then "forcibly penetrated [her] both anally and vaginally and forced Plaintiff to conduct oral copulation on him."The suit claims Smith "verbally expressed her pain and said 'no.'"

Smith is suing for negligence, assault, battery, and sexual battery and is asking for damages in excess of $5 million. Mike "Boogie" Malin, a co-owner who won the all-star season of "Big Brother," was also named as a defendant, though Smith did not allege he engaged in misconduct.

The attorney for Les Deux, Ronald Richards, tells TMZ the club and other agencies investigated the incident and concluded Smith was not credible and a "whack job." Richards adds Smith made moves on Moore and that "she was all over him in front of numerous witnesses." He says this is a "typical Hollywood shakedown." The bed, he says, is for managers to sleep in -- alone, because of long hours. Richards tells us Moore has never been accused of harassment or assault of any kind, noting Les Deux has a strict sexual harassment policy in the club. We're told Smith has been on the "party circuit" for years.

31. As a matter of principle, I hope she gets every penny. Not because she was victimized, because I'm sure she did her part, but because that "Hollywood lifestyle" is very shaddy. They knew she was underaged. They are focused on creating the hottest night spot in Hollywood. They don't care about laws. That club continuously has underaged people in there drinking and partying. You can't have it both ways you idiots! There's a reason there is a legal drinking age of 21. I guess now you get the other edge of the sword!!!!

34. Being a rape victim myself (by an abusive EX "boyfriend"), I truly feel bad for this girl. That being said, I had the same thought as Karlton...the suit says nothing about her being "forced" to consume "six to eight alcoholic drinks". I know there is underage drinking in clubs all over the US - not just Hollywood - but if you're going to put yourself in that position, you have to take responsibility for your actions. There is also no mention of her going to the club with friends, so if she is a "hot" 19-year-old going to a chic Hollywood club alone, what does that say about her motives? I'm not saying she went there to get raped, but she sure as hell didn't go there to drink water at a table for one.

38. Something isn't right. Is this a civil lawsuit or a criminal lawsuit? Did she have a rape kit done after the occurence? If she did, why isn't the D.A. pressing the charges? Why did it take 4 months for the lawsuit to be filed? If this happened as she said she did, why didn't she go to the police instead of filing a lawsuit? Even if she didn't go the police right away, is this really happened she should have gone there first.

This looks like a civil lawsuit and there isn't a rape charge in there. Also, this girl is suing for selling alcohol to a minor when she snuck into the club to get alcohol? I think she is out for a payday.

39. How do you guys make judgement on the club owners without knowing the full story? Maybe she went in with a fake ID? Maybe she told the owners she was old enough. Maybe she willingly slept with them, and now she's claiming rape because she wants money. Come on, is that so hard to believe? We don't know if she's lying or not. How many women have we seen lie about being raped? Hmm... Duke Lacrosse players case comes to mind.

41. All college kids go clubbing without ID's, and admittedly stupidly get piss drunk. But noone ever deserves to be raped... I hope the lot of you who say that she deserved it will be drunk one day and be raped, too. Regardless of her age, she was taken advantage of when she was drunk, and that's not right.

42. Even if this girl's lawsuit gets dismissed for lack of evidence that her rape occurred - the State of California Alcohol Board Control Director is finally going to be alerted to the unreported crimes going down in that junkyard club. Suspend their liquor license and close it down!

43. All of you (men & especially women!) that are saying she did it willingly or deserved it for being underage in a bar to begin with are absolutely pathetic. Just because a woman willing drinks alcohol does not mean she will willingly have sex. ITS THE LAW.....if a man takes advantage of a woman too drunk to have the mental capacity to consent, ITS RAPE. What makes your opinion better than the law? Nothing, it just proves you are idiots.

Ive been to clubs and bars before I was of age....never would I have gone if I knew I would be raped as a result. With as much attention as we give to Hollywood now, what do you expect from a pretty young girl? Most teens want to emulate stars, and what better than going where the stars hang out? To fault her for that is ridiculous. You should be faulting society for making Hollywood skanks look glamorous, and yourselves for condoning his behavior. As if a man with a drunk hot chick in front of him shouldnt HAVE to restrain himself just because.
