Shia's Attorney to Judge: Smoke This!

TMZ has learned that Shia LaBeouf finally showed this morning in a Burbank, Calif. court this morning to enter a plea -- sorta.

Attorney Michael Norris appeared on the "Transformers" star's behalf and pleaded not guilty to unlawful smoking.

A judge had issued a warrant for LaBeouf's arrest after he or his lawyer failed to appear yesterday in court.

A date of April 24 was set for an arraignment and pre-trial hearing.

UPDATE: Norris tells TMZ a warrant was ordered yesterday, but never issued -- so Shia "was never in danger of being arrested." The warrant was withdrawn today.

17. I think this kid is full of himself. No matter what your opinion regard to smoking or smoking laws, he is not above the law and must comply just like you and I. He was also arrested in November of 2007 for refusing to leave a Walgreens in Chicago, go figure?? But why I really say this is because of the attitude he had when he was on the HBO reality series "Project Green light". He spent hours trying to get into character, it was just so pathetic.

Well, er, no they aren't... must be from California! Probably meant Nicotine. Well so is caffeine and the ingredients in Aspirin. And they are all legal to use, so what's your point?

19. Surely you jest. Cigarettes are legal and have never been classified as a drug. Like it or not, WHAT A WAST OF TIME AND MONEY, in a State that depends on Tobacco Taxes to survive. 22. One morning, while I was enjoying Venti Americano and NYTimes at the local Starbucks, I received one of the first tickets for smoking on San Fernando Rd here in Burbank. It's not so much a ticket as it is a bench appearance ticket to the Burbank Criminal Courts on Olive Ave. The law (BMCC 17-708) makes it a Misdemeanor Criminal Offense to smoke anywhere within the "Village Limits" which is a small area from 1st to 3rd street and Angelino to Burbank Blvd. For the rest of the city, you're not allowed to smoke within 20 feet of doors.
I stood before Judge Nyby and plead not guilty but was finally given the choice of either going to jury trial using a constitutional defense or accepting the reduced charge of "Infraction" without Misdemeanor and a $25 fine ($123.00 after bloated court fees)
Shia was apparently here one day doing the same HORRIBLE thing! Smoking a butt on his was to either the AMC or Markett City Cafe. What a crime!!! Not appearing on or before the date on the ticket has resulted in a few people here spending the night in jail. YES, JAIL! For SMOKING! A CIGARETTE for Christ's sake. When will it all STOP?
I guess I'll be hearing from a few of you about the health ricks, blah, blah, blah... well, have at it then...

23. What a backward place we live in.......seriously. The Burbank Police have absolutely NOTHING to do out here so they impose all these crazy little laws to give the police some excersize. Too bad it has to be at the expense of good people whose only want to enjoy a cigarette outdoors (like we are supposed to be able to do). I feel sorry for Shia, they are trying to make an example out of him.

29. I think that these Smoking Bans in outdoor areas are Stupid and ridiculous. They are a huge waste of Taxpayer's money and a waste of the Police and court system.Why don't you people do something constructive? Here you are complaining about people who smoke cigarettes in outside locations...meanwhile, you are sitting down at an outdoor cafe or Starbucks...drinking coffee and sucking in all of the car fumes along the busy streets. What about all of the smoke you are inhaling from the refineries and forest fires?
**A person who is born in Los Angeles and who never smokes a cigarette...in his life...by the time he is 21 years old...the inside of his lungs are black...not from the cigarettes, but from the poor air quality due to car fumes, refineries,...etc.
***You complain about a cigarette...what is that brown stuff overhead that we are breathing every day. I know the politicians and weathermen call it haze. People...haze is not brown. FIX THE BIG PROBLEMS FIRST BEFORE YOU GO AFTER THE LITTLE PROBLEM

30. So . Burbank, CA is a NON SMOKING city, but you can drive a car? I guess it's only because of the bad smell? Are you sure it's smoke from cigs that give you cancer and not that stuff that comes out of the back of the car and is in the air we breath? People don't get lung cancer from second hand smoke, they get it from breathing the air.
