Mischa Messes Up -- Busted for DUI

TMZ has confirmed that Mischa Barton has been arrested for DUI, possession of illegal narcotics and driving without a valid license.

According to a press release issued by the L.A. County Sheriff's Department, the former "O.C." star was pulled over early this morning around 2:45 AM as she was driving in West Hollywood, Calif. Cops say she "was seen straddling two lanes of traffic and failed to signal when making a turn." When deputies pulled her over, they determined that she "was an unlicensed driver and was driving while under the influence of an alcoholic beverage."

Whatchs smokin?Barton is still in custody, being held on $10,000 bail. The L.A. County Sheriffs' Inmate Information website called her "Mischa Burton." Sources tell us that Mischa has been "very cooperative" and "no trouble at all." She's a good bad girl!

Barron Hilton announced Wednesday that he would be giving 97 percent of his $2.3 billion fortune to charity, specifically to the Conrad N. Hilton Foundation, putting Paris' reported $30 million windfall in some doubt. (There could be between $70M and 130M left, presumably for the family.)

It's said by a biographer that Grandpa Barron is "embarrassed" by Paris' behavior and supposedly even threatened to yank her inheritance entirely a few years back. Paris couldn't be reached for comment on the development.

Scary Ex-Hubby Is Not-So-Nice Spice


TMZ has learned that a custody battle has erupted between Mel B and her former husband over their almost 9-year-old daughter, Phoenix, and whether mom can take her on the road. Can't take my baby, Spice!

We're told dancer Jimmy Gulzar refused to alter his visitation schedule with the working mom -- and custodial parent -- Scary Spice aka Melanie Brown, while she's on tour with the Spice Girls. Now TMZ has obtained documents supporting Brown's desire to take Phoenix on the road with her. Los Angeles County Superior Court Judge Robert Schnider has ordered that little Phoenix can go on the road with her mom as she tours the world, thus denying Gulzar's attempt to block her from traveling. Your mum's your best friend!

Mel, who is represented by powerhouse attorney Goldie Schon, still maintains sole legal and physical custody of Phoenix, and Gulzar will have scheduled visitation over the next few months and on the little girl's birthday.


Brandy Crash -- Dead Woman at Fault?


TMZ has learned the hang-up in deciding whether to file vehicular manslaughter charges against Brandy is that Brandy may have been a victim, not a culprit.

A CHP source tells TMZ the woman who died in the car accident involving Brandy actually struck the vehicle in front of her before Brandy made any contact. The law enforcement source says Awatef Aboudihaj, the woman who died, struck the car in front of her -- which was going 65 mph, and then slammed on her brakes. We're told the sudden stop caused Brandy to hit the dead woman's car.

What's more, L.A. County Coroner spokesperson Captain Ed Winter tells TMZ that toxicology reports show Aboudihaj had "slight traces" of marijuana in her system at the time of the crash.

The L.A. City Attorney has until the end of the business day on Friday to decide whether to file criminal charges against Brandy -- that's when the one-year statute of limitations runs out. Sources tell TMZ there is significant division in the City Attorney's office, and a decision still has not been made. The problem for the City Attorney: if they file manslaughter charges, they have to prove Brandy did something negligent -- and we're told that could be difficult if not impossible.

This whole damn bunch will continue with their dirty rotten ways & kill a couple of people & expect the public to just look the other way & Gramps should give his money to who ever he chooses & to "HELL"with Hilton she is just a little bitch who cried her little eyes out & didnt serve all her time in jail,what does the judges expect these little whores & dope heads to be later.

35. I'll bet Paris could care less about inheritance. She has already made it on her own with her modeling, endorsements, her TV show, etc. She's wealthy in her own right, with or without her grandfather's money. On top of which, wise investments have probably already been made for her. Her investment in her multimillion dollar home alone can become very lucrative in the future. I actually like Paris even though she has made some bad choices in the past. Those choices affected no one but her.

37. I believe Brandy was negligent in that she was not a clear safe distance away from the car in front of her. If she had been, she would have had time to brake and avoid hitting the car. A driver needs to be 1 car length away from the car in front of them for every 10 mph. Bet she was much closer than that.

40. Im with the person that says it's a fake mug shot. There is no county jail placard to list an inmate # or height marker.............
I've been in county jail here in Tenn. . I beleive it's the same where ever you go. And reguardless of your fame..... If you got enough money though you dont have to do all of that. You can bond out before hand........... If you already have a current photo on file you dont have to take it again.....

42. If the person Brandy struck had already hit another car and was on pot it certainly changes the entire picture. The "following too close" law is pretty ridiculous most of the time. 2 weeks ago my daughter was driving on the limited access perimeter in our city when the man in a truck in front of her suddenly went crazy; veering to the left and crashing into the guardrail and then careening to the right and crashing into that guardrail before getting some sort of control and driving away from the accident. My daughter had to slam on brakes to keep from hitting him broadside, but the minivan behind her slammed into the back of her SUV. My daughter is being treated for severe back pain, but no bones broken. The minivan's front looks like it hit a brick wall. The man who caused the whole thing made it a mile down the road before his truck gave out. The police didn't even check him for DUI or no license, etc.! He said he was just trying to straighten out after merging and lost control. So why did he drive a mile past the accident site? Did the police believe him because he was an older white man? They charged the poor family in the minivan with following too close, but who would expect the car in front of them to slam on brakes while driving on a limited access highway? Think about that happening to Brandy.

43. Re: Fergie & Josh. I am friends with her aunt & uncle, they were told on Thanksgiving about the engagement, and wanted to tell her mom at Christmas before they went public. The whole family is estatic as well as Fergie & Josh. We all wish them the very best and a long and happy life. They both deserve it.

I get so sick of seeing the news services so preoccupied with all the gossip about blondes, anyway. It is like a sexual perversion among them, and blonde girls seem to feed off that sort of attention. It is all about sex, otherwise blonde girls always come across as unintelligent, immature, and totally useless. All they do is feed off of men's fantasies with nothing else to offer them. Perhaps all those dumb blondes will eventually drop out as favorites when the public gets their belly full of that nonsense.

Give me a well educated, hard working, pretty dark hair oriental chick anyday. They are certainly far more interesting to talk about.
