Crazy New Legal Papers in Britney Case

In a bizarre twist, a lawyer in NYC has filed legal papers in Federal court, asking that Britney's conservatorship case be taken away from L.A. County Superior Court.

In the documents obtained by TMZ, attorney Jon Eardley claims Britney's rights have been snatched away from her and she has been cut off from life as she knows it.

Eardley claims, "It is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing in the custody proceedings because of the intense media scrutiny of what would normally be private aspects of a person's life." It appears Eardley wants an injunction issued in federal court, asking the judge for the power to protect Brit in the custody case as well.

The documents allege "the deprivation of her civil liberties by the conservator is so severe as to interfere with the effectiveness of the scheduled medications that are covered by the Food, Drug and Cosmetics Act." This appears to be an attempt to get the Federal court to accept jurisdiction.

It is unclear on whose behalf Eardley is acting. We're told Sam Lutfi and his spokesman, Michael Sands, have something to do with the filing, though the exact nature of their involvement is unclear.

These girls don't deserve civil rights, they haven't earned them. Lindsay drives like a maniac with hostages. Actually, I think Dina Lohan should be the conservator for Lynn Spears. Lynn can be Jamie Lynn's conservator. Jamie Lynn can be Britney's conservator, and Britney can be Michael Lohan's conservator. Wait, what about Lindsay? Oh yeah, Jamie's available to be Lindsay's conservator. This way, everyone has a conservator! Except brother Bryan. Well, someone's gotta manage things.

497. Not just a bit sick JurisD...very sick. I'm surprised the police don't get involved. If she is that sick then doesn't the law say she can't even consent to sexual intercourse? Isn't it against the law to have sex with someone that is "gravely disabled mentally?" how could they possibly allow adnan to sleep with her at the moment? why don't the courts do something to stop jamie & lynne from letting this taking advantage of her in this state happen??

No, they're allowed to grant her permission to have sexual intercourse (it's called the "Writ of Coitus"). But the co-conservator (lawyer Wallet) has to sign off on it, of course. Adnan actually went to his office yesterday and completed the papers. He had to state the type of sex they would have; the number of times (a range of numbers usually suffices); what type of contraception they would use; and whether or not he would call in the morning. Then, once the paperwork was in order, and each of the co-conservators signed it (Britney technically didn't have to give consent, so her signature wasn't required), they filed it with the Court Clerk, who then stamped, initialed it, and filed it in the docket.

Fortunately, they were able to get to the court house by 5 yesterday. I hear there was quite a line from conservators filing Writs of Coitus on behalf of their charges for Valentine's Day!

498. Now I do disagree with you about what you said above in "a)". Do you know anyone who is bipolar? I do and there are many different degrees of having bipolar as well as a possibility for a mixed diagnosis. I know a person who has ultimately gone untreated for over 30 years. This person at different times has been high functioning as well as completely inept and helpless. This person had children that they loved and nurtured as well as severely abused. This person has been hospitalized several times but remains in denial about their illness. This person really could have used a conservatorship.
And again, we do not know Britney's diagnosis.

Yes, there are varying degrees of bi-polarism (bi-polarity?). What I meant was, just being bi-polar, in and of itself, isn't enough to warrant having a conservator. But, certainly, an extreme case of being bi-polar would justify having a conservator. That all falls under being declared mentally unfit. As I said, if she's been declared mentally unfit, then fine, I agree that having a conservator is appropriate.
