Court to Brit's Daddy: Stick Around Pop!

Sources tell TMZ, Britney Spears' conservatorship has been extended through July 31, 2008.
Britney
The order, issued by the court commissioner today, is effectively a seal of approval for Brit's dad, Jamie. Papa Spears has been a co-conservator since Brit's latest breakdown.

Sources say the conservators are open to ending the conservatorship earlier than July 31, if Britney's mental state sufficiently improves and stabilizes.

47. Hey lawdawg. Where you been hiding.... Yes. The scenario sounds very familiar,,,, No names mentioned as to the fraudster. Interesting to see what they take into account. How do you think it might impact the custody case? I,e, if they come to an agreement can they right conditions in it that come to an end if the conservatorship ends? I assume that any agreement would remain in effect unless one of the parties broke a condition.... I guess this also means that Pops can make sure she cannot testify on the 17th, i.e. if she were subpoenad, they could use the same reasoning as the crim case?

50. lawdawg, I wish that TMZ would add you as an additional filter to explain the minimalist coverage they give to the stories. My expertise is not in legal areas such as this, so an educated voice is appreciated! And where there is a lack of information or understanding, you will find an industry of rumor mills cropping up!

Posted at 10:33PM on Mar 5th 2008 by You're appreciated!

51. He is Britney's and Jaime-Lynn's Father but, he has a bigger fan-base across the World than the "Spearettes" do now. We love you Daddy Spears!!

Open your eyes, Britney! Find a REAL man like your daddy. You don't needed those foreign freaks and the other thieves in your life. Get rid of Ali too.

53. WTF....This is crazy and scary stuff. She is well enough to drive and to go out in front of the paps everyday and have a paparazzi boyfriend, but not well enough to spend even one penny of her own money....this makes no sense and is scary. She is clearly not that incompetent and I can't believe this can happen to someone in the USA. I sure hope someone steps in and does something about it.

55.
A question for the Sam Lutfi supporters out there.

Why is it important to you to have contact re-established between Britney Spears and Sam Lutfi?

58. Thanks, appreciated. TMZ is always misreading and misinterpreting the meaning of legal things. But of course, they have to make it sensational so idiots like us will visit their site and they can get their advertising $$$$.

britaculous, I haven't been hiding so much as there really hasn't been much that TMZ reported on that was worth blogging about. I get a day of free research each month on Westlaw, so last week I did some gratuitous research on conservatorship law in California. Lots of these cases seem to involve persons diagnosed as bi-polar, and most have refused to take their meds and/or signed over financial control to someone who takes advantage of them. Sad. Anyway, except for a recent posting that looked like you had an imposter, I see that you been the voice of reason. Keep up the good blogs!

59. Kudos to Jamie. Now he can keep the blood suckers away. Brit needs a pit bull Dad in her life to slap some sense into her and guard her estate and keep her in line. I just hope she see the benefit in the long run. Now the tabloids can find something more interesting to report over following her around everyday hoping for a tragedy to happen.

60. The entry of the order today suggests to me that Britney waived her right to a hearing. That is, at this time she is not contesting the conservatorship. She probably isn't happy about it, but I suspect that her doctors and attorneys had advised her that she would be fighting a losing battle at this point. Better to focus on her treatment plan and then file a motion in a few months requesting the court to relax the conditions and maybe end the conservatorship early. Thus, today the court could go ahead and, on the basis of the doctors' reports and the investigator's report, make a finding that Britney meets the conditions for establishing a permament conservatorship.

Lawdawg...if one accepts that Brit is incapable of making proper legal decisions, then that should of course include her ability to make the choice to waive her right to a hearing. If she is incapable of speaking with lawyers, then of course, that should include the ones you refer to giving her advice above. If she is incapable of speaking with lawyers, then she is also incapable of making a decision of this gravity and nature on her own. If you are a lawyer, you should know that?? I'm a lawyer and I certainly know it.

As you would know, if the Commissioner had allowed her her rights, she would have had representation, had an opportunity to meet with a psych of her choosing for the purpose of obtaining her own report and calling him/her as a witness. At the moment, the Court is basing it's decisions, on unchallenged evidence, and not allowing the person who has their rights affected to even get advice or have a lawyer appear on their behalf. That happens in lots of countries, but not in most common law western countries. Again if you are a lawyer, you should know all that, and you should also know about "Natural justice" which says anyone who's rights, interests etc are to be affected by a decision of the court, has a right to be heard, present, and challenge evidence in relation to those decisions.

If she can drive a car, she can talk to a lawyer. Any real lawyer can see that this is a bunch of b.s. and nothing like the case you are citing, unless of course what you are referring to are possible remedies for Brit should her father mismanage her own finances (like he did his own).

Are you sure you are a lawyer lawdawg?...you could have fooled me.
