Fed Judge to Brit -- You're Outta Here!

A federal judge has ruled the Feds have no business in Britney's conservatorship case and it has been sent back to state court.

Federal District Judge Philip Gutierrez ruled Jon Eardley, the attorney who claimed to rep Brit, "had no authority to remove the case from state court."

The judge added, "Mr. Eardley is not Ms. Spears attorney and acted improperly by removing her conservatorship proceeding to federal court."

The court did not award the conservatorship attorneys fees, which means it will cost Brit around $40,000 for what turned out to be a bogus case.

31. Ca is not paying for Brit's attorneys LOL She has to pay for her divorce attorneys, the mooches attorneys,for everything.
Unlike some p[eople she can pay her own way. So don't worry about Ca tax payers.

Great to see that it was kicked out of federal court.

I’m glad that I don’t have friends like Sam who cost me $40,000.

I wish the attorney’s fees had been awarded because it was such a blatantly stupid case in the first place.

33. Well, there never was any question in my mind that the federal court would reject Eardley's attempt to remove the case. But aside from the typo in the final sentence of section B, I think the court erred in its judgment by not awarding the conservator's legal fees when he prevailed. I can only speculate that court believes Britney is directly or indirectly behind this, and that the cost for such a stupid maneuver should be ultimately borne by her from her own assets, even though they are managed by the co-conservators. If that is the judge's reasoning, I'm not sure Britney can appreciate it. I don't think she thinks about money or what things cost, so $40,000 is something she is unlikely to give a second thought.

he was " SLOPPY "....

anyway....thats what they said my lawyer was.....because he screwed up my childsupport case....and i told him i didnt want him...........but he kept showing up..........acting like he was my lawyer.........

and the other lawyers ...said ............he was sloppy................lol....

38. britaculous: I agree that we probably haven't heard the last from Sands. Something tells me -- a suspicion, nothing more -- that Sands is the one who hooked up Sam/Britney with Eardley. Loved the footnote in the conservator's reply brief yesterday about the contradiction between Eardleys' claims that Britney's privacy needs to be protected and his publicist's (Sands) act in handing out free copies of the notice of removal to members of the press at the Probate Court. The irony is fabulous!

39. Whether Brit was directly or indirectly involved, as a lawyer, Eardley knew the case was frivolous, and should have advised his client(s). That's the trouble with a lot of lawyers, people present a case to them, and even though the lawyer knows there is no case, they pursue it anyway to rack up billable hours. A good, honest, attorney informs people when they don't have a case, and moves on to help people who do. If Eardley pursued this for notariety because Brit's name was involved, he failed miserably, and made an enormous fool of himself personally and professionally. Bella

40. Advice for Slutney: Wow! I can see you are just full of empathy for your fellow mankind! I hope nobody in your family ever has any type of addiction problems or has eating disorders. As for Britney losing 150 lbs, you must suffer from anorexia or bulimia, because she looks great for a mom of two, who had her kids back to back, even if it was with a surgeon, her weight is just fine. Enough is enough. She certainly did get herself into all this trouble and then to hook up with somebody like Lutfi who has made a living out of preying on people like her was the cherry on top of the icing on the cake! But I must asume you don't have a blemish on your character because God certainly will judge you with the same ruler you judge others.

45. Yea lawdawg. The whole thing is contradictory. She's not allowed to talk to her friends, yet Adnan visits frequently, Alli claims she talked to her, she is always pictured with a phone in her hand... She contacted him on the day she spent with Mom and at Millenium (not on one of the days she was most likely alone at home or could have sneaked a quit call in)...
And all this at the same time it was obvious to everyone that she would be able to get closer to her kids. Many perceive her as a "dumb blonde" but she's can't be THAT dumb.

I honestly think she did go to Streisand because she was worried about losing control. But at some point after Daddy laid down the law and they explained their plan at getting her closer to the kids she must have thought the step by step process would work in her favour...!? Maybe I'm just to ooptimistic here.

But if the court took into account that Brit could be behind it... Whatabout the fact that he's doen this before?
