Hey Sam! You Got Served!

TMZ has learned Brit's BFF, Sam Lutfi, has finally been served with a restraining order from her parents -- sorta.

As we reported earlier, the restraining order had to be served by yesterday at 1:30 PM to be valid. We're told that since it wasn't served until today, it may not be valid! That means they may have to serve him again with updated paperwork.

We hear Sam was finally found at his house in West L.A., today at around 11:00 AM PT as he walked out the door.

46. However it was supposed to be served YESTERDAY so it might not be any good. Good job process servers - dumbasses. Seems funny they couldn't get him for weeks and weeks and the day after he's supposed to be served they find him. Something is fishy. They are probably friends of his.

48. Ok, for those of you who think Sam really drugged Britney, I have a question for you.... if she had those drugs in her system, why didn't they show up during her RANDOM drug testings?? This is a question I've been waiting for someone to ask much less ANSWER!! I don't know if he did this or not but I would think that if he was drugging her, those drugs WOULD HAVE showed up in the tests and since everyone has said that Brit's tests have come back CLEAN, then WHERE are those drugs at?? Also, wasn't it Sam and Brit's Dr. who planned the last trip to the hospital so late at night so that way it wouldn't be a circus with all the paps? To me, that doesn't sound like a guy who's trying to harm her. I think her mom is a bit off herself so anything that comes out of her mouth, I just find it hard to believe. Like someone said, her parents came in when things calmed down, turned the tables on him after he did all the hard work and then tried to take credit for the help Brit did get!! Kinda odd don't you think? Where in the hell where they when all this stuff was going on prior to the hospital trips?? Sure the dad showed up AFTERWARDS but mom, she didn't even come the first time it happened. Why? They said because she stayed behind to care for Jamie. Ok, that makes no sense seeing how Jamie's NOT a child. Well, she is a child but I mean a child in like being 4 or 5 yrs of age. Remember when Brit showed up with the paps when she gave her mom that letter? What did Brit say? She said her mom NEEDS help and that she hopes her mom gets it. Also in that letter, she said her mom was abusing prescription drugs. Well, what if mom is? What if mom DOES need the help Brit was talking about? IMO, I see both of them acting the same way... CRAZY!! It just wouldn't surprise me if the mom lied about Sam in order to get the attention away from her thus putting it on someone else and who better to put it on but the one person who is with Brit most of the time. Also, the bodyguard that testified, he never said that Sam treated Britney badly did he?? What about the cousin Ali. I haven't heard her say anything and she too was around Brit during this time so.... ??? I just don't put to much stock into what the mother says because of HOW her mother is. For a mother to sell her daughters story to a magazine, that pretty much tells me "what kind of a mother this woman is"!!!! Just a few things to think about.. Peace

49. The process server needs to pretend to be a pap and he will not have ANY trouble serving Sam on the first day the restraining order is issued.

50. 39. too bad it won't stick - now they have to re-do the paperwork, and re-serve (that is what they mean by "updating" it) - if it expired, it expired, they have to do it all over again - maybe this time, the entire world won't let them know first before they re-issue it

Mickey, actually, it will stick. The purpose of the requirement that a person be served 48 hours in advance of the hearing is to give him/her an opportunity to prepare and, if they want, to retain counsel to appear at the hearing and argue why the TRO should not be made a permanent restraining order. Since Sam was served less than 48 hours before the scheduled hearing, the court can -- and probably will -- reschedule the hearing and extend the TRO until the new hearing date. That gives Sam ample notice and time to appear. This avoids the need to re-serve. Now that Sam has been served, the conservators' counsel can give notice of future proceedings by regular mail.

The atty already filed an ex parte motion requesting the TRO hearing extended and the TRO extended too....

If they filed the paperwork before they served the guy then the commish/judge will most likely grant it unless there's a counter motion filed and theres no way oSAMa has done that yet

Your observations about the legal wranglings in Britney's life domnstrate that you either have some legal background or just possess good common sense. Glad to know there are ppl out there who understand the court system and legal process. Should be taught in schools, shouldn't take a law degree to understand how our courts operate.

60. her mom exagratted/lied in her depo so that sam would get the restraining order against him her mother wasn't even at britney's house that night until sam called her to come over, by lynn's own admission.
