Crash Victim to Hogans: You're Responsible

The family of John Graziano, the man injured in Nick Hogan's August 2007 street racing crash, has filed suit against Hulk, Linda and Nick Hogan alleging they were negligent and are directly liable for the wreck that seriously injured the former Marine.

According to court papers filed today in Pinellas County, Fla. Circuit Court by Graziano's court-appointed guardian Peter Musante, Hulk and Linda (whose real names are Terry and Linda Bollea) should be held legally responsible for their son's accident.

In the suit, Musante alleges that Nick negligently operated his Toyota Supra by racing another man in a Dodge Viper, a car also owned by Hulk. The suit claims the Bolleas were aware of Nick's need for speed and knew that he had souped-up his vehicle for the purpose of racing.

Launch photosIn the suit, Musante also says Hulk purchased alcohol the day of the accident -- August 26 -- and that Hulk "knew or should have known" Nick was driving under the influence of the crash and he failed to take appropriate action.

The lawsuit also names Daniel Jacobs, who was driving the Viper that night, as a co-defendant. He pleaded no contest to reckless driving last month.

46. I guess I shouldn't be shocked, but I am. Was Terry under the influence at that time? Terrible decision-making and parenting.

Any seat-belt wearing nonwithstanding,Terry absolutely could have prevented this from happening and his minor kid was driving. I think it's a crying shame all around, but I think the Bolleas will have a very large judgement against them due to really bad parenting. And they deserve it. It won't bring John back, though. Nothing fixes that.

47. Of course the are responsible, they gave a knuckle headed teen age boy a leathal weapon as a gift!!!!
They knew full well his driving record and limitations to think rationally. What parent of a teen doesn't??
They are fools and are responsible, the divorce is probably a fake to ditch their responsibility to the victim.
If poor little Nicky were the victim I wonder how they would react???

48. It dosn't matter to the law if the passenger was drinking! Nick is the driver the owner of the car! When this goes to court it's gonna be the same thing said...You own the car you acted none responsible! Who cares what the passenger did...unless he actually grabbed hold of the steering wheel or gas peddal! Now STFU and pay up hogans!!

50. That is absolutly retared. Hulk and Linda are in no way responsible for that accident. It's all fun and games until someone loses an eye. Thats also why they have something called insurance. Sue the insurance company not people who had nothing to do with the situation. They wernt even there.

51. I think they are suing out of greed. What is health insurance. He was military so you know his medical is taken care of . They just want to make sure they are taken care of . I have no respect for this family. Not to mention the kid knew how Nick drove but still got in the car with him time after time. Truth be told he was probably cheering him on to go faster.

52. Some people seem to be missing the point, that the Hogans are responisble because their son is underage. Is this happened a year later, they wouldn't of been sued just Nick would've been.

For everyone that is saying John is responsible for not wearing his seat belt and suing is ridiculous, I wonder how you would feel if it were your son lying in a hospital bed brain dead because his friend decided to street race with him as a passenger. Bet you would be singing a different tune then.

53. come on, boys will be boys and thats what they are BOYS...they knew what they were getting themselves into everytime they got into the car with nick or drove his car...it was bound to happen one of these days. Suing them is just an excuse to get money. Nick is obviosuly and idiot..but aren't most guys that age. I guess someone has to be blamed and since he was driving. What if John told Nick to race the other guy and was pumped about it and egged him on to do it? Who knows. I bet he was all excited to race..just so happens hes the one that got hurt. It wouldn't be as big of deal if nick got hurt John wouldn't get sued I bet. Just give Johns family some money cause money cause money is gonna make their 100% better...riiight.

54. If the parents are not responsible for the minor son then who is? Parents need to be held responsible for thier childrens complete lack of consideration for their life and others. This gentlemen will win the suit.

55. If you are old enough to operate a vehicle and you do; why should your parents be responsible for what you do if an accident happens? Do your parents go to jail for you if you get pulled over for drunk driving? Give me a break....They know the parents have money and want to cash in.

56. For what may be the first time in his life; If something is not done, to ONCE AND FOR-ALL hold Nick Boella, personally, and or legally accountable for a history of maintaining a serious, dis-regard for his own, destructive and negligent actions.....

Mr and Mrs Boella, School officia's, Highway Trooper's , etc, etc...Nipping it in the bud, and getting ahold a long, long time ago; could well have prevented chosen acts of irresponsibiilities, which led up to a recent tragedy.

Sometimes, you just have to say NO - Oherwise, someone else along the way...will.

Nick is old enough to make his own decisions..... if old enough to drive he is old enough to take blame IF he did something wrong..... all the drinking speculation is just that SPECULATION.... why is this guy hanging out with a 17 yr old and if i am remembering right at 17 and you break the law your will more than likely be charged as an adult....I always find it funny how everyone is quick to blame ....lmao....like the guy didn't know that they were gonna race or even thought that was no possibility, he drives professionally or did before this happened , it is just sick how everyone jumps to sue people on speculation, were his parents there and know what their son was thinking or what those two were doing that noght?? doubt it! this family i agree with "WHATEVER" that they are trying to cash in on a accident and if these families have been friends for soooo long and when they get their chance they sue..... although my prayers go out to he and his family it is all just a bit overboard, but i guess it always is when it comes to celebrities!

60. Okay, you won't agree with me but Linda should not be sued. While parents are liable for their children's actions to a degree, Linda was not liable as she likely had no knowledge of the street race until after it occurred. (This is why the divorce and splitting of the assests is a good idea) Terry (Hulk) should be liable because he bought alcohol and allowed his vehicles to be operated by these persons. The vehicles were titled in his name only. (The suit claims co ownership by Terry and Nick however, Nick as a minor, cannot legally own a car, not even 50% of it.) However, lets be real here for a second. It's sure sad that the former Marine has been injured this bad but I doubt he was tied down in the car. I doubt he told Nick to slow down. He consented to the streetracing. And by the way, forcing your former Marine son to live as a vegetable for the rest of his life is awfully selfish. It's hard to let go but I doubt John would have wanted to live this way. The parents are trying to make a buck off of their child's misfortune. For god sakes, they put him in a nursing home instead of having home care. They don't give a crap about anything but a pending paycheck.
