Martha's Dishes Made My Kids Sick!

A Pennsylvania couple is suing Martha Stewart Living and K-Mart, claiming the domestic diva's "Everyday" dinnerware -- with the lovely name "Flowers and Buds Border" -- contains lead and is responsible for poisoning their children. Get the lead out!

In the lawsuit, filed on behalf of their two kids Michael and Matthew, Sandra and Raymond Dombroski allege the boys were poisoned by lead in the dinnerware, which caused the boys to suffer "mental, emotional and cognitive impairment, learning disability" as well as speech problems and physical impairment and a host of other problems. That's not a good thing!

Flowers and Buds dishesThe Dombroskis say that the lead problem is a result of "negligent, reckless, intentional and outrageous conduct of MSLO..." (that's Martha Stewart Living Omnimedia), and they've served up a heaping lawsuit asking for compensatory and punitive damages.

A spokesperson for MSLO told TMZ "We take consumer product safety very seriously. We do not comment on pending litigation."

61. Whether this suit is truthful or not, lead poisoning is dangerous and still a problem for our children worldwide. I resent that k-mart and Martha Stewart Living can market any merchandise that contains lead. I recently bought a Marhta Stewart pre-lit artificial Christmas tree from K-mart. All of the different styles were displayed where anyone could touch, brush against and all. Only when I took it down did I find a hidden warning about the tree containing lead, that children and pregnant women especially are at risk, and that one should wash ones hands after touching the tree. Who is going to clean, replace or make sure my ornaments are safe to handle? And even though the warning says the lead is contained in the light wiring, certainly the wire due to being permantly attached to the tree contains lead too. I called and complainded to K-Mart Headquarters as well as to the local store. The manager was not aware that the trees even contained the warnings. Yes, there should be a class action suit for the Martha Stewart Living and K-mart for the sale of this merchandise. So what that there was a warning attached to the tree. Where were the warnings on the displayed trees that we all touched and didn't know to immediately wash hands afterward? Thanks Carol, you're right, China is one country that has poorly enforced and minimal standards for manufacture, but I think that when U.S. companies go to China for their profit at our expense (no pun intended) then it's up to our companies to help China establish and enforce laws that regulate these things. And yeah, these childrem may or may not have disabilites related to lead poisoning, but there still should be a class action suit just for the retail of all the junk by Martha Stewart Living which contains lead and the like. Enough said.

Sorry, but to correct one part I wrote: Even though the warning states that dangerous levels of lead are contained in the tree light wiring, my concern is that because the tree is pre-lit, they are a part of the tree and certainly the tree contains lead too. Like I said, kids are at risk, who do you know that can be sure small kids stay away from these "pretty Christmas Trees". Thanks for reading.

63. Your peope are so stupid! People don't get the point. Posioned dog food from China, Lead in children's toys and now lead in silverware. Get it?

In other words there will be more silverware and household items from China that will be contaminated with various things, because we are so stupid and greedy, we don't check them when they come in.

So on the news, you will see more stories of silverware that also was ordered by various U.S. companies and they will be contaminated with lead as well.

Can we pickup the pace here a little? Get it? It will be told to the public by the ftc and fda that it is up to the companies to police themselves and "we don't have the budget for it". Convenient and also old now. How many have to die? How many will die and when does the American public catch on? From the comments here, I'd say never...

64. Just read the lawsuit.

I get the impression that one of the kids was diagnosed with autism and the parents think lead in the dishes caused it.

They won't win this one. Even if the dishes have more lead than regulations allow, it is impossible to prove that the kids' problems are a direct result of lead poisoning from eating off of those particular plates.

I think the parents would do much better spending their time, energy, and money on providing for their children (one of them seriously disabled) rather than gambling on this lawsuit.
