Brandy in the Clear

BrandyThe L.A. City Attorney has decided not to file charges against Brandy over the fatal car accident she was in last year.

The accident occurred one year ago Sunday near the interchange of the 405 and 101 freeways in Los Angeles. Brandy's car struck the vehicle of Awatef Aboudihaj, who died. Authorities say another car then sideswiped Aboudihaj's car. A well-placed source in the California Highway Patrol, however, tells TMZ Aboudihaj actually struck the car in front of her and then slammed on her brakes before Brandy made contact.

We're told the City Attorney's decision came after considerable conflict within the office. It is highly unusual to wait until the last day to pull the trigger.

62. "When you rear-end someone it is ALWAYS your fault, regardless of why the rear-ending occurred.

Brandy is guilty of causing the accident, period. Even the newest finding still supports that the accident was caused by her, it just excludes distractions.

Therefore, she should serve time for Vehicular Manslaughter. She IS currently being sued in a civil case for wrongful death. She WILL lose that lawsuit."

Admittedly, I thought she should be charged as well but when this new news came out, I had to re-evaluate my opinion. True, Brandy hitting that woman was her fault but if the police can't prove that her crash caused this poor woman's death, they can't press charges. That is the law and that is the rules. All they can prove is that she hit the car, they can't prove vehicular manslaughter because they can't prove that it was her hit that caused Mrs. Aboudihaj's death. Otherwise, they would've pressed charges.

As for wrongful death lawsuit, that is (unfortunately) a good possibility. You just have to prove probably cause instead of having concrete proof.
