Commish to Brit's Lawyers: Protect or Serve

Britney Spears' lawyers made it clear today in court: they want out. But it ain't that easy.

After meeting privately in chambers with Commissioner Scott Gordon, the matter was continued to Feb. 19. But here's what we know: the Commish wants to make sure when Trope and Trope says sayonara, someone has to be in place to handle the case. We're told the Commish wants Trope and Trope to come back with a plan and wants to know specifically who's coming in.

As we first reported, Britney secretly met with disso queen Laura Wasser, who represented her during the divorce, but quit Brit a few months back.

but also, i would like to see some charges brought against that lutfi guy. why haven't some charges been filed. if he did what lynn spears said he did, and psych doctors know her mental state has been tampered with so to speak, also his new rep, sands, says he gave her drugs...then who made him a doc.....so isn't that criminal...to do that to another person? what if she didn't have parents like she has, that have been able to step in and protect her..i would hate to think what she would be doing now under lutfi's control....if even still alive!!!

Brit is a selfish pig? I don't understand how anyone can say that about Britney. The truth of the matter is that, if anything, Britney is generous to a fault. Cases in point would be the huge French-country style "Serenity" mansion Britney had built for her mother and father in Kentwood, Louisiana in 2000 while Britney was still only 18-years-old and while her mother and father was struggling financially after their 1998 bankruptcy, and the JJ Chill restaurant in Venice, California Britney purchased for her father in 2004 while he was struggling financially and fresh out of a stint in rehab for drug and alcohol abuse 2 years after Lynne booted Jamie out of the Serenity mansion when they divorced. And wouldn't you know it? Her father Jamie failed in the restaurant business too! Less than 14 months after opening the JJ Chill restaurant he went out of business and closed the restaurant in December 2005 or January 2006. He now works as a cook for the Maloof family in Los Angeles.

Britney's mother Lynne and little sis Jamie Lynn still live in the mansion and PEOPLE.com recently reported that sources confirm that Lynne's "Serenity" is still paid for by Britney. I would say that is not a shabby lifestyle for an unemployed former elementary school teacher!

Guess daddy wants a new house and that's why he's trying to send her out on tour...I have no doubt he's charging her estate a management fee for the "work" he's been doing.

Do you think she will take control back tomorrow?...the Commissioner dealing with the matter seems a bit crazy with precluding Brit from having her interests represented. Seems the Commissioner in her family law matter disapproved of that course, insofar as they would not allow Brit to be unrepresented in her child custody matters, I wonder how long they will try to deny her her right to get legal advice and repreesntation?

I am not sure what I think will happen at the hearing tomorrow. I searched the California Probate Code to try to get a better understanding of what could happen and on a different TMZ thread earlier today I posted what I found. Here is a copy & paste of that:

The probate court will look at medical reports and Britney's most recent psychiatric evaluation at the hearing tomorrow and decide one of three possible actions, to extend the temporary conservatorship to March 1st, limit the temporary conservatorship to give Britney more control, or terminate the temporary conservatorship. Unless at the hearing tomorrow the court finds that Britney is not "gravely disabled," the temporary conservatorship terminates automatically on March 1st, 30 days after it was ordered on January 31st. If the temporary conservatorship goes to the end of 30 days, the court can reinstate temporary conservatorship for another 30 days or order permanent conservatorship. But Britney's bipolar illness does not make her a candidate for a permanent conservatorship order.

Here are some excerpts from the California Probate Code that will determine the judge's rulings:

5352.1. The court may establish a temporary conservatorship for a period not to exceed 30 days and appoint a temporary conservator on the basis of the comprehensive report of the officer providing conservatorship investigation filed pursuant to Section 5354, or on the basis of an affidavit of the professional person who recommended conservatorship stating the reasons for his recommendation, if the court is satisfied that such comprehensive report or affidavit show the necessity for a temporary conservatorship. Except as provided in this section, all temporary conservatorships shall expire automatically at the conclusion of 30 days, unless prior to that date the court shall conduct a hearing on the issue of whether or not the proposed conservatee is gravely disabled as defined in subdivison (h) of Section 5008.

Section 5008 (h) (1) For purposes of Article 1 (commencing with Section 5150), Article 2 (commencing with Section 5200), and Article 4 (commencing with Section 5250) of Chapter 2, and for the purposes of Chapter 3 (commencing with Section 5350), "gravely disabled" means: A condition in which a person, as a result of a mental disorder, is unable to provide for his or her basic personal needs for food, clothing, or shelter.

5350. A conservator of the person, of the estate, or of the person and the estate may be appointed for any person who is gravely disabled as a result of mental disorder or impairment by chronic alcoholism. The procedure for establishing, administering, and terminating a conservatorship under this chapter shall be the same as that provided in Division 4 (commencing with Section 1400) of the Probate Code.

1801. Subject to Section 1800.3: (a) A conservator of the person may be appointed for a person who is unable to provide properly for his or her personal needs for physical health, food, clothing, or shelter, except as provided for the person as described in subdivision (b) or (c) of Section 1828.5. (b) A conservator of the estate may be appointed for a person who is substantially unable to manage his or her own financial resources or resist fraud or undue influence, except as provided for that person as described in subdivision (b) or (c) of Section 1828.5. Substantial inability may not be proved solely by isolated incidents of negligence or improvidence. (c) A conservator of the person and estate may be appointed for a person described in subdivisions (a) and (b).

Section 1828.5. (b) If the court finds that the proposed limited conservatee possesses the capacity to care for himself or herself and to manage his or her property as a reasonably prudent person, the court shall dismiss the petition for appointment of a limited conservator. (c) If the court finds that the proposed limited conservatee lacks the capacity to perform some, but not all, of the tasks necessary to provide properly for his or her own personal needs for physical health, food, clothing, or shelter, or to manage his or her own financial resources, the court shall appoint a limited conservator for the person or the estate or the person and the estate.

85. Everytime sleazy shyster lawyer Kaplan goes to Court, Britney pays his fees so naturally he wants to go to Court often. K-Dud is still out of work and wants to live off of Britney all of his life. Don't forget they are the main Vultures in this Soap Opera. With all of the money mooching people in her life - parents, ex-husband, his lawyers, her lawyers, Sam, Adnan, the Paparazzi, well, everyone had a hand in driving her crazy - and all are after her money. Wish she would take her meds, go to therapy, exercise, and get well before the blood suckers steal ALL of her money. With all the nasty lowlifes in her life, Papa Spears is the ONLY one I trust.

86. I just read on E! news that Brit tomorrow is planning to get control again. Apparently, she is planning a party Friday night for the people she deems fit to be around without needing permission if she gets her way. She has paperwork apparently that says she can handle her own finances.

Hhhmmm TMZ where were you on that one? I don't think Brit is ready to handle anything on her own...she needs major help and I hope her dad stays her conservator so that she doesn't go down this road again. Those little boys need her so badly and all she is thinking about is partying with her so called friends.
