No Homicide in Death of Anna Nicole's Son

Big news in the Daniel Smith inquest -- the magistrate in the case will not be giving the jury the option to rule his death a homicide.

In a Bahamian court today, the parties discussed four possible options as the cause of death -- accident, "misadventure," non-dependent drug use and an "open verdict."

We're told the magistrate will instruct the jury on those options on March 31.

No one, including Virgie Arthur's lawyer, suggested that homicide was an option.

As for the options, "misadventure" is defined as "a hazardous course of action which ended fatally." An open verdict means the jury can't decide the specific cause of death.

One this is not true. McCabe has made a motion to the courts to add TMZ and others. The judge has not rule on it either. McCabe will have to show the court why he wants to add more people and think he will have a very hard time with that because of first amendment rights. How many times a day do you think Harvey is serve court papers. If he was to write articles on that heck he would never have any time for anything else. Just because a person wants to sue someone, until the judge rules in favor of it, it is NOT a law suit.IMO

Daniel Smith's Death Cannot Be Ruled a Homocide

The death of Daniel Smith, Anna Nicole's son, cannot be ruled as a
homicide, a Bahamian court announced on Thursday.

A court magistrate in the inquest would only be able to list the
cause of death as either an accident, "misadventure," "non-dependent
drug use" or "open verdict." No one involved in the case had
suggested homocide as an option.

"Misadventure" is defined as "a hazardous course of action which
ended fatally, while an "open verdict" means the jury was unable to
come to a conclusion of the cause of death.

Just accept it.

53. I will never change my opinion about Howard's part in these two deaths. It only means that the inquest was delayed too long & evidence was lost or a cover-up. Howard reminds me of Drew Peterson.

The summations are concluded in the inquest into the death of Daniel Smith. Suicide as cause of death was pretty much taken off the table by Bahamian Magistrate Campbell. That of course leaves the jury to deliberate “accidental death” and “intentional death” as in foul play. A decision of foul play would signal that more investigation is needed. The jury has until March 31st to deliberate and come back with a verdict.

56. Well I for one am very pleased with this. Howard never did anything to Daniel. He loved him like a brother-son and Daniel loved him back. I hope that Howard can have some peace as this inquest had to be very hard on him. He lost 2 people that he loved the most in this world. I try to feel sorry for Virgie but her behavior in this whole saga has been shameful and disgusting. But I wish she just would except that Anna and Daniel should be allowed to be at peace and that she is never going to get custody or control of anything that involves DL. She has spent many years calling her daughter a drunk and addict, and when her daughter does overdose she then says it was murder. Virgie move on this is not healthy for you to continue this BS.

Newsflash - Her daughter was a drug addict!
HKS did NOTHING to get Anna off of the drugs she was on. He enabled her abuse by having her prescriptions filled in his name and sent to the Bahamas......

60. Nope! Virgie's attorneys did not agree. The only thing that was
agreed upon was that suicide is pretty much ruled out. That is all.
Everything else is still on the table and the jury was not heard from
and will not be heard from until March 31st. TMZ has been lied to or
is lying.
