Underage Clubber Claims Les Deux Owner Raped Her

A 19-year-old girl has filed a lawsuit against Les Deux nightclub, claiming she was plied with alcohol and then anally and vaginally raped by the owner.

In court papers filed yesterday in L.A. County Superior Court, Skye-Anne Smith alleges on August 9, 2007, she went to Les Deux and was admitted without showing ID. She says she was immediately taken to the "owner's table," where she met defendants Lonnie Moore and Sylvain Bitton, both co-owners of the club. In the lawsuit, she says Moore "started off the debauchery" by plying her with six to eight alcoholic drinks. The suit alleges one of the owners suggest to Moore that Smith shouldn't be in the club because of her age. The alleged response from Moore: "I don't care. She's hot."

Smith says Moore led her to the "manager's lounge" -- which was outfitted with a large bed. She alleges that Moore pinned her against the wall and began to kiss her (she did not kiss him back, she says). She then claims he "pushed [her] onto the bed," "moved [her] clothing" and then "forcibly penetrated [her] both anally and vaginally and forced Plaintiff to conduct oral copulation on him."The suit claims Smith "verbally expressed her pain and said 'no.'"

Smith is suing for negligence, assault, battery, and sexual battery and is asking for damages in excess of $5 million. Mike "Boogie" Malin, a co-owner who won the all-star season of "Big Brother," was also named as a defendant, though Smith did not allege he engaged in misconduct.

The attorney for Les Deux, Ronald Richards, tells TMZ the club and other agencies investigated the incident and concluded Smith was not credible and a "whack job." Richards adds Smith made moves on Moore and that "she was all over him in front of numerous witnesses." He says this is a "typical Hollywood shakedown." The bed, he says, is for managers to sleep in -- alone, because of long hours. Richards tells us Moore has never been accused of harassment or assault of any kind, noting Les Deux has a strict sexual harassment policy in the club. We're told Smith has been on the "party circuit" for years.

46. I suppose they roped her, dragged her inside the club, handcuffed her and would jeopardize their reputation and careers to attack this "girl" as she claims in her lawsuit. This is a typical case of a young, stupid girl breaking the law, going to clubs knowing she is underage and then in an attempt to get money and attention dreams up this ridiculous story. She should be the one being sued for slander and for misrepresenting her age in order to enter a club for adults. Her family should hang their head in shame for encouraging their young daughter to be so devious and morally irresponsible.

47. right, the comment I made was because I don't believe her. She is just reporting this now? She is an adult, she has to know better than to put herself in that position. And lets think about this. If the woman is objecting and crying no, am I going to shove my gear in her mouth? This is made up BS to just get money. They guy owns one of the hottest clubs in LA and he is going to piss it all away on anal with an 18 year old? I call BS on this one. He banged her, she said i love you, he said get the F out and make me a sandwich on your way, now she is pissed and crying rape. PUUUULLLLEEEEEZZZZZ. 48. I know it's not the "politically corrrect" thing to say but we women have to have some comon sense on the situations we place ourselves in and be vigilant. I know it's not the way it "should" be, but that is the way it is. When we do dumb things by placing ourselves in dangerous situations things like this happen. Most of us have more common sense than to hitchhike becasue we know it is terribly dangerous, so we don't do it. Most of us know not to leave the door and windows to our homes open at night while we are sleeping, so we don't do it. Most of us would not leave home walking down the street in our bras and undies for the same reason. But a good many girls and women will let themselves overdrink at a bar and leave with a perfect stranger or place themselves unwittingly in a bad situation, when jsut a little thought as to "what the hell am I doing?" would save us from alot of pain (or even death) later.

Alot of the times we WOULDN'T be a victim if we just used some common sense and the brain God gave us.

49. Getting a body lickered up so they can't fight back or offer any type of resistance is a coward's way of doing things. Granted no one has heard anything about criminal charges, who actually knows if there are any? I'm all for giving her the benefit of the doubt. Maybe she went to the police and because of WHO the rapists were, the police didn't believe her or didn't do anything. So the next step would be to go civil! Until all sides are completely heard, don't judge!

50. I think rape is one of the most heinous acts one can do to another person short of murdering them because even though they walk away alive their lives are permanently ruined!!! But for this kind of situation I am having a hard time finding sympathy for this girl. Yes she was under age to be drinking, but at the same time we have no idea how she acted towards him. She chose to plow down each shot that was provided by a man who was a stranger to her and she chose to go there in the first place. For all we know she could have come on to him, they got busy and then in the morning when she couldn't remember anything realized her ass was sore and screamed rape. For all we know she could just be ashamed of herself for having taken part in such a night and figures that she can redeem herself by accusing Loonie Moore of rape!!! Plus he's rich!!!! These are just assumptions of course and maybe a real crime did take place, but the situation itself causes a red flag to come up in my book!! It's not like she was attacked while jogging or walking to her car at night!

I'm not sre i believe her but if it is true it;s not her fault. i don't beleve the bed being for sleeping aone but I'm sure being the owner of one of the hottest clubs he could do much beter han some 19 yr old nobody (unknown) without having to force anyone. Besides millions (+) women ar brutally raped and they ask for justice and for the guy to be locked up so he cant victimizeayone else - not for millions of dollars. If it's not true then thats probably why she added anal, oral, and vaginal to make the case for the money factor. if it happened why wasn't the guy arrested and charged when it happened? If it was a rapist with little or no money would she still sue or even pursue charges? im not thejury but If it is true she is a victim if not he is a victim and either way I hope the true vicim gets justice and the "bad guy" gets what is deserved.

