State Court May Have Lost Britney Jurisdiction

It's the craziest thing we've ever heard, but it's probable the State court has lost jurisdiction in the Britney Spears conservatorship case.

Sources at the L.A. County Superior Court tell TMZ, "It's possible jurisdiction has shifted to the U.S. Federal District Court." How, you ask? Well yesterday, a lawyer filed legal papers in federal court asking a judge to seize control of the conservatorship case on grounds Britney was at great risk in the L.A. County Court system.

The sources say just by filing the paperwork, the federal court probably has obtained jurisdiction. We know that sounds bizarre, but legal experts tell us that is indeed what has happened.

A well-placed source in the L.A. County Court system says even if the federal court has jurisdiction, they believe the conservatorship and all orders are still in effect, but no further orders can be made or modified unless and until a federal judge kicks it back to the state.

47. This is stupid ... having her father take over was the best thing that's happened to her in a long time. This is that stupid Sam's doing .... he's been cut off from his sugar momma and he needs to pay the rent.

The court appoints a lawyer for Britney ... if someone has been declared incompetent to handle their own affairs they can hardly hire a lawyer on their own. If this was a civil rights issue they'd have changed the way this works a long time ago.

49. Even if the federal courts get jurisdiction, this could blow up in DIRTY SAMCHEZ's face. He is ducking being served. The federal court isn't going to take that one lightly. At some point, the court will get fed up with his constant meddling and possibly hold him in contempt. Let his A$$ sit in a jail cell for a lil while so the real people can take care of Britney. She is doing better. Sure she may not be able to freely go out and kill herself. But, in the end, she will end up living instead of being another dead celebrity at the hands of a psychopath.

50. This is absolutely absurd. Can you imagine what this family is going through? The ones who truly love her and want to help her get well have to constantly be running to court to defend themselves against self serving people. Having a loved one with mental illness is heart wrenching enough. This isn't about money...it's about saving a life. No parent should have to go through this. It is easy for so many people to spit venom at Britney's parents, as well as Kevin Federline, but it is unwarranted. Britney is a human being who is worthy of love and support. Any one of us may be susceptable to mental illness at some time in our lives. She needs prayers, not judgement.
If the Federal court tries to interefere with the State court rulings, all the positive work that has been done will most certainly unravel. Britney should not be used as a pawn. It took many months of the court looking at the entire situation, and watching Britney deteriorate to the point of a critical life/death situation. Clearly she is thriving under her parents care. It would be a tragedy to intefere with such progress.
Sam L. has no right to speak for Britney's "rights." It is transparent that he is a self serving leech in her life. If he chooses to carry on with his nonsense and drag Britney back down, I pray that her parents seek appropriate retribution and compensation. Yes, Britney has basic rights but it has been repeatedly proven that she is NOT capable of handling the affairs of her complicated life. Her parents are protecting her, loving her, and making sure her needs are met...to see Britney smile and dance shows she is on the right path. May God continue to bless their efforts. Love conquers all.

55. B.S. This is not going to happen, Stae has Juridisction until federal courts see's case, if and when they decide to see this frivilous case, I doubt it highl. Already there has been an improvement in the quality of her life, there are now 4 conservators that have to agree on asspects of her economy, etc. And nothing happens without the courts approval. This is called grandstanding my friends. She is obviously not fit to make ANY decisions in her life and I am sure as hell that power will not be given EVER to Osama Lutfi and his Media hawking PR, Michael Sand. Why is Osama afraid to get served??? Why wont they produde the prescriptions for the drugs Osama admitted he gave her? That should not be hard, or were the bottles part of the stash he stole the night of her hospitalization. man, everybody was screaming for Osama to be taking out of her life, now that he is people are critizising what the parents and courts are doing. Yes, I think the LA Courts have it in for her, yes indeed, for her to get well in order to have her sons, if if its partial custody. She seems very happy with her dad at the helm of things, she's been seen kissing her daddy like a little girl. That's all she needs, her family to love, support and protect her from the slime that surrounded her.

Not how it works TMZ/GED, a hearing must be set, motions filed, arguments heard, then a judgement accepting the removal from state court. The judge can and likely will deny the removal. State court is where the matter remains.

Filing means nothing. The hearing coud be scheduled in weeks or months. The judge's decision can take even more time after the hearing is held. Then there are appeals.

Can't this site hire anyone who is EDUCATED?

60. As crazy as this is, at least -- at least -- at least it gives Britney a chance to make her case that her civil rights are being violated. So this guy's my hero. Call me crazy, say all kinds of things -- but this is the first chance that Britney's had to make a case for her civil rights, and for that, I applaud this guy. [OK, go ahead and throw tomatoes at me now.]
