Hey Sam! You Got Served!

TMZ has learned Brit's BFF, Sam Lutfi, has finally been served with a restraining order from her parents -- sorta.

As we reported earlier, the restraining order had to be served by yesterday at 1:30 PM to be valid. We're told that since it wasn't served until today, it may not be valid! That means they may have to serve him again with updated paperwork.

We hear Sam was finally found at his house in West L.A., today at around 11:00 AM PT as he walked out the door.

91. I thought I had read somewhere that Reva Goetz would take "live" testamony (?) from Sam if he was not served in time..did anyone else read this or am I just getting old and doing too much homework?

94. britaculous: Sorry, I couldn't resist one more comment before getting out the door. I don't think burden of proof will even come into play, assuming such a suit were filed. Typically, what happens is, the defendant first files a Motion to Dismiss, arguing that the complaint on its face does not state a proper claim for relief. One of the things that the complaint has to do is set forth the court's jurisdiction to hear the case, and that is where Eardley stumbles over the same problem he has with regard to the removal action -- Brit currently does not the capacity to retain an attorney and therefore lacks standing to sue. The second problem is that RICO has to be pleaded with particularity -- RICO stands for "Racketeer Influenced Corrupt Organizations" -- essentially, it was originally enacted as a conspiracy statute as a way to reach mob-influenced businesses, but it has been expanded to include other business conspiracies. Very difficult to state a claim, and even more difficult to prove it. Remember, Eardley is financing this out of his own pocket (or someone is bankrolling him) on a contingent, so one has to wonder how much more risk he is willing to take. My guess is, not much. The court will slap him down, with sanctions. I wouldn't be surprised if the USDC enjoined Eardley from filing any more suits on behalf of Britney -- it would simply enter an order directing the clerk's office not to accept any pleadings unless they are filed by the co-conservators' counsel.

95. This guy is real slime, but his PR man Sand's even slimier because is the one that is telling Osama what to do. But I so believe in Karma, Mr. Sands exposed his ex-wife as a Bipolar patient, uses his own son for publicity to garner sympathy for himself. But neither one of them is worth a crap. Im sure Mr. Sand's sympathizes with Osama because he too probably had a hand in having his wife declared unfit and probably showed Osama the ropes! Until either one of them can produce a prescription for the meds Osama was giving Britney, he is guilty as sin and he should be investigated. I don't trust anything that comes out of Mr. Sands mouth (whatever little is decipherable) or any comments Osama makes against the Spears family. Britney seems alot better since he's been gone. Im sure she would have been dead by now if her family had not stepped in at the rate she was going. This is a family matter and everybody needs to step back and let her family take care of business. Obviously she doesnt mind, she's been seen with her mom very happy as well as acting like daddy's little girl with Jaime. The only thing she needs now is time with her son's and if people would give this family some space i'm sure she can get the medical attention she needs for whatever condition she has, Bipolar or Borderline Personality (most likely, as I am bipolar and my symptoms were similar to Britney's and they can be confused, or a person can be diagnosed with both). Treatment is for life and the patient must give 100% commitment to taking their meds, as well as therapy is a good psychologist. But there is absolutely no reason for her not to have a normal life in the future if given the tools to deal with whatever ails her. I contacted him because I was outraged that he would humiliate his ex-wife and son by revealing she is Bipolar when this woman has nothing to do with celebrity and God knows how this has affected her. I honeslty think HE has mental problems, the type that believes their own lies and have airs of grandiosity,

98. What does this guy actually DO for a living? I know his IMDB credits are all bogus, but seriously, how does he make money? Who are his parents? Do they have money? I hear they own gas stations (how glamorous), but what does HE DO? He says he never took $ from her, he says he's never been paid by x-17 or anyone else for photos/info. How does he pay his bills? This dude should make infomercials on how to get money, cars and attention from conning rich people and filing frivolous lawsuits.

Exactly just a PR stunt while Eardley TRIES to get some silly reason to the judge for moving the case! And as he has til the 29th it's no surprise that they are waiting til then to file these new papers! I hope they get slapped with the legal fees on the 29th.... and as you say the court clamps him down with other sanctions!

Wonder what else Sands is gonna cook up for Sam's court case! Sam has the so-called "film producer" credits, but it looks like Sands is the real story-maker!

101. Britalicious: You are so right about Sands being the story maker, if you could read the emails he's sent me you'd ROFL. If you read my previous post, you'll know what I mean, but here's an exerpt "this case will help Britney and many people forced into conservatorships where people get fleeced of their money by family members" THE ONLY THING HE HASNT REALIZED IS THAT HIS CLIENT, OSAMA IS DOING THE FLEECING.
This one was from the 11th if Feb: "It is okay...right now I am working on my Marine Air Wing deploying to Iraq and other government work." (YEAH, RIGHT)

102. My comment is simple. Do you think, with all of the positive things that Mr. Spears has done since he's had conservatorship, that he wouldn't dot the i and cross the t and be stupid enough to serve this ass with an expired order??? It just doesn't ring true.

Mickey, actually, it will stick. The purpose of the requirement that a person be served 48 hours in advance of the hearing is to give him/her an opportunity to prepare and, if they want, to retain counsel to appear at the hearing and argue why the TRO should not be made a permanent restraining order. Since Sam was served less than 48 hours before the scheduled hearing, the court can -- and probably will -- reschedule the hearing and extend the TRO until the new hearing date. That gives Sam ample notice and time to appear. This avoids the need to re-serve. Now that Sam has been served, the conservators' counsel can give notice of future proceedings by regular mail.
