No Homicide in Death of Anna Nicole's Son

Big news in the Daniel Smith inquest -- the magistrate in the case will not be giving the jury the option to rule his death a homicide.

In a Bahamian court today, the parties discussed four possible options as the cause of death -- accident, "misadventure," non-dependent drug use and an "open verdict."

We're told the magistrate will instruct the jury on those options on March 31.

No one, including Virgie Arthur's lawyer, suggested that homicide was an option.

As for the options, "misadventure" is defined as "a hazardous course of action which ended fatally." An open verdict means the jury can't decide the specific cause of death.

31. Good point. Has anyone thought of this? Will this poor kid EVER get any justice? You cannot believe that he went to the Bahamas to see his new sister and commit suicide. Preposterous.

34. I know this makes me a minority but I don't think Howard Stern is that bad a guy. He stayed with Anna through all of her nonsense trying to take care of her. He was the closest thing Daniel had to a father. People think he was so terrible for saying he was Danilynne's father and keeping Virgie Aurther away from the baby. Guess what? He was only trying to do what Anna wanted. Anna was quite adamant about not wanting Larry Brikhead in the baby's life...in fact she moved to the Bahamas to insure that from not happening. And we all know she hated her mother. Larry Birkhead was only trying to do what Anna asked him to do. Give the guy a break.
I was not a big Anna Nicole fan...never watched her show...pretty much thought she was a joke. But one thing I did get from hearing her talk and seeing the pictures of her and Daniel is that she LOVED her son. I hope the are both at peace now.

After Daniel was found dead at Nassau's Doctors Hospital on September 10, 2006, two autopsies showed a toxic mix of methadone and the anti-depressants Lexapro and Zoloft, but the Bahamas police forensics chief testified that the high level of methadone was enough to have killed Daniel and that he could have had it in his system when he landed the night before.

The summations are concluded in the inquest into the death of Daniel Smith. Suicide as cause of death was pretty much taken off the table by Bahamian Magistrate Campbell. That of course leaves the jury to deliberate “accidental death” and “intentional death” as in foul play. A decision of foul play would signal that more investigation is needed. The jury has until March 31st to deliberate and come back with a verdict.

After all, removing methadone pills from the dead man's clothing and then flushing them isn't probable cause ,in this jurisdiction ,to believe he had advanced knowledge of the illegal possession.

Who knows? Stern might actually practice law or something.

41. To Rico....#4 comment----I know where you are coming from about those nasty holes on someone's butt. From my experience as a Student going to school to be a Doctor....... most of those I have seen were from people who used lots and lots of illegal needles. They cause awful, horrible infections and can manifest any plae on the body....not just where the injetion took place!!!!!!

Has to do with the coroner's decision and the jury verdict. In cases where homicide is NOT taken off the plate of option and the jury reaches an open verdict, he goes by majority rule or what we call preponderance of the evidence which is not unanimous or calls another inquest. There are many British cases like this where homicide was an option, but the jury simply was unable to produce enough evidence from the police investigation. That is not the case here as you know. In this case an open verdict would only be one of those options being given the jury and since it does not include homicide, it is doubtful another inquest would be called regarding the verdict IMO.

If VA can accept this then why can't you. No crime has happened and that is the facts. Time to move on. Maybe just maybe Anna and Daniel can rest in peace. We all need to learn from this and the dangers of prescription drugs. More and more people are dying from this, and we need new laws in place so fight for new laws to happen so these drugs cannot be easy to get.
