78. DIANE T: The hearing will be rescheduled, since service was not accomplished until the day before. At the hearing the court will take testimony in order to determine whether to issue a permanent order. Lynne will no doubt take the stand and repeat what she testified to in her declaration. Maybe there will be other evidence offered. If Sam does not show up for the rescheduled hearing, then the court hears only one side and makes its decision based on the evidence it received. The court can still make some determination about whether Lynne is being truthful by judging her demeanor, like, does she hesitate in her answers? are there inconsistencies? etc. However, without cross-examination by Sam or an attorney on his side, it likely the court will accept Lynne's testimony and issue a permanent restraining order. Frankly, I think that even if Sam does contest the TRO, the court will nevertheless issue a permanent injunction. His evasion of service will weigh on the court, and Sam has a history of restraining orders issued for similar conduct, and these will no doubt come around and hit him on the backside at this hearing.

it's prbably a telling sin also that the judge seemed to indicate that if he had not been served by tomorrow's hearing she would most likely have extended t anyway........



Also, Rosie O-Donnel's been at it again (page6):

yea my spelling is realy bad sometimes - multi tasking probably causing carelessness.

Radar have updated the "RICO" story saying that "While Sands still insists the new papers are being filed, they likely won't be filed until the end of the month." - well, I don't know what the burden of roof is for RICO/rackateering/wire fraud, but I can imagine even with a low B.O.P it's gonna be tough building that one - probably easier to build against Lutfi...

Just more BS for publicity. It seems more and more evident that Sands didn't leave Kaplan's office because he was having so-called moral issues being a Brit-basher. He just wanted in on the press.....
