Dennis Quaid's Weird Legal Non-Move

Cedars-Sinai Medical Center tried to cover-up a massive medical screw-up with Dennis Quaid's newborn kids, at least according to sources who spoke with TMZ when we first broke the story. So why the heck isn't Quaid suing the hospital?

As we first reported, after a Cedars nurse gave the kids several massive overdoses of the blood-thinning drug Heparin, they were spurting blood but Cedars never notified the parents. The kids are fine now, and the Quaids have sued the manufacturer of the drug, Baxter Heath Corp., for mislabeling -- but Cedars is not a defendant. Why the heck not, you ask?

We're told Quaid really wants to make a statement and it's not just about one hospital screw-up. The mislabeling problem has happened before -- sometimes with fatal results -- and Quaid wants to take a stand. But here's the deal. Sources tell us the hospital was holding meetings trying to figure out how to handle the problem at the same time they were keeping the info from the parents. What would you do?

16. He should not sue, what is he gonna get out of it money? He has it. It was horrible thing that happened and Thank God his babies are Ok but ppl do not need to take any more money from hosspitals. How many nurses have to work overtime because hospitals cannot afford to hire new staff? Maybe that is why they dont pay attention to what they do. Don't get me wrong I am not making excuses for the person who overdoes his kids, but I think he should use this experience to shed light on things like this. Maybe the company could start making the bottles look different. Or they could just plaster the name of the person who did this everywhere so that next time ppl are more carefull. The money will not make any difference to him but to the hospital and those treated there it will. PS. even if a surrogate delivers the babies they can be 100% biologically theirs. Many mothers can concieve but not carry to term. Also, Angelina is like 30 and we dont know IF she is having twins.

18. He's taking a principled stand, but the hospital's actions were conspiratorial and not in the patients' best interests. So I wouldn't let Cedars-Sinai off the hook (and neither should Britney Spears!).

20. Thank God that those babies are "ok". However, infants can suffer from learning disabilities, emotional development issues, etc., due to loss of blood to the brain, heart, and/or major organs. These may not come to light until these children are older. I, personally, as a young baby ran a very high temperature with measles at one month. My parents were told I may die, and that if I lived I may have learning disabilities, and/or emotional problems. I do have a learning disability. I do not handle everyday decisions like most people. I have Multiple Sclerosis. Although intelligent, I have problems. Also, my Mother was young, and very naive, the doctor who delivered me was NOT a pediatrician or obstetrician, a simple MD, he told my Mother to feed me equal parts of Kayro Syrup and Evaporated Milk. CAN YOU IMAGINE??? An infant's digestive system is very sensitive. Mom said I threw up constantly and THE doctor in town acted like it was no big deal, eventually changing me to infant formula. I have suffered from obesity all my life. Like I have an addiction to sugar. Well, for the first month of my tiny life, I was force fed Kayro Syrup and Evaporated Milk..NOT DILUTED. I can't imagine an adult being able to drink that without throwing up. Ever wonder if this is some sort of pergatory??? This life is no cake walk, ya' know?

Obviously Quaid decided the problem was bigger than the hospital and figures the better way to go is to sue the manufacturer. It's his decision. TMZ doesn't even have all the facts completely straight, but that is just par for the course.

22. I HAVE SEEN HOSPITALS AND STAFF GO TO GREAT LENGTHS TO HIDE ERRORS. NURSES AND DOCTORS ARE EQUALLY GUILTY. IN THIS CASE I AM SURE THE NURSES PICKED UP THE HEPARIN VIAL AND ASSUMED THAT THE PHARMACY HAD STOCKED THE CORRECT DOSE IN THE MED ROOM DRAWER AND THE NURSE FAILED TO DOUBLE CHECK THE DOSE WITH ANOTHER NURSE. THIS IS A POLICY WITH THIS DRUG AND OTHER POWEFUL DRUGS SUCH AS INSULIN IN EVERY HOSPITAL I HAVE WORKED IN FOR 30 YRS.

23. Victoria (#9)--One reason older women conceive and have twins has nothing to do with test tubes--these women take fertility drugs so that they have multiple ovulations, that's all it is. It's not happening "in a tube," it's simply injections that women take to improve their chances of conceiving, and this means multiple eggs, which often results in multiple births.

24. While manufacturer's could and SHOULD label or package similar medications differently to prevent such errors, the bottom line is to READ THE DAMN LABELS!!!! Not once, not, twice, but many times! Have someone else double check before administering to patients. It's human error.....well, actually STUPIDITY on the nurses part, but the bottom line is that the hospital is responsible for it's employees when they cause harm.

My shampoo and conditioner are from the same company. Same bottles, sizes, color, etc. Almost identical. Somehow, even with poor vision and no glasses, in the steamy shower I can manage to get them straight! And it isn't a matter of life and death if I confuse them! No excuse for this mix-up!

26. if he has decided not to sue the hospital then i think some deal has been reached between him and cedars like maybe free health care for him and his family maybe until the twins reach 21 ! Iknow it might sound stupid but think about how much healthcare can cost ! Who knows?

27. He should certainly sue ... not because it would undo what happened to his kids (it wouldn't), but because it could prevent it from happening to someone else. As much as I hate litigation and dislike most lawyers, lawsuits like this are one of the few ways to make pharmaceutical companies, hospitals, and other corporations change their practices. It's too bad, but that's the way it is. It also gives the public a heads-up that problems like this exist ... which you're better off knowing BEFORE something happens to you. In short, vengeance has nothing to do with it.

The hospital tried to cover it up?
The manufacturer, the hospital and the nurse should all be sued - let this be a lesson that they ALL sure as hell better do their jobs right.

There is a recall of Heparin in effect right now.

Something about contaminated ingredients from China.

The attorneys are probably awaiting the results of that investigation.

(my guess, anyway).

Cause you know, eventually this is a BIG BUCK$ case!

30. I think this proves what I had suspected for number of years. Dennis Quaid is a terrific, fair, caring man. Quaid doesn't want to take money away from the hospital because he knows overall a hospital needs money to help people get well and he has enough money. He's not a greedy pig. Quaid being the good guy that he is choose to sue ONLY THE DRUG MANUFACTURE OF THE HEPARIN so from now on hopefully the manufacture of the drug Heparin will be forced to alter the medicaation lebel of the vials of Heparin to make the different doses appear very different ---- so the nurses won't when in a hurry, confuse the different doses of Heparin and overdose and harm another person's child.
I think Quaid did the right thing!
