Psychology Board Investigates Dr. Phil

TMZ has obtained a copy of a complaint against Dr. Phil which was lodged with the California Board of Psychology, alleging the TV doc was illegally practicing without a license when he paid a visit to one Britney Spears.

We've learned the person who filed the complaint is a psychologist. Dr. Phil has never been licensed to practice in California, and he retired his Texas license in 2006.

The shrink believes when Dr. Phil visited Brit in the hospital earlier this month, he was practicing psychology. A "Dr. Phil" honcho told TMZ the visit was never meant to lure Britney onto the TV show -- and that there were never plans to put her on the air.

A Psychology Board rep told TMZ if the Board finds the complaint credible, it would be referred to the D.A. for review. Practicing without a license is a felony in California.

The psychologist who filed the complaint also alleges Dr. Phil violated HIPAA laws by "discussing or divulging a patient's medical condition ... with the media," in reference to a press release issued by Dr. Phil.

The complaint also says, "A petition is being circulated to remove the "Dr. Phil" show from the air." We're told the shrink is trying to get other psychologists to sign.

As for the Dr. Phil show's response -- no immediate comment.

31. 14. Not really understanding this one.. he didnt treat her and was invited by the family to come there. They have admitted as much. Wasnt it also reported that he did not speak with her and walked behind her out of the hospital. The Spears family needs to clean their own mess up rather than pointing blame in another direction.

He ratted on her personal business to the media. He was asked to visit Britney as the Spears' Family FRIEND... They felt betrayed and rightfully so. That's not pointing blame. It's betrayal of trust.

He shouldn't have opened his big mouth and talked about her to anyone in the public eye let alone the media. And he should have never attempted to have a "show" discussing her and her business. If he's such a good personal friend to the Spears family he should have simply declined comment.

And it was reported everywhere that he DID speak to her. Where have you been?

32. Wow, seems like all those Psychologists who have been jeolous of Dr. Phil are really jumping on this bashing bandwagon. Britney's parents were the ones who asked him to visit her. He wasn't practicing Psychology, just visiting Britney per her parents request.

33. I don't like Dr. Phil. But he is not a doctor. So he didn't not breach in patient/doctor confidentiality laws. Please read. Dr. Phil is not a licensed doctor. Britney is not his patient. So how did he break any laws? Dr. Phil never said he was treating her. He just said he visited her and explained what he saw. He only said what we all knew. Yes, it was tacky that he went to discuss her mental state to a celebrity news program at the same time promoting his show. But how has he coMmitted a crime? How has he breached any ethical laws of a profession he DOES NOT BELONG TOO?

you know you can't just go pick up an order to commit someone against their will at target. as crazy as brit is, she's an adult and dosn't have to consent to being medically treated for an illness.

42. I think it's time we had an intervention with this bubba Dr. Phil.

He clearly is delusional and thinks he's a doctor when he's not. We need to get his best friends sitting around him in a circle and tell him it's OK to fantasize, it's OK to pretend, but actually going to a hospital and think you're going to treat a patient?-- that's big no-no.

44. Technically, he was invited to see Britney Spears at the request of Britney's family. It's posible there is a loop hole in this situation because he was a personal friend ( at the time) of the Spears family. He can easily say he went to see her as a "concerned friend" , and not as a psychologist.
