Underage Clubber Claims Les Deux Owner Raped Her

A 19-year-old girl has filed a lawsuit against Les Deux nightclub, claiming she was plied with alcohol and then anally and vaginally raped by the owner.

In court papers filed yesterday in L.A. County Superior Court, Skye-Anne Smith alleges on August 9, 2007, she went to Les Deux and was admitted without showing ID. She says she was immediately taken to the "owner's table," where she met defendants Lonnie Moore and Sylvain Bitton, both co-owners of the club. In the lawsuit, she says Moore "started off the debauchery" by plying her with six to eight alcoholic drinks. The suit alleges one of the owners suggest to Moore that Smith shouldn't be in the club because of her age. The alleged response from Moore: "I don't care. She's hot."

Smith says Moore led her to the "manager's lounge" -- which was outfitted with a large bed. She alleges that Moore pinned her against the wall and began to kiss her (she did not kiss him back, she says). She then claims he "pushed [her] onto the bed," "moved [her] clothing" and then "forcibly penetrated [her] both anally and vaginally and forced Plaintiff to conduct oral copulation on him."The suit claims Smith "verbally expressed her pain and said 'no.'"

Smith is suing for negligence, assault, battery, and sexual battery and is asking for damages in excess of $5 million. Mike "Boogie" Malin, a co-owner who won the all-star season of "Big Brother," was also named as a defendant, though Smith did not allege he engaged in misconduct.

The attorney for Les Deux, Ronald Richards, tells TMZ the club and other agencies investigated the incident and concluded Smith was not credible and a "whack job." Richards adds Smith made moves on Moore and that "she was all over him in front of numerous witnesses." He says this is a "typical Hollywood shakedown." The bed, he says, is for managers to sleep in -- alone, because of long hours. Richards tells us Moore has never been accused of harassment or assault of any kind, noting Les Deux has a strict sexual harassment policy in the club. We're told Smith has been on the "party circuit" for years.

"Just a thought " - gee why don't you think about the fact that a victim of rape - DOES get some of the (the majority) of the reprocussions of a rape - she's the one who GETS raped and has to deal w/that for the rest of her life - idiot. And don't you think someone who gets raped does blame themselves later for being stupid and second guess themselves day after day forever. 94. To all the people who say that this club owner doesn't "need" to rape anyone to get laid, please understand that rape is not a crime of sex; it is a crime of power and violence. A rapist could get all the consensual sex he desires and still not quench his violent and dominating impulses. To use the "fact" that he could get laid anytime he wanted to as a defense or argument against the possibility that he committed this crime is to show that you don't fully understand the act of rape.

I am, unfortunatley, no longer surprised that people still try to blame a 19 year old girl who went out and got drunk at a bar for being raped. THis is the same population tha tvoted George W Bush into office twice. So sad.

On the other hand, she now has a serious uphill battle to prove her case because she waited so long and didn't report it right away...unless others step forward to substantiate her claims with specifics in regard to MO (Method of Operation). Then that would place the burden on the the co club owners.

99. Regretting having sex with someone is not rape.. I hate when girls lie like this because they want money. She knew what she was doing accepting drinks, being at the club, staying in an area with a bed etc..She didnt get raped, she all of the sudden got a conscience and felt ashamed of what she did months ago, and now wants revenge..LMAO

100. 1. I find it somewhat disturbing that there's a strain of comments like "He doesn't NEED to rape girls, he's rich," etc etc. Rape, by all scientific and psychological accounts, is generally about power, not a need to get laid. Rich, powerful dudes with a self-esteem issues are equally capable of rape as some 'nerd' who can't get some.

2. This is not simply a victim of a criminal charge, which would make TMZ abhorrently wrong for publishing her name, She is a civil plaintiff, and lawsuits are a matter of public record unless sealed by the court. This lawsuit is not sealed; thus, it is absolutely protected journalism to post her name.

3. While I don't think of her delay as dispositive of her lying - after all, rape can be traumatic and affect people in different ways - it certainly is a bizarre situation to begin a civil lawsuit without filing a police report. It certainly does seem as though her motivation is an out-of-court settlement, which always (fairly) leads one to assume her motivations are hardly pure. But, to be frank, my sympathy is limited. While others seem to think "she's drunk, she asked for it!" I think, these are professional club owners who got a 19 year old trashed and somehow she has details about their private bedding. NOT WISE, gentlemen. Unlike a drunk 19-yo, their entire career and business is a litigation magnet. Their lack of common sense in allowing this situation to occur certainly makes me question their judgment more than hers.

102. All I was saying was that IF this were true, she never would have bene assualted if she weren't breaking the law in teh first place, It's not like a date rape. Dating isn't against the law. Drinking underage is. She's liable, as is the club for admitting her.

103. Why not report it to the police and have a rape kit done? Why wait all these months, then sue for millions of dollars? I'm not saying it didn't occur, I'm not saying rape is ever acceptable, because it most certainly is NOT. However, no criminal report ever filed, but a civil report now? It's odd.
