Thomas Jane Popped for DUI

TMZ has learned "The Punisher" star Thomas Jane was busted early this morning for DUI.

Jane, whose real name is Thomas Elliot, was nabbed in Kern County, Calif. by CHP officers just before 3:00 AM. He has been charged with DUI and driving with a blood alcohol level above .08% -- both misdemeanors.

CHP tells TMZ Jane was stopped in a late-model Maserati for driving at "an extremely high rate of speed" on I-5. We're told he failed several field sobriety tests, including a breathalyzer. Cops also say he was also driving with a suspended license.

A cooperative Jane was taken to the pokey and he's already out. His arraignment is set for April 9th.

Jane is married to actress Patricia Arquette.

Well, I have to say that while I hate drunk driving....and I guess it's different for everyone where "drunk" actually occurs....that I have to say that .08 seems awfully low to be "legally drunk." And, yes I used to be a cop and yes, I arrested people for this limit, although, I saw people driving at .40 (!!!!) and ended up stopping them for a busted tail light and only then found out they were drunk!
Otherwise I would have never known! Some people can't drive at .05. Others can drive til a limit that would kill the average person. I have always had a hard time with this law. I guess I just find it arbitrary...
