Underage Clubber Claims Les Deux Owner Raped Her

A 19-year-old girl has filed a lawsuit against Les Deux nightclub, claiming she was plied with alcohol and then anally and vaginally raped by the owner.

In court papers filed yesterday in L.A. County Superior Court, Skye-Anne Smith alleges on August 9, 2007, she went to Les Deux and was admitted without showing ID. She says she was immediately taken to the "owner's table," where she met defendants Lonnie Moore and Sylvain Bitton, both co-owners of the club. In the lawsuit, she says Moore "started off the debauchery" by plying her with six to eight alcoholic drinks. The suit alleges one of the owners suggest to Moore that Smith shouldn't be in the club because of her age. The alleged response from Moore: "I don't care. She's hot."

Smith says Moore led her to the "manager's lounge" -- which was outfitted with a large bed. She alleges that Moore pinned her against the wall and began to kiss her (she did not kiss him back, she says). She then claims he "pushed [her] onto the bed," "moved [her] clothing" and then "forcibly penetrated [her] both anally and vaginally and forced Plaintiff to conduct oral copulation on him."The suit claims Smith "verbally expressed her pain and said 'no.'"

Smith is suing for negligence, assault, battery, and sexual battery and is asking for damages in excess of $5 million. Mike "Boogie" Malin, a co-owner who won the all-star season of "Big Brother," was also named as a defendant, though Smith did not allege he engaged in misconduct.

The attorney for Les Deux, Ronald Richards, tells TMZ the club and other agencies investigated the incident and concluded Smith was not credible and a "whack job." Richards adds Smith made moves on Moore and that "she was all over him in front of numerous witnesses." He says this is a "typical Hollywood shakedown." The bed, he says, is for managers to sleep in -- alone, because of long hours. Richards tells us Moore has never been accused of harassment or assault of any kind, noting Les Deux has a strict sexual harassment policy in the club. We're told Smith has been on the "party circuit" for years.

77. I think this girl had to be raped because there is no way that a 19 year old girl would voluntarily sleep with this cheesy guy who is old enough to be her father no matter how rich he is. I mean look at these guys! They are so goofy looking like overage boy banders.

78. I agree that you put yourself in a situation, especially at 19 when you are caught up in the whirlwind of getting into a club such as this and then mix that with alcohol. A 19 year consuming 6 to 8 drinks? That is a lot!!! I am 40 and 135 lbs and after 4 drinks I am feeling it and I can hold my own!

I am sure it takes time for some rape incidents to be reported for whatever reason that person has but in this case - wouldn't anyone as a parent (such as I with an almost 18 yr old daughter), be slamming these guys with a criminal action - NOT civil? Or even showing up at the club to ring their necks?

This is an obvious case of he said she said but it becomes more questionable when something is filed such as this with a charge of rape this in depth.

79. As a girl, I have to believe her story. However, she needs evidence. On the other-hand, their alcohol licenses should be revoked. Young girls have to ask themselves the reasons old men are taking out the time of day for them. I doubt she is a wonderful conversationalist. Most men are only interested in sex. I do not recall ever being this naive.

80. some people don't even bother to completely read an article before responding. She's 19 not 16 and only underage as far as drinking is concerned. She is above the age of consent. But..... Moore should know better, she came in looking for her 15 minutes of fame.

83. Some girls let their guard down and get drunk around men thinking they are safe as long as they don't leave the club with anyone. In this case she wasn't safe because this guy had a bed set up in a back room for the purpose of taking advantage of young drunk women. I agree with "diablofeminina weho" in that young women have to stop being so naive and trusting of men. Many men have integrity and would not take advantage of a drunk girl but there are many others who set out to do just that. They are only looking out for their own interests and don't care who they damage in the process. In my opinion, it borders on evil.

A girl goes in the club...gets taken to the managers table...gets drunk...politely says thankyou and leaves...NOT!...vome on being 19 with that much alcohol in her system im surprised that she didn't do him right there at the table! To wait 4 mos to complain?! BS! Sounds like she must be low on cash.

88. Just a tought. And I in no way condone what the club owner did. But, doesn't the girl bear *some* responsibility?
I mean, if we say, "no", then what we are really saying is: Girls, you aren't responsible for your actions. You aren't mentally capable of making informed and mature decisions.
The thing is, if a girl this girl's age knowingly goes into the lion's den, then consumes massive amounts of alcohol knowing what the lion's den is all about, then why shouldn't she bear some of the responsibility for what happened in there?
Not all of it, because the slime bag knows that she isn't consenting. He deserves to be shoved in a cell. But, she shouldn't feel empowered because she puts him there. She should feel stupid for having put herself in that position in the first place.

89. Now, I'm going to play Devil's Advocate here. What if she's only coming forward now and slapping him with a lawsuit because she did have consentual sex with him, but he gave her an STD? That would make me angry if a guy knew he was burning and then slept with me, giving me the heebie jeebies. $5 million might make me feel better though :) Ok, maybe she was raped, but she was actually an associate or friend of this guy's beforehand? That would explain why she'd wait so long to say anything. I was raped by an ex and didn't go to the police. Well, actually, I told my Sociology professor (who's an ex cop) what happened and he wanted me to go to the cops to nail the bastard - but I didn't. Why? Because I couldn't believe it happened and because I didn't want my mom to know I'd been stupid enough to put myself in the position to be raped by him in the first place. I wasn't even supposed to be talking to him. Or, ok, maybe she's just a big ol slut who is now embarrassed by her actions or she wants to have her little 15 minutes of fame. I guess time will tell.

Oh - and even if this guy did have sex with her when she was drunk and she said "yes", legally what he did is still classified as rape. If a girl is inebriated and can't make rational decisions, by law you're not supposed to have any sexual contact with said person. Basically, if she couldn't drive herself home from the club after the fact, the guy shouldn't have touched her. If he did, he is legally a rapist. Sucks, but that's the way the law works.

90. To- typical and Julia: You both remind me of a friend I used to have on myspace. He dumped EVERY friend he ever had and then he finally dumped ME. I kind of LIKED him, but I also kind of hated him, too. :(
