No Changes So Far in Brit Case

Britney SpearsThe custody hearing is over, and the status quo prevails.

There was supposed to be a hearing today on the motion by Brit to get "visitation in a therapeutic setting." That motion was put off, because the therapeutic setting Britney's in right now is a psych ward.

There also has been no change in Britney's legal representation. As we first reported, the conservators are at war with Brit's divorce lawyers. We don't know what they argued in court this morning, but Trope and Trope is still repping Brit in the custody war.

This afternoon, it's Brit's divorce lawyers who are on the attack. They'll ask that the conservators -- notably Jamie Spears -- be 86'd.

It sounds like Brit is suffering from Bipolar Disorder. With proper medical treatment and appropriate meds. Brit will be fine. Let's hope her stay in a psych ward will be theraputic. I am a psych nurse and have seen many cases like Btit's.

I think so too. Maby that's why Britney forbidded Lynne to visit her and the grandkids.
Therefore Lynne might have been afraid of putting Britney into hospital, 'cos she got so angry after rehab.
Lynne didn't know what Sam and Adnan told Britney.

154. 114. If there is any doubt at all a family member should not be a conservator. The court has a responsibility to insure that the conservator is capable of the duties and responsibilities that task involves.

Her father is a doubtful person for a lot of reasons beyond her attitude toward him, and to some extent it would be helpful to her treatment if her attitude toward the conservators was not based on her outspoken hatred of of one of them. ...

Stump: Thank you. Generally I agree with your comments, except that I do not see anything that disqualifies Jamie Spears from serving as a co-conservator. First, the independent co-conservator is experienced, and he will be the one who actually does the heavy lifting as far as the finances are concerned. It is my imporession that Jamie's primary role as conservator is to interface with the medical staff. Second, but for the fact that many years ago Jamie Spears had an alcohol problem, now in remission, there is nothing I have seen to suggest to a court that he cannot carry out his fiduciary duties to Britney's estate. If you have specific qualities that you believe cause him to be disqualified, let me know. But surely we both agree that the fact that Britney doesn't trust her father constitutes legal cause.

I think what some posters on this board do not reaklize is that the court is going to appoint a family member 99.99% of the time. The court will not appoint a conservator who has a criminal record, a record of income tax evasion, or a civil judgment based on fraud, financial malfeasance, breach of fiduciary duty, or similar tort. And, of course, it is not uncommon to require a fiduciary to post a bond, so if there are questions about his capability, that option is available. But the court bases its decision on evidence put before it, and while Britney's desires will be taken into consideration, the court is not going to remove her father unless there is hard evidence that he cannot carry out his duties faithfully.
