State Court May Have Lost Britney Jurisdiction

It's the craziest thing we've ever heard, but it's probable the State court has lost jurisdiction in the Britney Spears conservatorship case.

Sources at the L.A. County Superior Court tell TMZ, "It's possible jurisdiction has shifted to the U.S. Federal District Court." How, you ask? Well yesterday, a lawyer filed legal papers in federal court asking a judge to seize control of the conservatorship case on grounds Britney was at great risk in the L.A. County Court system.

The sources say just by filing the paperwork, the federal court probably has obtained jurisdiction. We know that sounds bizarre, but legal experts tell us that is indeed what has happened.

A well-placed source in the L.A. County Court system says even if the federal court has jurisdiction, they believe the conservatorship and all orders are still in effect, but no further orders can be made or modified unless and until a federal judge kicks it back to the state.

62. I am so sick of her and her Dad should give up now or he will die of a heart attack from the stress of her never ending messes. If she insists on ruining her life, killing herself, allowing the Sam's of the world to steal her blind and lose all of her money, then let her. She is determined to do so and you cannot help someone in her condition because eventually, she will return to the same situation.

If he was smart, he would turn and walk out and whatever happens to the little witch, happens. Her games are so old. If she wanted help, she would seek it. Take away her children and let her do what she wants to her life but don't let her trash anyone else involved.

70. I read SAM is the one behind involving the Feds. Wow, only in America can someone who has allegidly admited to drugging a person, and whose influence visibly made her condition worse, file a piece of paper blaming those who have tried to get her back on track. What's worse is that he just may legally get his way! Disgusting

This is crazy, the girl needs to continue working with her family...she apparently seems to be back on track.

At first, I thought she deserved what she got due to her reckless behavior and blatent disregard for the law, but now I feel that her acting out could have possibly been more SAM induced. KFED doesn't have to take drug test because in the eyes of the law, he is behaving as any normal, adult father should. He has not acted recklessly, and without regard for the law.

71. Since when do federal courts have jurisdiction over a case just because someone files papers at a federal courthouse? There has to be a federal issue raised in the pleadings and I don't see one. None that is legitimate, anyway. The entire matter belongs in state court where all conservatorship issues are adjudicated.

What you seem to be saying is that the matter is federal (by virtue of papers being filed) until a federal judge inevitably says the federal courts have no jurisdiction over the matter and sends it back to state court. Until then, the conservatorship set up by the state stays in place. So nothing changes just alot of time gets wasted. Ridiculous.

74. Mental Illness is not cured by a 'spanking'. A mentally ill person is 'helped', but not cured by medication. Brittany needs stability in her life and a true support system. She did not have stability in her childhood and is still in need of it. Her support system has always been weak until now, and that has been shown until now.