52. As a victim of rape myself, I feel for anyone who has gone through this. It's unfortunate that people make up stories for their 15 minutes of fame or to seek financial rewards in such a horrible situation. I can't say I believe this girl. She waited four whole months. She needs to prove that a rape even occured and that means a rape kit, police report, etc. I have a sad feeling she is just in this for some sort of financial gain. If that is the case, I hope the owner's counter sue her for the money. How dare she make fun of a horrible situation. Also, if she was underage why did she go to the club in the first place? Was she alone or was she with friends? Let's see what happens. If she can prove that she was raped, then I hope the owners do go to jail.

53. If she went to the police with those claims, they would have to open an investigation and it most certainly would have made the news since we now know when people like Britney urinate. TMZ has sources everywhere and this would have been news. If she had gone to the police, the charges would have been filed, investigated and then dismissed, not never filed. Plus, there was no rape kit. She is only going after the money, so I don't believe her.

I do believe that serving minors does happen a lot in these clubs and I am sure that the owners get a lot of consenting wormen (maybe even a few dudes) to go into that special room for sex. There are plenty of hot women who go to the clubs that are of age and that do consent so I find it hard to believe that they would have to force a 19-year-old who turns around 4 months later and files a civil lawsuit.

55. Im not excusing his behavior at all if guilty but this 19 yr old girl should never have been in a bar and drinking 6-8 drinks. 19 is old enough to know better. She wanted in that club and was underage and knew legally she shouldnt have been there and shouldnt have been drinking. Girls - do not put yourself in situattions where you can be taken advantage of! There is no excuse for rape if he is guilty but she could have avoided a terrible situation altogether by not enetreing the club underage & drinking all that alcohol! Unless they tied her arms and pried her mouth open - she willingly drank 6-8 drinks and I dont know 1 19 yr old who doesnt know better! Thats an insane amount of alcohol.

56. Wow. I can't believe what some people are saying on here. I don't know if she was actually raped or not, but NO ONE DESERVES TO GET RAPED OR SODOMIZED, EVER. Regardless of whether or not you were drinking or underage or slutty. No woman, or man for that matter, "asks" for it. She was consuming alcohol, which was poor judgement in some aspects and resulted in certain things (ie: flirting with an older guy), but if she said no, she meant no. I was sexually assaulted at a crowded bar when I was there underage and had too much to drink. I chose to drink, but I didn't go in there with the intent of getting sexually assaulted. I went in to have fun with my friends and, since I had consumed alcohol, I didn't react how I should have and it probably could have prevented had I not been drinking. In fact, it took me several months to even talk about it because I assumed it was all my fault because I was drinking and it took me a long time to realize that, while I made a mistake by drinking, the consequence should have been a hangover and NOT sexual assault. If you want someone who drinks underage to "get what they deserve" then you should wish a terrible hangover or puking that night, something that is a direct result of the alcohol. What if everytime you made a stupid decision, you were raped or sodomized because of it? Does that seem fair to you? Rape or sodomy are not a result of alcohol, they occur whether or not alcohol is present because there are some sick individuals in the world. Most importantly, the blame should NOT be placed on the woman that got raped, it should be placed on the man who took advantage of her condition and committed a CRIME. Accordng to the law, rape or sodomy occurs when one person forcibly asserts themselves sexually on another, regardless of the state of mind of the person! That's the truth, plain and simple.

Cause she knew she was hot and could get in without an ID. while this was all happening there was no reason she couldn't of got up and walked out if she felt uncomfortable. She definitly put herself in this position. If anything,, shes just look for some easy money and her 15 minutes of fame. I don't feel bad whatsoever. 58. Being a former bar owner, I'm completely pissed off every time I hear about an underage celebrity (Or, HOT gir) going into one of these bars and coming out completely smashed. I was responsible when I owned my bar, and NEVER engaged in activity like this and ALWAYS checked for I.D's. This story is disgusting, now I'm REALLY PISSED.

So pissed, that I've just called the Wishire division, and lodged a complaint against Le Deux and Hyde. I encourage all of you to call them also, and lodge your complaints. Just make sure you get their addresses (The Bars addresses), before calling the ABC. For those of you who believe we need to shut these places down, please call the Alcoholic Beverage Control at (213) 736-2005 and ask for an officer. Then lodge your complaint. No bar owner is above the law, and this is abhorrant behavior. Now, after hearing this, I'm taking action.

These bar owners compromise all of our lives. Ask Lindsay, who also was under-age, while hanging out there. So how long has this been going on, (And why is Les Deux, Hyde, and the like), allowed to continue in business? The cops were all over my ass constantly (Here, in the San Fernando Valley),

I guess the Los Angeles officers must be enjoying some payola perhaps? Or, maybe they themselves are impressed with celebrity? I believe these bars all need to finally take responsibility, Especially Les Deux. Put those two guys in prison.

60. No one deserves to be raped - we all agree with that but girls (and boys) sometimes put themselves in dangerous positions. Im sure this poor girl never thought entering a club underage and drinking all that alcohol would lead to rape but thats the problem she didnt think at all. Who put her in that siutaion? herself and herself only. Women MUST be more aware of their surroundings and not put themselves in positions where something like this could happen easily. The saddest thing is had she thought about it and not be so excited she got into LA club underage she might have realized this was not a good situation at all. 19 is definitely old enough to know better than drink all that alcohol in presence of older men she had NEVER met in her life! I feel for her and my wish to stop this happening (if it did) to other women is please think about what kind of situation you are putting yourself in and I hate to say be a pessimist but think of what could go wrong and stear far clear of it!
