Federal Judge Says It Seems Bogus To Him

A Federal judge in the Britney conservatorship case has issued a tentative ruling that the move to make a federal case out of it is ridiculous.

Judge Philip Gutierrez set a deadline of February 29 for Britney's so-called lawyer, Jon Eardley, to explain why on Earth the federal court has any business getting involved in Britney's mental affairs.

The court said it sure seems the Feds have no jurisdiction to interfere, and unless Eardley can convince the judge to the contrary, the case will go back to State court on Feb 29.

87. just me....thank you for putting it so well...I've been saying the same for weeks...everyone keeps saying Jamie can't spend her money, but that's just wrong...Brit is paying for all these lawyers, and all but 1 have an interest in keeping her under the conservatorship, in fact they each have a huge finanical interest. No doubt, last week alone, over 1 million was probably spent in legal fees and it will keep going at that rate until Brit regains control. I wish they would make her father lodge some sort of bond with the court or something in case daddy makes mistakes with her money. That would have been the benefit to hiring independent professionals cause at least Brit could sue them for malpractise if they mess things up, dad is a bankrupt that can never reimburse her these millions, even if 1 day another court says he shouldn't have spent all this. The new family law lawyer alone would have billed well over $100 000 just to get on top of the lengthy and involved custody case. She will be close to bankrupt by 10 March if dad keeps spending like this...plus he's paying a fleet of full time body guards and chaperones (why not just keep her at home or take her to another city for a week or 2?) and of course paying himself and Bryan's on the payroll now too. Crazy stuff

Yep...daddy spears has put probably about 20 people or more onto Brit's payroll since he's taken over, about half of which are lawyers. I shudder to think what he's spent....my guess is that he's gone through millions already.

This guy Eardly is hanging himself with so much rope that the judge is just gonna blow up. Eardly had no business to get in this case and he just wants to get his name in the mix. He definitely should have known better. What an idiot.

59. Did anyone think that maybe this lawyer is trying to protect Britney's constitutional right to hire an attorney?
Or her right to make her own decisions regarding how she spends her money, career, etc?

Our beloved Brit was never convicted of a crime, yet she her civil rights are being restricted. Maybe that is what this is all about, not Sam.

I completely agree. ....though the people on here don't respect human rights or somehow think they should decide who deserves them. They think it's "a ok" to not be allowed your own lawyer to represent your interest in court proceedings that can so seriously impinge on your rights and liberty. Even the g'tmo bay guys are allowed to instruct lawyers, do people think they are any less crazy than Brit if they were out in the desert willing to die for Osama Bin Laden?

Nor do the people on here respect another very important right, that is "THE RIGHT TO A PRESUMPTION OF INNOCENCE". A right that every person in the USA is entitled to, but apparently, or at least according to the poll here, 95% disrespect. The guy hasn't even been charged and people are suggesting he should be shot. What does that say about today's American society? Pathetic

They can't sue him, the best they could hope for is asking that their legal costs be paid....however, if his client is Brit, then she would be paying those legal costs.

Brit however, may be able to sue the conservator once she regains control.

All the other media outlets are now reporting that there is no such investigation and the LAPD have gone on the record that SAM IS NOT BEING INVESTIGATED BY THE LAPD FOR ANYTHING.

You all must be so disappointed...you wanted him hung without a trial...weirdos.

62. Just think this could happen to any of us. Your ex or someone wants your kids or money or both. You suffer from depression and you have a greedy family and what happens? They try to convince the world you are crazy, have you taken away in an ambulance, put in a psych ward, and they take control of your money. They've leeched off you all your life, you had to pull daddy out of the gutter and pay for his rehab just a few years ago, then you gave him millions for a new restaurant, but he doesn't think it's enough, so he takes control of all your money and spends it before you are even allowed to hire a lawyer. The feds need to investigate Jamie and these "attorneys" he has hired to try to get control of Brit. Maybe the Feds won't step in on this case but maybe they canorder some kind of investigation. I hope so.

#87..., A Lawyer, ...Bankruptcy? Seriously?! Now my blood is really boiling! Sam reportedly told Lynn Spears, "Don't mess with me!", among other threats !( He reminds me of O.J.) It seems he is doing everything to financially screw this family if he can't continue his sick control of Brit.and her monies! ...Hopefully Jamie will prune some dead branches from his daughter's money tree before its to late!

Britney won't have to pay any of the legal costs. She can't hire an attorney; in fact, her right to form contracts appears generally limited due to her unfitness. The conservatorship's fees may be recouped directly from the attorney, John Eardley. I don't understand why everyone is getting so worked up about so-called "constitutional rights." For one thing, the probate court is taking great pains to protect Britney's due process rights, and is restricting her rights to make decisions regarding her estate and her affairs on a temporary basis because she currently lacks the ability to do so independently. This is fairly routine-and I don't see too many people lining up to protest at every probate court in the country.

Has anyone found any background on this attorney "Jon" Eardley? I am wondering if he is the same attorney as "John" Eardley with the "Rights For America" network of lawyers led by the Robert H. Weiss PLLC law firm with offices in Washington, DC and New York? If he is, I am guessing that in Britney's case he is practicing slightly outside his area of legal expertise.

DBK...if dad just wanted it temporarily, he wouldn't be spending millions fighting the Federal Court thing...he'd simply allow her control back and not waste her money fighting it. I want to see a psych report saying she is still gravely disabled before they give him any more power. If he's letting her go out to clubs on her own and flashing herself, he must think she's able.
